About this file

This is a Questions and Answers document providing Government responses to 212 industry inquiries submitted during the draft RFP phase for the Medical Instructor/Operator Support Services (MIOSS) contract.

Contract Overview and Key Requirements: The MIOSS contract requires continuous support for Medical Simulation Training Centers (MSTCs) across 25+ Army installations in CONUS and OCONUS locations (Germany and Korea). The contract is structured as a Firm Fixed Price (FFP) contract based on a Mandatory Minimum Staffing Baseline (MMSB) of 110 Full-Time Equivalents (FTEs) distributed across sites with varying staffing levels (ranging from 2 to 5 FTEs per location). The base period is 7 months with four 1-year option periods, with an anticipated start date of approximately August 31, 2026. This is a 100% small business set-aside (NAICS 541990) under FAR Part 16.202 with a requirement that prime contractors perform at least 50% of contract value themselves. The Government will conduct in-person oral presentations in Orlando, Florida (July 22-30, 2026), limited to five team members per offeror, with proposals due July 27, 2026.

Staffing, Labor, and Compensation: Personnel must meet strict qualification requirements outlined in Appendix A, including current EMT or Paramedic licensure, military medical experience (former 68W, 18D, Navy IDC, or Air Force 4NOX1), or current licensure as RN/PA/Physician. All Instructor/Operators (I/Os) must achieve TC 8-800 certification within 90 days of hire and maintain annual recertification. Service Contract Labor Standards (SCLS) apply, with Wage Determinations identified for four Arizona, Iowa, Indiana, and Utah locations; Collective Bargaining Agreements apply at 16 sites with successor obligations requiring the new contractor to honor existing CBAs and First Right of Refusal provisions. Government-established Direct Labor Floor Rates are provided in the Government Format Pricing Model (GFPM-Prime), with ceiling rates capped at 105% for CONUS and 110% for OCONUS locations (excluding profit/fee). Minimum annual escalation factors are 3.2% for Option Period 1 and 2.7% for Option Periods 2-4. The contract requires contractors to maintain 1,992 productive hours per FTE annually and cover all PTO within fringe benefits; price reductions begin on the first business day a position remains unstaffed with no grace period for vacancies, though Section H provides updated grace period provisions. All consumables (synthetic blood, moulage materials, skins, PMCS kits) are Government-furnished and should not be priced by contractors; the Government is responsible for HAZMAT disposal, regulated waste, and cadaver-related waste management.

Additional Key Provisions: Contractors must establish a 90-day phase-in period for all sites (including OCONUS locations), with Government facilitation of incumbent contractor cooperation and SOFA documentation assistance. The 2,500 annual 68W student throughput figure is a Government planning estimate, not a contractual performance standard. Program Management is priced separately on an FFP basis above the 110-FTE baseline, with contractor discretion on required labor categories. Surge support is priced as a separate optional CLIN with Government-estimated plug numbers and will only be exercised through bilateral modification if needed. The Government will provide Common Access Card (CAC) sponsorship and typically processes cards within 4-5 business days with accurate information submission. Contractor personnel will not have access to MODS (training record system) data entry; the Government Course Coordinator manages MODS and accreditation submissions. The Government confirmed that the incumbent contractor is Phoenix Defense and provided limited historical data on staffing and throughput. Offerors are responsible for understanding and interpreting SOFA agreements for Korea (USFK Regulation 70019) and Germany employment authorization and must independently assess potential labor relations obligations when hiring incumbent employees.

Questions and Answers Attachement 010 - Answers to the Draft RFP

PWS SectionOther DocumentQuestionsGovernment's Answer
3Appendix A: EMT 4Is the "Complete/certified on TC 8-800" part waived when we hire a new Paramedic or EMT?The current TC 8-800 and the pending update does not provide for a waiver of TC 8-800 requirments for Instructors/Evaluator
4L.2.3.5L.2.3.5 shows the 2-page Executive Summary in Volume IV; L.3.1 calls for it in Volume I. Please clarify. It was adjusted in the PWS and will be required under Volume IV only.
