SUMMARY OF WORK

PART 1 GENERAL

1.1 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for the Government’s Information only. The Contractor shall submit all materials and design submittals through the Designer of Record first providing the DOR with the opportunity to ensure each will meet his/her/their design effort and maintains the sealed design’s integrity. Throughout these specifications and the specifications added and tailored throughout the Design Effort, the following examples will be noted:

The Contractor shall submit each submittal (including those required DOR review), to the Government via the AF3000 Process. The Contractor shall ensure that all submittals are clear, legible, easily read, contain the most recent information, correctly formatted and tracked with a Submittal log pre-approved by the Contracting Officer (CO) and Civil Engineer Project Manager (CEPM).

1.2 WORK COVERED BY CONTRACT DOCUMENTS

1.2.1 Project Description

Building 896 is The Unites States Air Force’s C5 Flight and Ground Training School (affectionately referred to as “The C5 Schoolhouse”) is a two story iron and steel framed structure with a brick facade comprising approximately 37,000 SF of space. This Contract is limited to the B898 Flight Simulator Server Room located on the bottom floor. The Server Rooms has a raised computer floor with removable floor tiles. The Server Rooms contain down-flow Direct Expansion Computer Room Air Conditioning Units (CRAC Units). These units have their condensing units on the same (North) side of the facility.

The work includes the demolition and preparation for replacement, removal, and full replacement of two (2) each, 5 Ton and two (2) each 15 ton air cooled down-flow Computer Room Air Conditioning Units (CRAC Units), their condensers, their fire alarm components, electrical feeds and circuits, and all appurtenances to result in a fully 100% turnkey replacement of the Computer Room HVAC System with a new, engineered and more energy efficient CRAC system.

The Scope of this project is to inspect, test, audit, and otherwise investigate the existing facility’s computer room HVAC systems, usage, configuration, location and construction, and to provide the Government with a 100% complete, comprehensive, and detailed design to 100% IFC. The Contractor shall cause a comparison of this data and provide their findings in the form of a written Design Analysis. The DA shall include as a minimum, the discussion of the existing system, its ability or inability to meet the current load. The contractor shall provide a design that includes temporary air conditioning to meet the requirements of the space. This includes any generator, maintenance and fuel support.

The Computer room houses sensitive equipment and software that interacts with facilities throughout the US. The Contractor shall ensure that at NO time, shall this space be without air conditioning. The Contractor shall ensure that adequate redundancy is in place to ensure that no failure of HVAC occurs during the construction portion of this project. This system shall be maintained operationally 24/7/365. Any outages shall be prearranged no less than 60 days in advance. If an unplanned outage occurs by cause of the Contractor and/or their subcontractors, the Contractor shall be held liable to reimburse the United States Air Force for lost time, materials, and mission capabilities.

The Contractor shall remove, protect and store those floor tiles necessary for removal. The contractor shall reuse and replace those tiles when work is complete. The Contractor shall install necessary underfloor plenum/baffle/isolation dividers to provide separation between the active room components and their Air Conditioning supply, and the CRAC units being replaced so that the computer components are isolated from all dust dirt and debris during the entire construction process.

Life Safety devices in support of the CRAC Units (smoke detectors) shall be replaced with like kind addressable units that are proven to work at the panel and annunciate to the FD Emergency Center via the Monaco System.

The Contractor shall reuse refrigerant piping, piping chased as feasible if refrigerant and oils are compatible.

1.2.2 Location

The Project is located on Kelly Annex, Joint Base San Antonio Lackland, TX, 78236. The exact location will be shown by the Contracting Officer.

1.3 OCCUPANCY OF PREMISES

The School House facility and the Computer Room will be occupied during performance of work under this Contract. Occupancy notifications and signage to inform both Government and Contractor Personnel shall be posted by the Contractor in a prominent location in the work area. This signage shall include necessary pathway, egress and ingress, emergency evacuation, and general jobsite safety warnings and instructions. The Contractor shall not bear liability for Government employee violation or interference. Before work is started, arrange with the Civil Engineer Project Manager, a sequence of procedure, means of access, space for storage of materials and equipment, and use of approaches, corridors, and stairways. Contractor shall construct those temporary approaches and corridors necessary to protect workers and employees as necessary.

1.4 EXISTING WORK

In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements":

a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.

b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work must be in a condition equal to or better than that which existed before new work started.

