STATEMENT OF WORK (SOW)
PART 1 GENERAL
1. SCOPE OF WORK: This contract is for a broad range of Sustainment, Restoration and
Modernization (SRM) work on real property at Fort Drum, New York. All work shall be performed in strict accordance with all the terms, conditions, special contract requirements, specifications, drawings, attachments, and exhibits contained in the contract or incorporated by reference. This contract will be an Indefinite Delivery/Indefinite Quantity (ID/IQ) type contract and will employ a wide variety of individual construction tasks (approximately
35,000). The scope of work will include tasks in a variety of trades, such as carpentry, road repair, roofing, excavation, fiber optics, building automation, interior electrical, exterior electrical, plumbing, sheet metal, painting, demolition, concrete masonry, and welding.
During the contract period, as specific requirements arise, the Government will implement the process set forth in Section 00800 Additional Contract Requirements paragraphs 31, 32, and
33, to develop and issue individual task orders to this contract. The Contractor shall provide, upon receipt of a Task Order, all work, materials, supplies, parts (to include system components), plant supervision, labor, and equipment, except when specified as Government
Furnished, to repair or construct real property facilities and structures on Fort Drum. Ft Drum will not provide any office or government space on the installation.
1.1. The Contractor's work and responsibility shall include all Contractor planning, programming, administration, and management necessary to provide all repair or construction and related services as specified. The Contractor shall perform the work in strict accordance with the contract and all applicable federal, state and local laws, regulations, codes, directives, and Installation policies. The Contractor shall insure that all work provided meets the requirements stated in the drawings and specifications identified in the contract and task orders. The Contractor shall provide related services such as preparing and submitting required reports, performing administrative work, and submitting necessary information as specified under this contract and within individual Task Orders.
1.2. The Contractor shall maintain a 30 minute response time to Building T-4895 at Fort
Drum, in order to receive work requests and provide other contract services related to accomplishing multiple jobs.
1.3 POSITION REQUIREMENTS/CONTRACTOR STAFF/KEY PERSONNEL: The
Contractor shall maintain a full-time management and technical staff dedicated to the performance of the JOC at Fort Drum to respond to the requirements set forth in this contract.
The management and technical staff shall be located adjacent to Fort Drum so that it will meet the 30-minute response time stated in paragraph 1.2 of this SOW. On-site means the contractor managed office which facilitates the response time specified in paragraph 1.2 of this SOW. The Contractor shall provide an On-site Contract Manager and an Assistant On-site Contract Manager; these individuals and any individual designated to act for them, shall have the full authority to contractually commit the Contractor for prompt action on matters pertaining to administration of the contract. The On-site Contract Manager and Assistant On-site Contract Manager shall have the authority to contractually commit the Contractor during negotiations and shall have on-site authority to promptly sign task orders and modifications.
They shall be designated in writing 10 days prior to contract performance (listing name, address, cell phone numbers, and home telephone number) to the Contracting Officer. The
On-site Contract Manager shall be responsible for the overall management and coordination of this contract and shall be the central point of contact with the Government for performance of all work under this contract. On a temporary basis only, another individual may be designated to act for the On-site Contract Manager or Assistant On-site Contract Manager;
however, 10 days advanced written notice of such change shall be provided to the Contracting
Officer. The Contractor’s staff shall meet the position requirements as stated in the SOW.
The Contractor shall provide experienced and knowledgeable personnel in civil, structural, architectural, mechanical, and electrical engineering disciplines. If the case arises where a key staff member is to be replaced, the Contractor shall notify the Contracting Officer within
10 days. The replacement staff shall meet or exceed the same minimum qualifications as stated in the SOW. The On-site Contract Manager or Assistant On-site Contract Manager shall be physically present and reachable at the on-site location from 7:30AM to 4:00PM, Monday through Friday, except on legal holidays. These individual(s) shall be able to understand, speak, read, and write the English language fluently.