5Appendix A - NoteThe note says "In any combination there must be at least (2) BLS Certified Instructors I/Os and (1) Advanced Life Support (ALS) Certified Instructor at each site at all times." The MMSB shows only two personnel total at JBSA. Please clarify.JBSA will only require two instructors because the site will be additionally staffed and supported by Government‑provided military personnel. As a result, the minimum staffing requirement outlined in PWS Section 3.0.4 does not apply to JBSA in the same manner as other MSTC locations. The MMSB correctly reflects the requirement for this site. Will update docs
6L.2.3.5
L.3.1, L.5.1The Table in L.2.3.5 lists the Exective Summary in Volume IV. L.3.1 has the Executive Summary in Volume I. L.5.1 has the Executive Summary in Volume IV. Will the Government please clarify which volume the Executive Summary is to be placed? It was adjusted in the PWS and will be required under Volume IV only.
7M.4.5.Section M.4.5 is missing from the Section M. Can the Government please renumber Section M.4?Yes
8L.4.3.11, L.4.3.12, L.4.3.13Can the Government update the CONUS and OCONUS ceiling rate percentages in Section L to match the Government Format Pricing Model ceiling rate percentages?Reconciled
9L.3.1.1Reference: The number of participants present during oral presentations shall be limited to five team members (and it is highly encouraged to include the three key personnel required for contract performance).
Question: Can the Government provide the titles and the minimum qualifications of the unidentifiied key personnel? There are no "Key" personnel. This statement was taken out of Section L.
103.0.4Will the Government please publish the WDs and CBAs for all locations for which they apply? They are attached to the Final RFP.
113.20Is it the Government's intent for contractors to include contractually required ongoing certification costs in their indirect rates or will the Government reimburse for ongoing certification costs via the Travel CLIN, which will require pricing to accommodate the ongoing certification costs for staff to travel to offsite locations in order to accomplish their ongoing certifications? Alternatively, will the Government please provide a separate cost reimbursable, Government-directed, "plug number" for ongoing certification costs, and by doing so, it will provide the Government with the best ability for price comparisons across bidders with regard to the Total Evaluated Price?Ongoing certification costs are to be covered by the Contractor and should be priced on the FFP CLIN as part of their management plan.
12L.3.0.4Did the Government intend to provide a period of time to accomodate industry for filling positions where there has been attrition in order to maintain 100 percent MMSB requirement as long as that position is filled within that period of time? Industry recommends 45 days to fill OCONUS vacancies and 30 days for CONUS vacancies.No. For permanent vacancies resulting from attrition, resignation, or termination, price reductions will begin on the 1st business day the position remains unstaffed.
13L.4.3.4The Government has set the Mandatory Minimum Staffing Levels to 1,992 hours per year and stated that PTO hours should be included in the offeror’s fringe benefits rate. Worked hours of 1,992/year are more than a standard work year, when taking the standard 2,080 hours/year and deducting holidays and PTO. Is the Government's intent to use the 1,992 hours for pricing only or will it also be used for MMSB staffing metric and potential penalities for vacancies?Yes, penalties for vacancies. Staffing is full number of persons identifed in the PWS and GFPM. See section H.1
141.2The PWS references cadaver use in MEDCoE-approved POIs/curricula and training exercises. Please indicate if the contractor of the government is responsible for sourcing, transporting, storing, handling, safety compliance, disposal, and liability associated with cadavers. The government has directed the limited the use of cadaver's during training, it has not been eliminated. With the incorporation of Tier 4 TC3, there is still the possibility of cadaver's/live tissue being utilized for some training events. Contractors will not be responsible for them.
153.11Please provide the current list of hazardous materials, regulated materials, synthetic blood products, moulage materials, disinfectants, cleaning agents, and consumables used at each MSTC location, and identify which items are Government-furnished or contractor-furnished.All consumables are purchased by the Government under a seperate contract and should not be priced on this proposal.
163.11Please clarify whether the government or the contractor is responsible for disposal of regulated waste, hazardous waste, contaminated PPE, spent moulage materials, synthetic blood materials, cadaver-related waste, and expired or unusable training supplies. The Government is responsible for disposal.
