1.2 WORK COVERED BY CONTRACT DOCUMENTS

A. Project Location: The Site is located within Smoky Mountains National Park, Sevier Co., Tennessee at the Laurel Falls Trailhead 1.3 miles to Laurel Falls and 1,400 feet east of the Laurel Falls Trailhead parking along Fighting Creek Gap Road.

B. The Work consists of the following five Contract Line Items:

1. Contract Line Item No. 001: Trail Rehabilitation and Rest Area 1

a. Extent of this line item begins at the face of the curb of Laurel Falls Trailhead parking beginning at Station 100+02.85 and continues to the Laurel Fall Upper Pedestrian bridge ending at Station 165+77.63.

b. Work includes the rehabilitation the trail including grading and widening of the trail, installation of asphalt concrete pavement, concrete paving, stone base, siting walls, culverts, trench drains, headwalls. Pine Knot Branch box culvert, retaining walls and associated elements as shown on the plans.

2. Contract Line Item No. 002: Laurel Falls Viewing Area

a. The extent of this line item begins at the Laurel Falls Upper Pedestrian Bridge at

Station 165+77.36 and includes the viewing platforms, lower wood bridge and stone steps ending at Station ±164+75.

b. Work includes the installation of upper Laurel Falls Pedestrian Bridge, wood platforms, lower wood bridge, structural footings stone steps, pedestrian guardrail, metal handrail, interpretive signs and associated elements as shown on the plans.

3. Contract Line Item No. 003: Rest Areas 2 – 7 and Viewing Deck

a. The extent of this line item includes the following:

1) Viewing Deck: Begin Station 152+40.63, End Station 152+67.35

2) Rest Area No. 2: Begin Station 107+24.86, End Station 108+32.00

4. Contract Line Item No. 004: Option A Parking Improvements

a. Extent of this line item begins at the face of the curb of Laurel Falls Trailhead parking beginning at Laurel Falls Trail Station 100+02.85 and includes Laurel Falls Trailhead parking area both sides of Fighting Gap Road and Fighting Gap Road beginning Station ±28+80 to Station ±44+40.

b. Work includes construction of parking areas 1 and 2, installation of electric and communication conduit, utility street cut, installation of modular block retaining walls, asphalt concrete pavement, wood guardrail, stone guardwall and railing concrete paving, stone base, siting walls, culverts, catch basins, striping, pavement markings stone curb, headwalls, grading and widening of the Fighting Gap Creek Road north shoulder, and associated elements as shown on the plans.

5. Contract Line Item No. 005: Option B Vault Toilet

a. Extent of this line item at the existing trailhead parking is as shown on the plans.

b. Work includes the placement of a precast single vault restroom as shown on the plans and specifications.

C. Project will be constructed under a single prime contract.

1.3 WORK UNDER OTHER CONTRACTS

A. Not applicable under this contact.

1.4 GOVERNMENT-FURNISHED MATERIALS

A. In case of Government -furnished materials:

1. Government will inspect delivered items for damage after delivery. Contractor shall be present for and assist in Government's inspection.

2. Contractor is responsible for protecting Government-furnished items from damage during storage and handling, including damage from exposure to the elements.

3. If Government-furnished items are damaged as a result of Contractor's operations, Contractor shall repair or replace them.

4. Contractor shall install and otherwise incorporate Government-furnished items into Work.

B. Government-Furnished Materials:

1. Existing roadside boulders to be relocated from current to new location as directed by the Contracting Officer.

2. Existing Road signs and posts to relocated from current to new location on the site as indicated on the drawings.

1.5 CONTRACTOR USE OF SITE

A. General: Contractor shall have full use of site for construction operations. Contractor's use of the site is limited only by the Government's right to perform work or to retain other contractors on portions of the Project.

1. Limits: Confine construction operations to areas within the Limits of Disturbance as shown on the drawings.

2. Storage of Materials: Confine storage of materials to staging areas shown on plans.

3. Parking: Confine parking to staging area shown on plans.

4. Stockpiling: Confine stockpiling to staging area shown on plans.

5. Limits: Confine constructions operations to areas of disturbances as shown on the plans.

6. Limit site disturbance, including earthwork and clearing of vegetation, to no greater than 5 feet beyond areas of disturbance as shown on the plans; 15 feet beyond primary roadway curbs and main utility branch trenches.

7. Storage of Materials: Confine storage of materials to the existing Laurel Falls trailhead parking lot both sides of the road. Additional staging can be at rest area # 7 and on the trail, as needed.

B. Parking: Confine parking to Laurel Falls trailhead parking area.

C. Stockpiling: Confine storage of materials to the existing Laurel Falls trailhead parking lot both sides of the road. Additional stockpiling can be at the midpoint rest area # 7 and on the trail, as needed.