1.3.1 On-site Contract Manager: The On-site Contract manager shall have a Bachelor’s degree in construction/industrial technology or a related technical field and five years of specialized experience managing/supervising (i.e., as a job superintendent or higher level position) multiple construction projects (preferably JOC, SABER or IDIQ contracts) totaling over $20 million. Experience of ten years of specialized experience managing/supervising
(i.e., as a job superintendent or higher level position) multiple construction projects
(preferably JOC, SABER or IDIQ contracts) totaling over $20 million may be substituted for the Bachelor of Science (BS) degree and five years of experience. In addition, prior to performance, the On-site Contract Manager must also have completed a total of 30 hours in
OSHA General Construction training courses. Proof of completed OSHA training shall be provided to the Contacting Officer.
1.3.2. Assistant On-site Contract Manager: The Assistant On-site Contract Manager shall have an Associate’s degree in construction/industrial technology or a related technical field and three years of specialized experience managing/supervising (i.e., as a job superintendent or higher level position) multiple construction projects (preferably JOC, SABER or IDIQ contracts) totaling over $10 million. Experience of five years of specialized experience managing/supervising (i.e., as a job superintendent or higher level position) multiple construction projects (preferably JOC, SABER or IDIQ contracts) totaling over $10 million may be substituted for the Associate’s degree and three years of specialized experience. In addition, prior to performance, the Assistant On-Site Contract Manager must also have completed a total of 30 hours in OSHA General Construction training courses. Proof of completed OSHA training shall be provided to the Contracting Officer.
1.3.3. On-site Quality Control (QC) Manager: The QC Manager shall have a minimum of ten years specialized experience as a project/job inspector or quality control specialist in a construction environment, and have experience with construction industry standards and codes. In addition, prior to performance, the QC Manager must also have completed a total of
30 hours in OSHA General Construction training courses. Proof of completed OSHA training shall be provided to the Contracting Officer. The QC Manager shall be on-site during normal business hours. An alternate for the QC Manager shall be identified to serve in the event of the QC Manager’s absence. The alternate QC Manager shall meet the same qualifications as the primary QC Manager.
1.3.4. On-site Project Engineer: The Project Engineer shall have an Associate’s degree in construction/industrial technology or a related technical field and three years of construction experience on multiple projects totaling over $1 million. Experience of five years of construction experience on multiple projects totaling over $1 million may be substituted for the Associate’s degree and three years of experience.
1.3.5. On-site Drawing Operator: The Drawing Operator shall a minimum of five years drafting work, and two or more years of construction experience on multiple projects totaling over $1 million.
1.3.6. On-site Contract Administrator: The Contract Administrator shall have a minimum of two years accounting experience and one-year experience in construction contract management and payroll duties.
1.3.7. Contractor Personnel:
1.3.7.1. Contractor employees shall be subject to the same general rules of conduct while on the installation that apply to Government civilian employees. Violation of such rules, regulations, laws, directives, or requirements shall be grounds for removal (permanently or temporarily as the Government determines) from the work site. Individuals who violate such rules, regulations, laws, directives, or requirements may be denied access to the Installation, either temporarily or permanently.
1.3.7.2. Contractor employees shall be appropriately dressed, including individual protective clothing and equipment, for the work to be done.
1.3.7.3. The Contractor shall not allow any employee having possession of, or under the influence of alcohol or controlled substances to perform work. Marijuana is an illegal controlled substance under Federal law.
1.3.7.4. Relationship between Government, Contractor, and Contractor Personnel: The services to be delivered by the Contractor to the Government are non-personal services, and no employer-employee or master-servant relationship exists or will exist under the contract between the Government/Government personnel and Contractor. Contractor personnel are solely responsible to the Contractor, who shall be accountable to the Government. The services to be performed under this contract shall not require the Contractor or its employees to exercise personal judgment and discretion on behalf of the Government, but rather, Contractor personnel shall act and exercise personal judgment and discretion on behalf of the
Contractor.