173.11Will the Government provide each site’s installation HAZMAT, environmental, public health, and waste disposal SOPs prior to phase-in?Each site has individual procedures for disposal with basis in Army Regulation applicable state, federal, and local regulation.
183.11Please identify the specific OSHA, EPA, U.S. military public health, state, local, and host-nation training or certification requirements the Government expects contractor personnel to complete for HAZMAT, bloodborne pathogens, PPE, regulated waste, and spill response. The Government is responsible for the personnel on site to maintain and dispose. No certifications are required for this by the contractor.
193.11Please clarify whether costs for HAZMAT supplies, PPE, spill kits, SDS systems, biohazard containers, disposal fees, installation-required training, and site-specific environmental compliance should be priced by the contractor or treated as Government-furnished support. The Government is responsible for the personnel on site to maintain and dispose. No certifications are required for this by the contractor and should not be priced on this proposal.
203.18.2The phase-in for all U.S. sites within 30 days and Germany/Korea within 90 days requires an “over-the-shoulder not to interfere” basis with the incumbent. Will the Government facilitate access to the incumbent contractor, incumbent staffing rosters, site points of contact, and transition schedules immediately after award to support timely phase-in?Yes upon award and is part of the incumbants phase out plan.
213.20.2The PWS states that the contractor shall provide I/Os per MSTC site to meet a projected minimum throughput of at least 2,500 68W students annually. This is not clear - is the 2,500-student throughput requirement applicable per site, or across the entire MIOSS program?Per the PWS, yes 2500 per site Each site must have the capacity for an annual througput of 2500.
223.20.4The PWS identifies instructor-to-student ratios for lecture, practical exercises, invasive procedures, and skills validation testing. During drill weekends, annual training periods, mobilization events, or other high-throughput periods, will the Government limit scheduled class sizes to available I/O staffing ratios, or is the contractor expected to provide additional staff through surge or internal coverage?Flexible work schedules within the 40 hour work week are to be employed to provide proper instructor to student ratios. The instrutor to student ratios were consdered in I/O Redcution. If surge support is needed the Government will direct.
233.20.7The PWS states the contractor will inventory and manage consumable items and notify the COR when additional consumables are required. Please clarify whether the Government provides and funds all consumables, such as skins, synthetic blood, moulage materials, and PMCS kit items, or whether any recurring consumables must be priced by the contractor. All consumables are purchased by the Government and stored in the MSTC the list will be provided. This should not be priced on the proposal.
24Page 7The solicitation states the Government may present up to three unreleased questions/scenarios during the oral presentation. Will responses to these scenarios be evaluated under Factor 1 Program Management, and will the Government provide any scoring weight, rating methodology, or examples of the types of operational risks the scenarios may address. There will be no questions asked during oral presentations.
25Appendix A, Page 1Appendix A requires NRP or NREMT credentials, medically credentialed instructor status, BLS certification, TC 8-800 certification, and prior military medical or licensed medical professional experience. Please confirm whether equivalent civilian trauma, EMS, tactical medicine, or instructor experience can be accepted when a candidate does not meet one of the listed former military or licensed medical categories.Waivers are considered on a case-by-case basis by the Contracting Officer Representative and MEDCoE.
26Appendix A, Page 1If these positions are SCA, since they are listed as separate occupations, will the government need conformance from the Department of Labor to determine the correct rate for these positions? The Government has provided the Statement of Equivalent Rates for Federal Hires, as required by FAR 52.222-42, which includes federal equivalents for the listed labor categories. This information is provided for the contractor's awareness and consideration. If the contractor determines that any of the listed labor categories will not fit its technical approach but are still subject to the Service Contract Labor Standards (SCLS) and are not exempt, the contractor may choose to commence the conformance process outlined in FAR 52.222-41(c)(2) after award of the Task Order. The contractor is responsible for ensuring that labor categories are compliant with the SCLS, if applicable. The Government is not directing the contractor to take any specific action, but rather providing this information to facilitate the contractor's understanding of the requirements.