1.5 LOCATION OF UNDERGROUND UTILITIES

No excavation or digging is anticipated under this TO. If the Contractor requires a utility locate, the Contractor shall obtain a JBSA Digging Permit, San Antonio Water Systems Locate, and Texas 811 account and case number prior to the anticipated start date of ant excavation. The Contractor shall comply with JBSA requirements for locating and marking underground utilities. Contact the Civil Engineer’s Inspector (CEI) for a copy of the most recent JBSA Digging Permit and the most recent date/time of the JBSA-Lackland Contractor’s Locate Meeting (a “one-stop shop” for the Contractor to have all coordinating parties present) a minimum 2 weeks prior to any excavations. Local utility locating service for the San Antonio Water Service required a minimum of 48 hours’ notice and TX811 will inform the Contractor of their current suspense requirements under TX Law. The Contractor shall make notification adjustments prior to excavating, to mark utilities, and within sufficient time required, if work occurs on a Monday, Friday, or after a Holiday. Verify existing utility locations indicated on contract drawings, within area of work and as listed on permits immediately prior to breaking ground. The Contractor shall be responsible to maintain all location markings throughout the duration of the project. Failing to do so and requiring a Government re-locate will require the payment of $250.00 to the Government for each re-locate.

The Contractor shall verify elevations before installing new work closer than nearest manhole or other structure at which an adjustment in grade can be made.

1.5.1 Notification Prior to Excavation

The Contractor shall verify all marked utilities for clarity and visibility and then notify the CEPM and CO at minimum 24 hours (Government Business Hours) prior to breaking ground, signifying the starting excavation work.

1.6 GOVERNMENT-FURNISHED MATERIAL AND EQUIPMENT

Not Applicable.

1.6.1 Delivery Schedule

Not Applicable. The Government will not deliver equipment or materials.

1.8 SALVAGE MATERIAL AND EQUIPMENT

Items designated by the CEPM to be salvaged remain the property of the Government. Segregate, itemize, deliver and off-load the salvaged property at the Government designated storage area located within 5 miles of the construction site.

Provide a salvage plan, listing material and equipment to be salvaged, and their storage location. Maintain property control records for material or equipment designated as salvage. Use a pre-approved system of property control that is approved by the CEPM. Store and protect salvaged materials and equipment until disposition by the CEPM.

1.1 REFERENCES

(RAM) MANAGEMENT

1.2 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for Government Information Only.

All design effort documents, drawings reports and analyses shall be submitted using the AF3000 process. All materials intended to be used shall be submitted using the most recent product and manufacturer technical data with no date older than 5 years.

The Contractor shall submit all chemical products’ (mastic, paint refrigerant, etc.) Safety Data Sheets (SDS) to the CO via the AF 3000 process 20 days prior to being brought onto the installation for review and acceptance by the CE Hazmat Pharmacy.

Any subsequent changes to previously submitted chemical products will be heavily scrutinized, as this is a disdained practice reserved only for absolute necessity. A Memo For Record (MFR) and clear explanation and acceptance and concurrence for the DOR shall be submitted to the CO and the CEPM. The MFR from the DOR shall be on company letterhead, clearly state the reason for change, and contain the contract number, project number, and the signature and stamp of the DOR.

Installation Access

1.3 SPECIAL SCHEDULING REQUIREMENTS

All medical and mission critical areas will remain in operation during the entire construction period. The contractor shall conduct his operations so as to cause the least possible interference with normal operations of the activity.

Permission to interrupt any Activity roads, driveways, and/or utility service must be requested in writing a minimum of 90 calendar days prior to the desired date of interruption.

1.4 CONTRACTOR ACCESS AND USE OF PREMISES

1.4.1 Activity Regulations

Ensure that Contractor personnel employed on the Activity become familiar with and obey Activity regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. Wear OSHA approved Personal Protective Equipment (PPE) in designated areas. Do not enter any Controlled or Restricted areas unless required to do so and cleared for such entry. Unauthorized entry to any of these areas may result in detention, apprehension, Use of Force and/or death. The Prime Contractor shall be held strictly liable for all of the workers on their site and shall ensure that personnel are briefed to be completely aware of their surroundings at all times. Any and all unauthorized individuals and “strangers” shall be challenged and detained as necessary for identification by the CEPM, CEI, End-User Designated POC, CS, CO, and/or 802d Security Forces.

1.4.1.1 Subcontractors and Personnel Contacts

Provide a list to the CO and CEPM of contract personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency, as changes occur and additional information becomes available, correct and change the information contained in previous lists.