D. Preservation of Natural Features:

1. Prevent damage to natural surroundings. Restore damaged areas, repairing or replacing damaged trees and plants, at no additional expense to the Government. See EFL plans/specs for costs to damage to trees. Trees shall only be removed between November 15 and March 31.

2. Provide temporary barriers to protect existing trees and plants and root zones.

3. Do not remove, injure, or destroy trees or other plants without prior approval. Consult with

Contracting Officer (CO) and remove agreed-on roots and branches that interfere with construction.

4. Ropes, cables, or guys can only be fastened to existing trees with approval from the Contracting Officer (CO).

5. Carefully supervise excavating, grading, filling, and other construction operations near trees to prevent damage.

E. Construction Camp: Establishment of a camp within park will not be permitted.

F. Hauling Restrictions: Comply with legal load restrictions in hauling of materials. Load restrictions on park roads are identical to state load restrictions with such additional regulations as may be imposed by the Park Superintendent. Information regarding rules and regulations for vehicular traffic on park roads may be obtained from the Office of the Park Superintendent. A special permit will not relieve Contractor of liability for damage which may result from moving of equipment.

1. Hauling will only be allowed from the nearest point of entry into the Park of which is the Gatlinburg entrance.

1.6 PUBLIC USE OF SITE

A. The Laurel Falls Trail from trailhead to 300 feet past Laurel Falls and trailhead parking area will be closed to the public during construction.

1.7 CONDUCT OF OPERATIONS

A. Contractor shall conduct his operations in conformance with rules and regulations promulgated by the Secretary of the Interior for the National Park Service, and applicable park rules and regulations prescribed by Park Superintendent.

B. Work on Saturdays, Sundays, Federal holidays or at night may not be performed unless stated in the Work Restrictions below or without prior consent from the Contracting Officer. Submit requests 7 calendar days in advance of the work to the Contracting Officer for approval.

C. No signs or advertisements (except those specified herein) shall be displayed on the construction site or within the park.

1.8 WORK RESTRICTIONS

A. The issuance of the Notice to Proceed (NTP) and on-site work commencement date is subject to the approval of the Contracting Officer. Prior to receiving the NTP, the contractor is required to submit and have their Division 1 specifications accepted. Work may commence on or after upon obtaining the approved NTP and meeting all specified requirements. On-Site Work Hours: Work hours shall be defined as the following:

1. Parking Improvements and Fighting Creek Gap Road.

a. Daytime hours. A term denoting a period of time beginning at 7:00 a.m. and ending at 7:00 p.m. during a calendar day.

b. Nighttime hours. A term denoting a period of time beginning at 7:00 p.m. and ending at 7:00 a.m. during a calendar day. Night work will not be permitted.

c. Weekends. A term denoting a period of time beginning at 7:00 p.m. on Friday and ending at 7:00 a.m. the following Monday.

2. Laurel Falls Trail Area.

a. Daytime hours. A term denoting a period of time beginning at 7:00 a.m. and ending at 7:00 p.m. during a calendar day.

b. Nighttime hours. A term denoting a period of time beginning at 7:00 p.m. and ending at 7:00 a.m. during a calendar day. Night work will not be permitted.

c. Weekends. A term denoting a period of time beginning at 7:00 p.m. on Friday and ending at 7:00 a.m. the following Monday.

B. All construction operations are limited as the follows:

1. No work will be permitted on Federal holidays.

2. No work permitted on weekends.

3. No work involving a lane closure permitted during the following periods:

a. The week before and the week after Easter Sunday.

b. The Friday before Memorial Day.

c. The period between June 15-August 15.

d. The Friday before Labor Day.

e. The month of October.

f. The Wednesday before Thanksgiving Day through the weekend after Thanksgiving

Day.

g. The week of Christmas and New Year’s Day.

C. Public Traffic

1. Maintain traffic on Fighting Creek Gap Road at all times except as stated:

a. Contractor shall conduct his operations to ensure the least inconvenience to the public. Temporary Lane closures may be permitted, when required, upon specific approval of Contracting Officer for a maximum of 5 minutes; seasonal restrictions apply.

D. Existing Utilities

1. Existing Utilities: Notify Contracting Officer and utility companies of proposed locations and times for excavation.

2. Contractor shall be responsible for locating and preventing damage to known utilities. If damage occurs, repair utility at no additional expense to the Government.

3. If damage occurs to an unknown utility, repair utility. An equitable adjustment will be made in accordance with the Changes clause of the contract.