27Appendix A, Page 1The labor categories given "EMT" & "Paramedic" could fall under the SCA Directory of Occupations as 12040, EMT. But an "instructor" could be under the SCA positions of Technical Instructor. Will the government indicate the correct SCA job codes for these roles? The Government is only requiring EMT or Paramedics to be at the level of "EMT" & "Paramedic" not an Instructor for EMTs/Paramedics. But having the higher certification would not disqualify the personnel.
28QASP, page 29The QASP references a Mandatory Minimum Staffing Baseline of 110 FTEs and requires 100% compliance, but the PWS does not show the complete site-by-site labor category distribution. Will the Government provide or confirm the final MMSB table by location, labor category, shift/hours, and CONUS/OCONUS designation that Offerors must use for proposal and performance purposes?See PWS Section 3.0.4 Mandatory Minimum Staffing Baseline (MMSB)
293.0.4 (MMSB)Will the government provide historical data over the last 3 years at each MSTC site for staffing levels, type of courses, and number of students trained? No, See PWS Section 3.0.4 Mandatory Minimum Staffing Baseline (MMSB)
303.0.4Can the Government clarify what constitutes an acceptable timeline for replacing personnel vacancies without incurring deductions under the MMSB requirement?See Section H and PWS Section 3.0.8
313.0.8Are temporary or bench personnel allowed to count toward the Mandatory Minimum Staffing Baseline (MMSB) while permanent replacements are being processed?Yes as long as the temp postions have the proper certification and the MMSB is met.
323.6.2 (Surge)How does the Government treat approved leave (PTO), training time, and administrative absences relative to the requirement to maintain 100% MMSB coverage?See Section H and PWS Section 3.0.8
333.0.4Can the Government clarify whether surge personnel are required to be separate from MMSB baseline staff, or if existing staff may be used to meet surge requirements? It all depends on how each Offeror decides to sets up their program management plan and how they plan to man the MMSB. Wether it be full time personnel or several part time personnel.
343.6.2Will the Government allow cross-site staffing (e.g., personnel temporarily reassigned between MSTC locations) to maintain MMSB compliance?Yes as long as the postions have the propoer certification
35L.4.1.3M.4Can the Government provide historical data on surge events, including average frequency, duration, and number of personnel required? No surge support was required under the incumbent contract.
363.6Will the Government evaluate price realism in addition to price reasonableness? No, see sections L and M
37Are there specific locations identified by the Government as high-risk or difficult to staff? All sites have been able to be maintained in the past.
383.0.4Appendix APWS Section 3.0.4 shows CP Atterbury, IN and CP Ripley, MN each staffed with 2 Paramedics and 2 EMTs (4 FTEs total), while most other sites require 5 FTEs. Appendix A requires at minimum 2 BLS-Certified Instructor I/Os and 1 ALS-Certified Instructor at each site at all times. Please confirm that this BLS/ALS instructor note is achievable and enforceable at 4-FTE sites. Please see Appendix A as it has been updated to reflect the correct # of FTE's. Yes, the BLS/ALS instructor requirement is enforceable at the 4‑FTE sites.
393.0.4Appendix APWS Section 3.0.4 shows CP Atterbury, IN and CP Ripley, MN each staffed with 2 Paramedics and 2 EMTs (4 FTEs total), while most other sites require 5 FTEs. Appendix A requires at minimum 2 BLS-Certified Instructor I/Os and 1 ALS-Certified Instructor at each site at all times. How does the BLS/ALS instructor requirement apply when a site drops below 4 personnel due to a temporary vacancy — is the site considered non-compliant with the BLS/ALS standard even if the remaining personnel cannot satisfy the minimum combination? Please see Appendix A as it has been updated to reflect the correct # of FTE's.
403.0.4Appendix APWS Section 3.0.4 shows CP Dodge, IA; Ft. Benning, GA; and CP Shelby, MS each staffed with only 1 Paramedic and 2 EMTs (3 FTEs total). Given that Appendix A requires 1 ALS-Certified Instructor at each site at all times, does the Government intend for the single Paramedic at these 3-FTE sites to fulfill the ALS certification requirement exclusively? Please see Appendix A as it has been updated to reflect the correct # of FTE's.