1.4.1.2 Installation Access

Non DOD persons (Contractors, vendors, etc.) requiring entry to JBSA Lackland, Kelly Annex shall be sponsored by the Contracting Officer or Civil Engineer Project Manager. All personnel, including Prime Contractor and Sub Contractor personnel for this Project shall be US Citizens.

The Prime Contractor shall notify the Contracting Officer that access is required no later than 10 business days prior to the requested entry

SECTION 01 14 00 Page 3 date. This request shall be in writing via email using a secure corporate address to the Contracting Officer and include the individuals’ last name, first name, Date of Birth, State of Birth, Driver’s License or similar US Municipality issued picture ID, and state of issue.

All construction contractor employees shall have:

a. One Government form of picture identification

b. Provide personal (full name, date of birth, home address, and driver license number) and vehicle information.

1.4.1.3 No Smoking Policy

Smoking is prohibited within and outside of all buildings on installation, except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation. Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. Discarding litter and not disposing of it properly in a secure container anywhere near this jobsite will be considered FOD material (material that can be ingested by an aircraft, thus causing Foreign Object Damage) and the Contractor shall be held fully and absolutely liable for any and all damage caused by this FOD to any aircraft. The Contracting Officer will identify designated smoking areas.

1.4.1.4 Government Housing Areas

a. Haul routes to and from constructions sites cannot go through the housing, residential areas.

b. NO work under this Contract will be done in housing areas.

1.4.2 Emergency Response Requirement

Contractors reporting an emergency should provide the 9-1-1 dispatcher with the following information:

a. Building number, address or general location

b. Name

c. Phone number

d. Emergency information (cause of fire, explosion, natural gas leak, injuries, etc.)

e. Please, do not hang up the phone until directed by the 9-1-1 dispatcher.

IMPORTANT: If calling 9-1-1 from a mobile phone on any JBSA location you will be directed to the local 9-1-1 dispatcher. Advise the local dispatcher of your location (JBSA-Fort Sam Houston, JBSA-Lackland or JBSA-Randolph). Immediately the local dispatcher will transfer the 9-1-1 phone call to a JBSA emergency dispatcher.

1.4.3 Radioactive Materials and Equipment (Use and Storage)

a. Non-DoD agencies, including contractors, who intend to use, or store, radiation sources on Joint Base San Antonio installations shall obtain proper authorization in accordance with AFMAN 40-201, and AFI 48-148. Non-DoD agencies will not use radiation sources on referenced locations without an approved Department of the Air Force Radiation Permit. Such equipment typically includes equipment for Soil Density Testing, Lead-Based Paint Analysis (X-Ray fluorescent analyzer), etc.

b. Non-DoD agencies (including civilian contractors) require an Air Force

Radiation Permit(s) (AFRP) to use or possess ionizing radiation sources

SECTION 01 14 00 Page 4 on a JBSA installation. For the purpose of this paragraph, ionizing radiation source means any source that, if held or owned by an Air Force organization, would require a specific NRC license or Air Force radiation authorization - ARA.

c. The non-AF applicant will apply by letter with supporting documentation through the Installation Radiation Safety Officer (RSO). Submit the letter so that the installation representative receives the application at least thirty (30) days before the requested start date of the permit.

d. The Air Force radiation permit (AFRP) application will specify start and stop dates for the AFRP and describe for what purposes the applicant needs the AFRP. See the document in Appendix A for AFRP requirements and instructions to apply for a permit. The following information shall be submitted to the RSO for the AFRP request.

1) Brief Description of Proposed Activities

2) The applicant possesses a valid U.S. Nuclear Regulatory Commission

(NRC) Form 347 material license that allows the applicant to use the source as specified in the AFRP application.

3) The applicant possesses a valid Agreement State or Radioactive

Material License (Texas Department of Health, Bureau of Radiation Control) license that allows the applicant to use radioactive material (RAM) as specified in the AFRP application and the applicant has filed NRC Form 241, Report of Proposed Activities in Non-Agreement States, with the NRC in accordance with 10 CFR

150.20. A copy of the NRC Rom 241, must accompany the TRC Form 12-1. An AFRP issued under this circumstance will be valid for no more than 180 days in any calendar year.

4) Project Local Point of Contact: Name, Address, and Phone.

5) Company Radiation Safety Officer: Name, Address, and Phone.