E. Existing Utility Interruptions: Do not interrupt utilities serving facilities occupied by Government, Wastewater Treatment Plant, or others unless permitted under the following conditions and then only after arranging to provide temporary utility services according to requirements indicated:

1. Notify Contracting Officer not less than 7 calendar days in advance of proposed utility interruptions.

2. Do not proceed with utility interruptions without Contracting Officer’s written permission.

F. Hours and length of Utility Shutdowns: All utility outages must be approved in writing by the Contracting Officer.

1.9 SPECIAL CONSTRUCTION REQUIREMENTS

A. Project Website: A project website administered by NPS will be used for purposes of managing communication and documents during construction stage.

1. See Section 01 31 00 "Project Management and Coordination" for requirements on using Project Website.

B. The Contractor may, at their own risk, access the work sites while roadways are closed to the public. Coordinate this access with the CO. If inclement weather requires the closure of the roadways during the periods when they are otherwise to remain open to the public, maintain close communication with Park maintenance crews to avoid any potential accidents. Install or store all equipment, traffic signals, signage, construction barriers, etc., in a manner that does not interfere with Park operations.

C. The Contractor must remove all food trash from the project site on a daily basis or use a bear-proof dumpster. The CO will assess a daily reduction in payment to the Contractor of $250 for the first offense, $500 for the second offense, and $1,000 for each offense thereafter. This reduction in payment will be subtracted from the Contractor’s progress payments and will be unrecoverable.

D. The first equipment inspection before work has commenced to be coordinated with the CO at least 24 hours in advance and to occur outside of the Park boundary. If the initial inspection passes, subsequent inspections can take place on site before equipment is unloaded.

1. The contractor to thoroughly clean all equipment before entering Government property.

All equipment will be subject to inspection at the CO’s discretion to preclude the introduction of exotic vegetation or pests into the Great Smoky Mountains National Park.

2. Make restitution for the introduction of any exotic vegetation or pests into the Park.

3. Examples include, but are not limited to, careless use of unclean equipment, incorrect seed mix, incorrect mulch or erosion control blanket, or unapproved sod. The amount of restitution will be based on the number of man-hours required to remove the exotic vegetation, or treat or eliminate exotic pests at $50.00 per man-hour and equipment rates will be assessed equal to commercial equipment rates within a 50-mile radius of the project site. Restitution will be subtracted from the Contractor’s progress payments and will be unrecoverable.

E. The project site may provide habitat for several federally listed species of bat, including the Gray bat (Myotis grisescens), Indiana bat (Myotis sodalis) and Northern long-eared bat (Myotis septentrionalis). Protect these species and their habitat as follows:

1. Comply with the avoidance and mitigation measures outlined in the Environmental Assessment Form for Great Smoky Mountains National Park, latest edition and the Programmatic Biological Opinion for Transportation Projects in the Range of the Indiana Bat and Northern Long-Eared Bat, February 2018 Revision, found at http://www.fws.gov/Midwest/endangered/section7/fhwa.

2. Do not disturb wildlife species found nesting, hibernating, estivating, or otherwise living in, or immediately nearby, the work site. If bats are encountered during construction activities, cease work and notify the CO and NPS natural resource staff immediately.

Continue construction activities upon approval by the CO.

3. Do not permit vehicles or machinery beyond the edge of pavement unless otherwise approved by the CO. Access areas beyond the edge of pavement by foot.

1.10 SOILS INVESTIGATION REPORT

A. The soils investigation report, prepared by WSP is an appendix with this package:

1. Geotechnical report for the Rehabilitation of Laurel Falls Trail, prepared by WSP, March

B. In case of conflict between report and drawings or specifications, the drawings and specifications govern.

1.11 FINDING OF NO SIGNIFICANT INCIDENT REPORT (FONSI)

Drawings on reproductions of Contract Documents or standard printed data. Include following information, as applicable:

a. Indicate functional and spatial relationships of components of architectural, structural, civil, mechanical, and electrical systems.

1.9 PERMITS

A. General:

1. Permits and Responsibilities: Contractor shall, without additional expense to the

Government, be responsible for obtaining necessary licenses and permits, and for complying with Federal, State and municipal laws, codes, and regulations applicable to the performance of the work. Contractor shall also be responsible for damages to persons or property that occur as a result of Contractor’s fault or negligence; and for materials delivered and work performed until completion and acceptance of the work.

2. For the purpose of this contract, Contractor will not be considered an agent of the

Government. Contractor shall comply with appropriate Federal, State and local laws.

B. Government Furnished Permits: During development of the project’s design, permits listed below were negotiated and agreed to by the Government. Terms and provisions of these permits shall be adhered to for the duration specified in each permit.

1. An Aquatic Resource Alteration Permit (ARAP) & State Section 401 Water Quality

Certification was acquired. The Agency with Jurisdiction for this permit is Tennessee

Department of Environment and Conservation (TDEC).

2. A Section 4040 Nationwide Permit was acquired. The Agency with Jurisdiction for this permit is US Army Corps of Engineers, Nashville District.