413.0.4Appendix APWS Section 3.0.4 shows CP Dodge, IA; Ft. Benning, GA; and CP Shelby, MS each staffed with only 1 Paramedic and 2 EMTs (3 FTEs total). Appendix A requires 1 ALS-Certified Instructor at each site at all times. If the Paramedic position at one of these 3-FTE sites becomes vacant, is the site considered non-compliant with the ALS certification requirement even if the two EMTs remain on-site?Please see Appendix A as it has been updated to reflect the correct # of FTE's.
423.0.4The original pre-RFP Appendix A listed Ft. Bragg, NC as having 2 MSTCs (10 FTEs, 5 per MSTC). The updated PWS 3.0.4 MMSB table reflects only one entry for Ft. Bragg with 5 total personnel (2 Paramedics, 3 EMTs). Is MIOSS now supporting only one MSTC at Ft. Bragg, or do the 5 MMSB personnel support both Ft. Bragg MSTC facilities simultaneously?Yes only 1 MSTC at Ft. Bragg
433.0.4The original pre-RFP Appendix A listed Ft. Bragg, NC as having 2 MSTCs requiring 10 FTEs (5 per MSTC). The updated PWS 3.0.4 MMSB table reflects only one entry for Ft. Bragg with 5 total personnel. If both Ft. Bragg MSTC facilities must be staffed, will the MMSB be updated to reflect 10 FTEs for Ft. Bragg prior to final RFP release? No see appendix A and PWS section 3
443.0.4PWS Section 3.0.4 includes a note that MSTC locations and minimum required personnel may change over the life of the contract due to Army reformation and funding changes. Please describe the process by which the Government will notify the contractor of site additions, deletions, or staffing level changes, including the minimum advance notice period and whether changes will be executed via bilateral contract modification. The Government will provide formal notification to the contractor of any MSTC site additions, deletions, or required staffing changes through the Contracting Officer (KO). All changes affecting contract scope, funding, or staffing levels will be executed only through a written, bilateral contract modification issued by the KO.
453.0.4Section HPWS Section 3.0.4 notes that MSTC locations and minimum required personnel may change over the life of the contract due to Army reformation and funding changes. When such a Government-directed change occurs, will Section H diminished value deductions be waived or paused during any transition period required for the contractor to adjust staffing accordingly?Yes, and it would be part of the change order as well.
463.18.2PWS Section 3.18.2 states that phase-in will be conducted on an "over the shoulder not to interfere" basis with the incumbent contractor. Will the Government contractually require the incumbent to cooperate with the incoming contractor's phase-in activities? The contractual requirement is included in the incumbant contractor's phase-out activities.
473.18.2PWS Section 3.18.2 requires the incoming contractor to conduct phase-in on an "over the shoulder" basis with the incumbent. What specific Government resources or mechanisms will be available to facilitate coordination between the incoming and incumbent contractors during phase-in, particularly at OCONUS sites in Germany and Korea? The Government and contractor will discuss all processes during kick off meeting
483.0.8.2Section HPWS Section 3.0.8.2 requires the contractor to maintain 100% MMSB during short-term absences using methods such as reach-back/bench personnel, cross-training, or a surge float. Must bench or floater personnel be pre-cleared (Tier 1) and pre-qualified to the applicable labor category standard before being activated to cover a short-term absence? This section has been updated in order to provide a "Grace Period". Please see for specifics.
493.0.8.2Section HPWS Section 3.0.8.2 requires the contractor to maintain 100% MMSB during short-term absences using methods such as reach-back/bench personnel, cross-training, or a surge float. Must bench or floater personnel be identified to the Government in advance as part of the contractor's staffing plan, or can they be introduced to cover a vacancy as needed? This section has been updated in order to provide a "Grace Period". Please see for specifics.
503.0.8.2Section HPWS Section 3.0.8.2 requires the contractor to maintain 100% MMSB during short-term absences using methods such as reach-back/bench personnel. Will the Government treat a site as non-compliant with the MMSB and apply Section H deductions if bench personnel are deployed to cover a short-term absence but are not permanently assigned to that specific site? This section has been updated in order to provide a "Grace Period". Please see for specifics.
