About this file
This document is a Recreational/Commercial Use Agreement between Collier County Board of County Commissioners and a vessel owner for use of a boat slip at Collier County Marina. The agreement grants the user non-exclusive docking and mooring rights for a single recreational or commercial fishing vessel at a designated slip within the marina facility, which is located on state-leased sovereign submerged lands. The agreement operates on a month-to-month basis beginning March 15, 2021, and may be terminated by either party with fifteen days' notice. The user's vessel, a 23-foot Forest River fishing boat registered in 2012, must remain wholly within the slip boundaries and maintain current state registration and operational capability. The agreement prohibits liveaboard vessels, defined as those inhabited for five or more consecutive days or ten or more days within a thirty-day period, and prohibits sewage discharge into surface waters.
Monthly use fees are determined by Collier County Board of County Commissioners resolution and may be adjusted annually; the user must pay the first month's fee and last month's fee upon execution. Use fees are due by the tenth of each month, with a five percent late charge assessed monthly for unpaid amounts. The agreement requires the user to maintain comprehensive insurance with minimum coverage of $300,000 per occurrence for recreational users (or $500,000 for commercial users) naming Collier County as additional insured, and commercial users must provide workers' compensation coverage. The user is responsible for all vessel maintenance, utilities if applicable, environmental compliance, and damages caused by the vessel or user's activities. The County reserves rights to inspect the slip, reassign it to another of equal or greater size with ten days' notice, modify marina operations, and immediately eject vessels for non-compliance with regulations or failure to maintain required boat lift certifications within thirty days of agreement execution or annually thereafter.