6) Copy of Contractual Clause of the Air Force/Army Contract describing work to be performed and inclusive dates (from the contract)

7) Provide log of actual equipment usage to the JBSA-FSH RSO.

8) Leak test documentation for the equipment with the radioactive source(s).

9) Site map defining area where radioactive materials/equipment is to be used.

10) Radiation Safety Program to include standard operating procedures

(SOP), training program and designation of Radiation Protection/Safety Officer.

11) Written confirmation that the JBSA-FSH RSO can conduct periodic assessments and has authority to suspend contractor operations believed to be unsafe.

12) For naturally occurring or accelerator produce radioactive material

(NORM/NARM) and machine-produced ionizing radiation sources, the applicant has an appropriate State authorization that allows the applicant to use the source as specified in the AFRP application or has in place a radiation safety program that complies with Air Force requirements.

e. All AFRPs will require applicants to remove all permitted sources from Air Force property by the end of the work day. (Ft. Sam Houston policy, no radiation producing equipment will be stored on Ft. Sam Houston and Camp Bullis property overnight).

f. Disposal of radioactive material (RAM) by non-Air Force agencies on

Air Force property is strictly prohibited.

g. Submission of Application. Review of the permit request and subsequent approval/disapproval requires no less than 30 days. Submit three copies of the application with the required supporting documentation to 502nd Air Base Wing Safety Office, Safety Point of Contact:

1.4.4 Work Outside Regular Hours

Work outside regular working hours requires Contracting Officer approval.

Make application 14 calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress, giving the specific dates, hours, location, type of work to be performed, contract number and project title. Based on the justification provided, the Contracting Officer may approve work outside regular hours.

1.4.5 Permits and Requests

The Contractor shall be responsible for any fees and permit costs. The Air Force does not charge for certain requirements but this project is within an area of privatized utilities and the local utilities do charge for these services. All permit requests must include at minimum the following:

a. Site Map (8" x 11" or 8" x 14") 5 complete copies

b. 100% Construction Drawings 5 complete copies

c. Project Name and Number

d. Contractor & Subcontractor Name

e. Brief Description of Work - Identify all buildings and/or facilities possibly affected.

f. Desired Date for Work to Begin

g. Estimated Duration of Work

h. 14 Day Advance Notice minimum, unless otherwise noted, and Crane Waivers require a minimum 90 day notice to be processed and approved.

i. Contractor's Representative Contact Information.

1.4.5.1 Digging Permits / Utility Locate

a. Digging permits must be obtained prior to prior to any digging, SECTION 01 14 00 Page 6 drilling, driving (stakes, grounding rods etc., or any excavation work.

b. Digging permit /utility locates are available by submitting the completed US Air Force Form 103 and shall be obtained (post award) from the 802 CES Construction Inspector (CEI).

c. The Contractor shall allow a minimum fourteen (14) calendar days for

Local Utility review of digging permit requests. A digging permit for a specified area of excavation expires 30 days after the issue date; the contractor shall re-apply for a new permit to perform excavation in the area if the excavation was not started within the 30-day period. All locate markings shall be protected and maintained by the Contractor at the Contractor’s expense. Failure to maintain may cause additional re-locate costs by the locate service and local utilities and will cause a re-marking charge of $400.00 by the 802 CES.

d. Permits will identify all underground utilities within 5 feet of the designated area. Contractor shall be responsible for all repairs, costs, and damages due to excavating without permit or damaging an identified utility.

1.4.5.2 Utility Outage Request

a. Contractor shall complete and submit a written request 30 days in advance of the requested utility outage to CES Utility Manager through the 502 CES Construction Manager. The request shall include the utility service to be affected, proposed date, proposed time, and outage duration. An outage request form shall be obtained by the Contractor from the CEI.

b. Contractor shall be responsible to coordinate with CPS Energy about any energy or gas outage request. This coordination is separate than the government coordination.

c. Provide CES Construction Manager a copy of the written Utility Outage request.

d. After submitting the request to the government, the contractor shall receive approval from the government prior to schedule a utility outage.

1.4.5.3 Hot Work Permits

Under no circumstances shall hot work operations start without a hot work permit.

All welding and cutting operations shall be performed in accordance with National Fire Protection Association NFPA Standard 5lB Fire Prevention during Welding, Cutting, and Other Hot Work. Contact the site specific JBSA fire department to request an AF Form 592 USAF Welding, Cutting and Brazing Permit. Ensure a copy of the AF Form 592 is located on site. Phone numbers are:

Permits expire in 30 days. If work will extend beyond 30 day period the contractor shall contact JBSA Fire and Emergency Services to re-issue a new permit.