513.20.1Appendix APWS Section 3.20.1 permits the contractor to employ a lesser-qualified person on a one-year probationary period when qualified applicants are unavailable in a region. The contractor must formally request a waiver for qualification requirements to the PCO and the medical proponent. Will the Government pause MMSB deductions for the affected position during the waiver review period?PWS Section 3.20.1 was updated to the following: The medical proponent, in coordination with the COR, shall review and approve or reject waiver requests within three (3) business days of receipt. Upon the contractor's submission of a formal waiver request, any applicable MMSB financial deductions for the specified position will be paused pending the Government's decision. If the waiver is approved, no deductions will be applied for the review period. If the waiver is rejected, deductions will be retroactively applied from the first day of the vacancy. Waiver requests lacking sufficient justification, documentation, or mitigation measures shall be rejected.
523.20.1Appendix APWS Section 3.20.1 permits the contractor to employ a lesser-qualified person on a one-year probationary period when qualified applicants are unavailable. What is the Government's expected response timeline for reviewing and adjudicating waiver requests submitted under this provision?PWS Section 3.20.1 was updated to the following: The medical proponent, in coordination with the COR, shall review and approve or reject waiver requests within three (3) business days of receipt.
533.20.1Appendix APWS Section 3.20.1 permits the contractor to request waivers for qualification requirements when regional labor markets lack qualified applicants. Can a waiver request be submitted and adjudicated prior to contract award so the contractor can incorporate any approved waivers into its phase-in and staffing plan?No the attempt has to be made to hire in the labor market before requesting a waiver. Most of these areas already have these positions staffed. This cannot be done prior to contract award as it is handled on a case-by-case basis. Waivers are handled on a case-by-case basis by the Contracting Officer Repersentative and MEDCoE.
54Appendix AAppendix A requires Paramedics and EMTs to comply with military service options including being a "former 68W or 18D Noncommissioned Officer (NCO) Advanced Leader Course (ALC) Graduate." Must the individual have completed ALC prior to separation from service, or is enrollment in or partial completion of ALC acceptable to meet this requirement? To meet the Appendix A requirement of being a "former 68W or 18D NCO ALC Graduate," the individual must have successfully completed ALC before separation. Mere enrollment or partially completing the course will not satisfy the requirement.
55Appendix AAppendix A requires Paramedics and EMTs to comply with military service options including being a "former 68W or 18D NCO ALC Graduate." Does the ALC graduation requirement apply to retired commissioned officers or warrant officers who held senior 68W or 18D related roles during their military service?Only completion of ALC qualifies, not just enrollment or partial attendance. The Army’s NCO Educational System (NCOES), including the Advanced Leader Course (ALC), is explicitly gated to both promotion and reenlistment timelines. A soldier must complete ALC to be eligible to reenlist or serve in positions requiring that level.
56Appendix AAppendix A requires Paramedics and EMTs to be former 68W or 18D NCO ALC Graduates. Are NCOs who achieved the grade of E-7 (Sergeant First Class) or above — and who may have been grandfathered or otherwise exempt from ALC attendance under Army policy at the time of their service — still eligible to meet this requirement based on their service experience alone? This would require a waiver, Waivers are handled on a case-by-case basis by the Contracting Officer Representative and MEDCoE.
57Appendix AAppendix A lists Navy qualification criteria as "A former Navy Enlisted Classification (NEC) 8404 or Navy Independent Duty Corpsman E-6 or above." Please confirm whether these are two separate qualifying criteria (i.e., NEC 8404 OR IDC E-6 or above independently qualify a candidate) or whether both the NEC 8404 designation and the E-6 or above rank must be met concurrently.Either qualification will suffice
58Appendix AAppendix A lists Navy qualification criteria referencing NEC 8404 and Independent Duty Corpsman E-6 or above. Does a retired Navy Independent Duty Corpsman who held the grade of E-5 (below the stated E-6 threshold) qualify for an I/O position if that individual also holds NEC 8404?Yes
59Appendix AAppendix A requires all I/Os to be certified on TC 8-800 (all tables) on an annual basis. Must this TC 8-800 certification be completed and documented prior to the employee beginning performance on the contract, or will the Government allow a reasonable grace period for newly hired personnel to achieve TC 8-800 certification after their start date?TC 8-800 certification is an Army specific requirment and is not available in the civilian sector/market. Tables training, assessment and evaluation will be provided at the MSTC site by Governtment/Military personnel. New hires will have 90 days from hiring to complete tables IAW TC 8-800 and MEDCoE standards.