1.3.7.5. The Contractor will be required to respond within two calendar days from the time contacted by the Contracting Officer or Contracting Officer Representative (COR) regarding conduct of Contractor employees.
1.4. REQUIRED CONTRACTOR PLANS: The Contractor shall submit the following plans to the Contracting Officer for review and approval within the time specified in the contract.
These plans shall be submitted as part of the base contract. These plans shall clearly demonstrate an understanding of all tasks and describe a sound approach to satisfy these requirements. The Contractor shall implement, maintain, and follow these plans/programs during the term of the contract. The Contractor shall update these plans as changes occur or as directed by the Contracting Officer or COR and provide the Contracting Officer and COR with an electronic copy of the updated plan within 10 calendar days after change of conditions. Changes shall not be implemented prior to approval of the Contracting Officer or
COR.
1.4.1. CONSTRUCTION AND DEMOLITION WASTE MANAGEMENT PLAN. A waste management plan shall be submitted within 30 days after base contract award and prior to initiating any site preparation work on the first task order (Exhibit D, Data Item No. D001).
See Section 00800, ADDITIONAL CONTRACT REQUIREMENTS, Paragraph 11 for plan requirements.
1.4.2. ENVIRONMENTAL PROTECTION PLAN (EPP): The Contractor shall prepare and implement an effective environmental protection program, including a generic EPP. The EPP shall be written to cover all aspects of environmental protection for the contract. The EPP shall be submitted to the Contracting Officer for approval within 30 days after the base contract award and prior to initiating any site preparation work on the first task order (Exhibit
D, Data Item No. D002). Approval of the Contractor's plan will not relieve the Contractor of responsibility for adequate and continuing control of pollutants and other environmental protection measures. See Section 00800, ADDITIONAL CONTRACT REQUIREMENTS, Paragraph 17.13. for plan requirements.
1.4.3. PHASE OUT PLAN: When one JOC contract expires and another one is awarded, there most likely will be task orders still outstanding from the previous contract. When open task orders remain, the Contractor shall provide a plan demonstrating the plan for successful completion. A Phase out plan shall be submitted at least six months before contract expiration (Exhibit A, Data Item No. D003). The plan shall, at a minimum, address how task order warranty issues will be managed; and explain how Contractor operations on the
Installation will be phased out, to include oversight of ongoing work to ensure successful and timely completion.
1.4.4. GENERIC SITE SAFETY AND HEALTH PLAN. This generic site safety and health plan shall be submitted with the proposal to the Contracting Officer for approval within 30 days after base contract award (Exhibit D, Data Item No. D004). See Section 00800, ADDITIONAL CONTRACT REQUIREMENTS, paragraph 42 for plan requirements.
SOW PART 2
DEFINITIONS AND ACRONYMS
DEFINITIONS:
Annual Database. The price book that is generated at the start of every calendar year and is implemented when option is exercised.
Coefficient factor or coefficient: “Coefficient” means a numerical factor that represents costs
(generally indirect costs) not considered to be included in “Unit Price Book” unit prices (e.g., general and administrative and other overhead costs, insurance costs, bonding and alternative payment protection costs, protective clothing, equipment rental, sales tax and compliance with tax laws, and also contractor’s profit). Coefficients proposed by Offerors are multiplied times the unit prices in the Unit Price Book to price a job or project on individual orders. The coefficient(s) proposed by the Offeror and accepted by the Government are incorporated in the JOC.
Contract. “Contract” means a mutually binding legal relationship obligating the seller to furnish the supplies or services (including construction) and the buyer to pay for them. It includes all types of commitments that obligate the Government to an expenditure of appropriated funds and that, except as otherwise authorized, are in writing. In addition to bilateral instruments, contracts include (but are not limited to) awards and notices of awards;
job orders or task letters issued under basic ordering agreements; letter contracts; orders, such as purchase orders, under which the contract becomes effective by written acceptance or performance; and bilateral contract modifications.
Contracting Officer. An individual with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.