1.4.5.4 Road Closure Approval Requests

a. Road closings will not be permitted without approval. To get approval for a proposed road closure contractor shall submit a traffic control plan to the 802 CES Project Manager (CEPM) 90 days prior to anticipated need for closure.

b. The Contractor traffic control plan will include each section of road that will be worked on or impacted as a result of this contract. The traffic control plan shall be in accordance with "Traffic Controls for Street and Highway Construction and Maintenance Operations" of the latest edition of the "Texas Manual on Uniform Traffic Control Devices."

c. Contractor shall provide all traffic control signs and barricades for all street widening and extensions. At least one lane of traffic must be maintained at all times.

1.4.5.5 Crane Waiver Requests (“Crane Permit”)

a. Due to the proximity of the airfield, The Contractor shall provide a complete and accurate Critical Lift Plan if any crane or boom equipment is to be used on this project.

b. The Critical Lift Plan shall meet the requirements of OSHA 29 CFR, 1926 and EM385-1-1. Refer to Appendix For an example of this form.

c. The Contractor shall submit the Critical Lift Plan NLT 65% design to allow for adequate processing time. The Design Analysis and basic equipment data sets are typically well identified by this level of design, enough for the waiver process to begin.

1.4 PROGRESS AND COMPLETION PICTURES

Photography before, during and upon completion of this project is strictly controlled and limited. With the guidance and physical presence of The CEPM, the CEI, and/or the End User Facility Manager, Photographically document site conditions prior to start and at completion of each construction task order. Digital photographs, .jpeg, shall be provided to the Contracting Officer for unrestricted use by the Government. The Contractor, when taking pictures, shall “watch the background” to ensure that all sensitive items, materials and systems are not within the frame of

1.5 MINIMUM INSURANCE REQUIREMENTS

Procure and maintain during the entire period of performance under this contract the following minimum insurance coverage:

Comprehensive general liability: $500,000 per occurrence

b. Automobile liability: $200,000 per person, $500,000 per occurrence for bodily injury, $20,000 per occurrence for property damage

c. Workmen's compensation as required by Federal and State workers' compensation and occupational disease laws.

d. Employer's liability coverage of $100,000, except in States where workers compensation may not be written by private carriers,

e. Others as required by Texas law.

1.6 CONTRACTOR SPECIAL REQUIREMENTS

Accomplishment of all contract requirements under this Contract shall be directly assigned to the Prime Contractor or limited to no more than a first tier subcontractor.

2.1.1 Asbestos Containing Material

All contract requirements of Section 02 82 16.00 20, "Engineering Control of Asbestos Containing Materials" assigned to the Private Qualified Person (PQP) shall be accomplished directly by a first tier subcontractor.

HAZMAT materials are not suspected within the work area of this contract, however, OSHA’s Mandated General Duty Clause is enforced, and thus, if the employer suspects a material, that employer shall have it tested IAW TX Laws. IF a fully tested material were to be found hazardous, the Contractor shall immediately take actions to protect their employees and notify the CEPM immediately, who will notify the Contracting Officer.

Under no circumstances will a Contractor attempt disturbance, removal or abatement actions without the permission and coordination of the CEPM and

CO.

2.1.2 Space Temperature Control, HVAC TAB, and Apparatus Inspection

All contract requirements of Section 23 05 93 TESTING, ADJUSTING AND BALANCING FOR HVAC shall be accomplished directly by a first tier subcontractor, including the Commissioning NEBB TAB Agent. No work required by Section 23 05 93 shall be accomplished by a second tier subcontractor.

1.7 SUPERVISION

1.7.1 Minimum Communication Requirements

Have at least one qualified supervisor capable of reading, writing, and conversing fluently in the English language on the job site during working hours. In addition, if a Quality Control (QC) representative is required on the contract, then that individual shall also have fluent English communication skills.

The Project Manager in this context shall mean the individual with the responsibility for the overall management of the project and the Project Superintendent shall mean the individual with the responsibility for

quality and production. Both the Project Manager and Project Superintendent are subject to removal by the Contracting Officer for non-compliance with requirements specified in the contract and for failure to manage the project to insure timely completion. Furthermore, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to such stop orders shall be made the subject of claim for extension of time for excess costs or damages by the Contractor.