60Appendix AAppendix A requires all I/Os to complete and maintain TC 8-800 certification (all tables) on an annual basis. Who at each MSTC site is responsible for scheduling, administering, and documenting TC 8-800 certification events for contractor I/O personnel — the Government Course Coordinator, the contractor, or a combination of both?Primary responsibility rest with the government personnel/course coordinator at each location. Contractors will not evaluate themselves on Tables requirments.
613.20.4PWS Section 3.20.4 lists instructor-to-student ratios (1:24 lecture, 1:6 practical exercise, 1:1 invasive procedures and skills validation) and states they are maintained IAW Deployed Medicine/MTN/MEDCoE directives. Are these ratios contractually fixed as stated in the PWS, or are they subject to change at the medical proponent's discretion without requiring a contract modification?Student/Instructor ratios are subject to change based on the medical proponent’s discretion
623.20.4PWS Section 3.20.4 lists instructor-to-student ratios maintained IAW the medical proponent's directives. If the medical proponent adjusts these ratios in a manner that requires the contractor to provide additional personnel beyond the established MMSB to remain compliant, will the contractor be compensated through a bilateral contract modification?Yes.
633.18.3PWS Section 3.18.3 requires the contractor to brief the establishment of Status of Forces Agreement (SOFA) documentation for Germany and Korea at the Post Award Conference. Please identify the specific SOFA documentation required for the Vilseck, Germany and Camp Humphreys, Korea sites.During the phase in period the Government will work its reponsibility for completing the first phase of putting the SOFA agreements into place for the contract. But for the second phase, it is up to the contractor to complete for each of their employees. For Korea Offeror must comply with USFK Regulation 700‑19 process: https://www.usfk.mil/About/USFK/Organization/Special-Staff/Acquisition-Management/

For Germany: https://safe.menlosecurity.com/doc/docview/viewer/docN04AD22560AB0cc2a7e187f195f2783a8de511edbb5592acc79596ffc13cbf54b4c3ce8bf5b8e

Understanding and interpreting the SOFA agreements vis a vis employment authorization is the responsibility of the Offeror.

64 3.18.3 PWS Section 3.18.3 requires the contractor to establish SOFA documentation for the Vilseck, Germany and Camp Humphreys, Korea sites. What specific Government support will be provided to assist the contractor in obtaining the required SOFA authorizations and local registrations necessary to hire and onboard personnel at these OCONUS locations? During the phase in period the Government will work its reponsibility for completing the first phase of putting the SOFA agreements into place for the contract.

65 3.3.4 PWS Section 3.3.4 states the contractor is responsible for considering all costs of doing business OCONUS with no pre- or post-award price adjustments. Will the Government provide any available guidance documents, SOFA agreements, or host-nation labor law summaries applicable to the CP Humphreys, Korea and Vilseck, Germany sites to assist Offerors in accurately pricing OCONUS performance? During the phase in period the Government will work its reponsibility for completing the first phase of putting the SOFA agreements into place for the contract. But for the second phase, it is up to the contractor to complete for each of their employees. What labor categories does the Government expect to be included within the Program Management pricing component (e.g., Program Manager, Deputy Program Manager, administrative support staff)? The contractor shall determine what labor categories are necessary to effectively manage the contract and will be part of their progfam management plan that they will discuss during their oral presentation.
70Section L.4.7.0 states that Program Management shall be proposed on an FFP basis in addition to the established MMSB of 110 FTEs. Are Program Management personnel (e.g., Program Manager, Site Leads) included within the 110-FTE MMSB headcount, or are they proposed and funded separately above and beyond the MMSB?Program Management is separate from the 110 FTE staffing floor. However, Site Leads may be included within the 110 FTE count, though it is not a requirement it is all determined on how the Offeror's Program Management Plan is set up.