Contracting Officer’s Representative (COR). An individual from the functional activity appointed by the Contracting Officer and delegated specific authority to monitor contract performance and to perform specific contract administration functions.
Job Order Contract. “Job Order Contract” means an indefinite-delivery, indefinite-quantity contract which is used to execute sustainment, restoration and modernization projects at installation (post, camp, or station) level. The JOC includes a comprehensive collection of detailed repair, maintenance and minor construction task descriptions or specifications, units of measure and pre-established unit prices for each of these discrete tasks. Each project or job ordered under a JOC is normally comprised of a number of pre-described and pre-priced tasks.
Non-prepriced Items. Non-prepriced (NPP) items are tasks not included in the UPB but within the intent and general scope of the contract. NPP work may also include items that are included in the UPB but require adjustments because of unusual site conditions differing from those contemplated in the contract. NPP work is negotiated separately from tasks included in the UPB. The coefficient developed for a prepriced task or item must not be applied to a non-pre-priced task or item.
On Site. On-site means the contractor managed office which facilitates the response time specified in paragraph 1.2 of this SOW.
Task Order. A task order is an order for sustainment, restoration, and modernization projects against an active contract. These projects are obtained through task orders under the terms of the contract and are not small purchase transactions.
Unit Price Book.. “Unit Price Book” means the compilation of sustainment, restoration, and modernization tasks, associated units of measure and unit prices that are used in job order solicitations and JOC. JOC unit prices include direct material, labor and equipment costs, but not indirect costs or profits which are addressed in the coefficient(s). Depending upon the source of the data base used, the Unit Price Base (UPB) may contain from 25,000-90,000 line items.
Technical Specifications. Technical specifications establish the quality of workmanship and materials required for the engineering and construction tasks in the UPB. The specific UPB for this contract is detailed in paragraph 52.1.12. SECTION 00800 – ADDITIONAL
CONTRACT REQUIREMENTS.
Work Site: The location where work is to be performed as stated on each Task Order.

GOVERNMENT FURNISHED PROPERTY (GFP)
3. GOVERNMENT-FURNISHED EQUIPMENT/MATERIALS: No Government Furnished equipment or materials will be provided under this contract.
SOW PART 4
CONTRACTOR-FURNISHED ITEMS AND SERVICES
4. GENERAL: The Contractor shall furnish all supplies, equipment and services necessary to perform the requirements of this contract.
4.1. CONTRACTOR FURNISHED COMPUTER HARDWARE/SOFTWARE. The
Contractor shall provide sufficient ADP equipment (computers and all related accessories) for their use during the contract period. These computers shall have the capability to run the e4Clicks software with full functionality, to include MicroSoft Office 2013 or later. In addition, contractor computers shall have Adobe Pro software with the capability to fill out and digitally sign PDF documents. MicroStation V8i (Select Series 3) or later will be required for as-built drawings and viewing existing government drawings.
SOW PART 5
SPECIFIC TASKS
5. WORK TO BE PERFORMED: During task order (TO) discussions between the
Contractor and the Government, the quantities and tasks necessary to perform the scope of work will be negotiated. Each TO will contain the specific tasks required.
SOW PART 6
APPLICABLE PUBLICATIONS
6. GENERAL: All regulations/documents referenced in this document are mandatory and shall be complied with. Supplements or amendments to these mandatory publications may be issued during the life of the contract. Supplements and amendments to mandatory publications shall be considered to be in full force and effective immediately upon publication.
6.1. TECHNICAL PUBLICATIONS: The Contractor shall implement the requirements of the applicable publications from the following organizations to form the basis of the work required in individual task orders under this Contract. Additional publications may be identified as required in the task orders. The Contractor is responsible for obtaining and updating all applicable publications. Work done under the individual task orders shall utilize the latest issue of the publications dated at the time of award of the task order. When a required publication is not referenced in this list, or in the task order, the Contractor shall utilize one that has national applications. Where conflicts arise between publications, the most stringent shall apply.