Approval of Project Manager and on-site Project Superintendent is required prior to start of construction. Provide resumes for the proposed Project Manager and on-site Project Superintendent describing their experience with references and qualifications to the Contracting Officer for approval. The Contracting Officer reserves the right to interview the proposed Project Manager and on-site Project Superintendent at any time in order to verify the submitted qualifications.

1.8 PRECONSTRUCTION CONFERENCE

After award of this contract but prior to commencement of any work at the site, the Contractor shall meet with the CO and CEPM to discuss and develop a mutual understanding relative to the administration of the contract, preparation of the schedule, Contractor’s general intent on direction of execution, submittals, scheduling, programming, prosecution of the work, clear expectations of the "Interim DD Form 1354" and the submittals process review. Principles of any major 1st tier subcontractors who will engage in the work shall also attend.

1.9 PARTNERING

NOTE: Partnering is required for this project.

To most effectively accomplish this contract, the Government requires the formation of a cohesive partnership within the Project Team whose members are from the Government, the Contractor and their Subcontractors. Key personnel from the Supported Command, the End User (who will occupy the facility), the Government Design and Construction team and Subject Matter Experts, the Installation, the Contractor and Subcontractors, and the Designer of Record shall participate in the Partnering process. The Partnership will draw on the strength of each organization in an effort to achieve a project that is without any safety mishaps, conforms to the Contract, and stays within budget and on schedule.

Personnel involved in the Partnering Process changes as the project’s trajectory continues toward completion. This is the normal ebb and flow of Construction. A list of key personnel involved in the Partnering Process shall be developed by the Contracting Officer. To accomplish this, the Contractor shall clearly identify in writing he key members of their teams, Prime, 1st Tier Subcontractor(s) and the DOR within 10 days of the issuance of the Notice To Proceed (NTP).

1.10 AVAILABILITY OF CADD DRAWING FILES

After award, upon request, and IF available, the electronic "Computer- Aided Drafting and Design (CADD)" as-build drawing files will only be made available to the Contractor for use in preparation of construction data related to the referenced contract subject to the following terms and conditions.

Data contained on these electronic files shall not be used for any purpose other than as a convenience in the preparation of construction data for

the referenced project. Any other use or reuse shall be at the sole risk of the Contractor and without liability or legal exposure to the Government. The Contractor shall make no claim and waives to the fullest extent permitted by law, any claim or cause of action of any nature against the Government, its agents or sub consultants that may arise out of or in connection with the use of these electronic files. The Contractor shall, to the fullest extent permitted by law, indemnify and hold the Government harmless against all damages, liabilities or costs, including reasonable attorney's fees and defense costs, arising out of or resulting from the use of these electronic files.

These electronic CADD drawing files are not construction documents.

Differences may exist between the CADD files and the corresponding construction documents. The Government makes no representation regarding the accuracy or completeness of the electronic CADD files, nor does it make representation to the compatibility of these files with the Contractors hardware or software. In the event that a conflict arises between the signed and sealed construction documents prepared by the Government and the furnished CADD files, the signed and sealed construction documents shall govern. The Contractor is responsible for determining if any conflict exists. Use of these CADD files does not relieve the Contractor of duty to fully comply with the contract documents, including and without limitation, the need to check, confirm and coordinate the work of all contractors for the project. If the Contractor uses, duplicates and/or modifies these electronic CADD files for use in producing construction drawings and data related to this contract, all previous indicia of ownership (seals, logos, signatures, initials and dates) shall be removed.

1.11 ELECTRONIC MAIL (E-MAIL) ADDRESS

The Contractor shall establish and maintain electronic mail (e-mail) capability along with the capability to open various electronic attachments in Microsoft, Adobe Acrobat, and other similar formats. Within 10 days after contract award, the Contractor shall provide the Contracting Officer a single (only one) e-mail address for electronic communications from the Contracting Officer related to this contract including, but not limited to contract documents, invoice information, request for proposals, and other correspondence.

The Contractor shall endeavor to protect DoD Data. The Contracting Officer may also use email to notify the Contractor of base access conditions when emergency conditions warrant, such as hurricanes, terrorist threats, etc.

Multiple email address will not be allowed.

All DoD and Government data that is shared, stored or created on non-DoD information systems must be protected and any breach or loss of that data must be reported immediately, not to exceed 24 hours. The contractor shall comply with the security requirements defined in DoD Instruction 8582.01.

The use of private email addresses (Yahoo, Gmail etc.) by the Contractor, sub-contractors or other entities involved in this project, for project related information, are not acceptable. At this level of business, the Contractor is expected to provide a company or corporate .com, .biz or other ICANN-accredited and registered domain with appropriate security protocols in place.

It is the Contractor's responsibility to make timely distribution of all Contracting Officer initiated e-mail with its own organization including field office(s). The Contractor shall promptly notify the Contracting Officer, in writing, of any changes to this email address.

1.11.1 ELECTRONINC SECURITY BREACH NOTIFICATION

The Contractor agrees to comply with all applicable laws that require the notification of individuals in the event of unauthorized release of personally identifiable information (PII) or other event requiring notification. Some examples of PII are Social Security, Driver’s License and ID numbers, personal phone numbers, home addresses. In the event of a breach of any of contractor’s security obligations, or other event requiring notification under applicable law, The Contractor agrees to:

a. Notify CO and CEPM (in this order) by telephone and e-mail of such an event within 24 hours of discovery, and

b. Notify the US-CERT of such an event within 24 hours of discovery, and

c. Assume responsibility for informing all such individuals in accordance with applicable law, and

d. Indemnify, hold harmless and defend the United States, its trustees, officers, enlisted, and employees from and against any claims, damages, or other harm related to such event.

1.1 QUALIFICATIONS

The Contractor shall designate an authorized representative who shall be responsible for the preparation of all required project schedule reports and their submission to the Contracting Officer and Civil Engineer Project Manager via the Air Force Form 3000 process. As with all submittals, the accuracy and completeness of submittals is a quality control item.

1.2 SUBMITTALS

3.1 GENERAL REQUIREMENTS

A Project Schedule as described below shall be prepared. The scheduling of construction shall be the responsibility of the Contractor. Contractor management personnel shall actively participate in its development.

Subcontractors and suppliers, subcontractors and suppliers working on the project shall also contribute in developing and maintaining an accurate Project Schedule. The approved Project Schedule shall be used to measure the progress of the work, to aid in evaluating time extensions, and to provide the basis of all progress payments.

3.2 BASIS FOR PAYMENT

The schedule shall be the basis for measuring Contractor progress. Lack of an approved schedule or scheduling personnel will result in an inability of the Contracting Officer to evaluate Contractor's progress for the purposes of payment. Failure of the Contractor to provide all information, as specified below, shall result in the disapproval of the entire Project Schedule submission and the inability of the Contracting Officer to evaluate Contractor progress for payment purposes. In the case where Project Schedule revisions have been directed by the Contracting Officer and those revisions have not been included in the Project Schedule, the Contracting Officer may hold retainage up to the maximum allowed by Contract, each payment period, until revisions to the Project Schedule have been made.

3.3 PROJECT SCHEDULE

The computer software system utilized by the Contractor to produce the Project Schedule shall be capable of providing all requirements of this specification. Failure of the Contractor to meet the requirements of this specification shall result in the disapproval of the schedule. Manual methods used to produce any required information shall require approval by the Contracting Officer on a case by case basis and only in rare cases.

The Progress schedule shall be submitted to the Government NLT 7 business days from the NTP. Earliest submission allows for likely discussion with the Contractor, CO, CEPM and Stake Holders.

3.3.1 CONTRACT PROGRESS SCHEDULE

Refer to the Appendices, this Contract for an example Contract Progress Schedule. The Contractor may use other scheduling formats from commonly acceptable software (e.g. Primavera®, MS Project®) shall include the required items, submittals, level of detail and contract requirements listed below for critical path method activities (Work Elements), in this paragraph C. through F and as detailed by the attached example form located in the Appendices. The Contractor shall demonstrate their risk management analysis in an organized presentation of anticipated and possible risk(s) and their approach(es) to mitigate such risks.

3.3.2 Use of the Critical Path Method

The Critical Path Method (CPM) of network calculation shall be used to generate the Project Schedule. The Contractor shall provide the Project Schedule in the Precedence Diagram Method (PDM).

3.3.3 Level of Detail Required

The Project Schedule shall include an appropriate level of detail. Failure to develop or update the Project Schedule or provide data to the Contracting Officer at the appropriate level of detail, as specified by the Contracting Officer, shall result in the disapproval of the schedule.

The Contracting Officer will use, but is not limited to the following conditions to determine the appropriate level of detail to be used in the Project Schedule:

a. Activity Durations: Contractor submissions shall follow the direction of the Contracting Officer regarding reasonable activity durations.

Reasonable durations are those that allow the progress of activities to be accurately determined between payment periods (usually less than 2 percent of all non-procurement activities' Original Durations are greater than 20 days).

b. Procurement Activities: Tasks related to the procurement of long lead materials or equipment shall be included as separate activities in the project schedule. Long lead materials and equipment are those materials that have a procurement cycle of over 90 days. Examples of procurement process activities include, but are not limited to:

submittals, approvals, procurement, fabrication, and delivery.

c. Critical Activities: The following activities shall be listed as separate line activities on the Contractor's project schedule:

i. Mobilization

ii. Temporary and redundant HVAC System Installation

iii. Temporary and redundant HVAC System Recurring Maintenance Schedule(s)

iv. Long Lead Item Order Placement and on site delivery schedule

v. Major Equipment Order Placement and on site delivery schedule

vi. Pre-final inspection

vii. Correction of punch list from pre-final inspection

viii. Final inspection

ix. Construction phasing

d. Government Activities: Government and other agency activities that could impact progress shall be shown. These activities include, but are not limited to: approvals, design reviews, environmental permit approvals, inspections, permits, and Notice to Proceed (NTP) for phasing requirements.

e. Responsibility: All activities shall be identified in the project schedule by the party responsible to perform the work. Responsibility includes, but is not limited to, the subcontracting firm, contractor work force, or government agency performing a given task. Activities shall not belong to more than one responsible party. The responsible party for each activity shall be identified by the Responsibility Code.

a. Work Areas: All activities shall be identified in the project schedule by the work area in which the activity occurs. Activities shall not be allowed to cover more than one work area. The work area of each activity shall be identified by the Work Area Code.

b. Modification or Claim Number: Any activity that is added or changed by contract modification or used to justify claimed time shall be identified by a mod or claim code that changed the activity. Activities shall not belong to more than one modification or claim item. The modification or claim number of each activity shall be identified by the Mod or Claim Number.

Whenever possible, changes shall be added to the schedule by adding new activities. Existing activities shall not normally be changed to reflect modifications.

c. Feature of Work: All activities shall be identified in the project schedule according to the feature of work to which the activity belongs. Feature of work refers, but is not limited to, a work

SECTION 01 32 01.00 10 Page 4 breakdown structure for the project. The feature of work for each activity shall be identified by the Feature of Work Code.

f. Scheduled Project Completion: The schedule interval shall extend from NTP to the Contract completion date.

a. Project Start Date: The schedule shall start no earlier than the date on which the NTP was acknowledged. The Contractor shall include as the first activity in the project schedule an activity called "Start Project". The "Start Project" activity shall have an "ES" constraint date equal to the date that the NTP was acknowledged, and a zero day duration.

b. Constraint of Last Activity: Completion of the last activity in the schedule shall be constrained by the contract completion date.

Calculation on project updates shall be such that if the early finish of the last activity falls after the contract completion date, then the float calculation shall reflect a negative float on the critical path. The Contractor shall include as the last activity in the project schedule an activity called "End Project".

The "End Project" activity shall have an "LF" constraint date equal to the completion date for the project, and a zero day duration.

c. Early Project Completion: In the event the project schedule shows completion of the project prior to the contract completion date, the Contractor shall identify those activities that have been accelerated and/or those activities that are scheduled in parallel to support the Contractor's "early" completion. Contractor shall specifically address each of the activities noted in the narrative report at every project schedule update period to assist the Contracting Officer in evaluating the Contractor's ability to actually complete prior to the Contract period.

g. Interim Completion Dates: Contractually specified interim completion dates shall also be constrained to show negative float if the early finish date of the last activity in that phase falls after the interim completion date.

d. Start Phase: The Contractor shall include as the first activity for a project phase an activity called "Start Phase X" where "X" refers to the phase of work. The "Start Phase X" activity shall have an "ES" constraint date equal to the date on which the NTP was acknowledged, and a zero day duration.

e. End Phase: The Contractor shall include as the last activity in a project phase an activity called "End Phase X" where "X" refers to the phase of work. The "End Phase X" activity shall have an "LF" constraint date equal to the completion date for the project, and a zero day duration.

f. Phase X: The Contractor shall include a hammock type activity for each project phase called "Phase X" where "X" refers to the phase of work. The "Phase X" activity shall be logically tied to the earliest and latest activities in the phase.

h. Default Progress Data Disallowed: Actual Start and Finish dates shall not be automatically updated by default mechanisms that may be included
