About this file

This Request for Proposal (RFP 758 2000000118) is issued by the Commonwealth of Kentucky Finance and Administration Cabinet on behalf of the Kentucky Department of Fish and Wildlife Resources (KDFWR) to solicit proposals for experimental Asian carp fishing gears and methods. The procurement seeks multiple contract awards from entities presenting viable proposals for testing new harvest gears designed to increase Asian carp removal efficiency while ensuring fisher safety and protection of non-target aquatic species. Proposals were accepted on a rolling basis with a closing date of November 27, 2020, at 3:30 PM EST. No vendor's conference was scheduled. The initial contract term is one year from the award date, with options for two additional one-year renewals upon mutual agreement of the parties. Testing must be conducted by Kentucky licensed commercial fishermen with at least one KDFWR staff member present during all test events. The Commonwealth will schedule sampling locations, dates, and times, and vendors must provide all equipment, sampling gear, and necessary staff to conduct the testing.

The Commonwealth will not provide payments to contractors for evaluating experimental fishing gear and methods. Vendors are responsible for legal disposal of all harvested Asian carp and may sell harvested fish to buyers of their choice. The proposal evaluation is based on pass/fail criteria assessing the description and expectations of test gear, vendor expertise, and schedule flexibility for KDFWR observers. No cost proposal is required, though Kentucky resident bidder reciprocal preference and qualified bidder preferences apply. Vendors must submit proposals via secure file transfer in three parts: Technical Proposal, Cost Proposal (not required), and Proprietary Information. All proposals must include a signed face of solicitation, transmittal letter with required affidavits and certifications, Kentucky Tax Registration Application (Revenue Form 10A100), and Secretary of State registration for foreign entities. Five addenda were issued between January and May 2020, primarily addressing administrative updates and secure file transfer procedures.

SECTION 20 – BACKGROUND AND PRESENT SYSTEM SUMMARY

20.1 Background

Kentucky is partnering with industry to help us control Asian carp, enlisting the commercial fishing industry as a management tool. A part of our commitment to controlling these invasive fish populations is assisting with the development of a new fish industry focused on mass-removal of Asian carp for its products. The fledgling industry is the most important tool that the Kentucky Department of Fish and Wildlife Resources (Department) has to realize significant reduction of the invasive fishes’ numbers. Currently, the fate of two of the state’s most economically important reservoirs concerning fishing, boating recreation, and tourism is dependent upon commercial removal efforts. The primary hurdle to the success of this industry is our commercial fishermen’s abilities to harvest enough Asian carp to consistently provide a supply to satisfy market needs, while at the same time reducing Asian carp densities in our waters. It is imperative that Kentucky facilitate testing of experimental gears which could prove to be more efficient with mass-harvest of Asian carp.

50.6 Scope of Work/Technical Requirements

The Kentucky Department of Fish and Wildlife Resources (KDFWR) is charged with conserving and enhancing wildlife resources and providing opportunity for hunting, fishing, and other wildlife related activities. Asian carp represent a major problem for many states because of their prolific nature, their ability to outcompete native fish and other aquatic species for forage, and the silver carps’ tendencies to leap high into the air and land in boats, thereby destroying expensive equipment and potentially harming the boats inhabitants. These issues are well documented in Kentucky and Barkley lakes, two very high profile tourism destinations and economically important reservoirs in Kentucky.

KDFWR is focused on significantly reducing Asian carp numbers in the two reservoirs and other Kentucky waters. To augment current programs with that goal, the Department plans to work with other state and federal agencies to test new, more efficient fish harvest methods. Additionally, the department needs to work with private individuals and businesses (entities) to aid in the development of new gears and methods. KDFWR may partner with private entities alone, or also may incorporate assistance of the private entities in the multi-agency efforts.

Therefore, we would like to establish a Master Agreement with qualifying entities to allow testing new methods of harvesting Asian carp. If the methods and gears prove effective and can be safely administered by current licensed commercial fishers, regulation proposals will be considered to make the gears legal methods for harvesting Asian carp. Otherwise, if special conditions and qualifications are warranted to allow use of the tested gears, KDFWR will consider requesting specific, sole source contracts with entities that will include clauses to provide consideration for anglers and recreational boaters and to ensure their safety and the safety of native fish populations.

THE FOLLOWING ARE CONDITIONS OF THE GEAR AND METHODS

TESTING MASTER AGREEMENT:

KDFWR requires that all testing of commercial fishing methods be conducted by Kentucky licensed commercial fishermen. Free licenses are available if only Asian carp are harvested.

Pursuant to KRS 150.460(2), KDFWR is authorized to use any device in research or resource management work, and any entity approved to testing new fish harvest methods will be required to have at least 1 KDFWR staff present for all tests.

KDFWR will receive proposals from entities to test new methods and gears to harvest Asian carp. The Department will assess to feasibility of the test gears and methods as follows:

Gear types must be safe to administer in public waters.

Gear types must be safe to deploy and operate.

The entities Gear types must be qualified to use special fish harvesting gears.

The harvest methods must not be detrimental to native fish species;

especially sportfish threatened or endangered species, or species of conservation concern.

50.7 The proposed gears and methods must appear to have some reasonable semblance of being effective for mass harvests. Qualified resource KDFWR biologists in coordination with the Kentucky Aquatic Nuisance Species Program Director will make those determinations.

50.8 Entities must agree to end any tests considered by the Department to be detrimental, unsafe, or unsuccessful for significant Asian carp harvests. It will be up to the discretion of KDFWR to make final judgements as to the efficacy of the gears tested, and whether to propose new regulations to allow widespread use by the commercial industry or if the methods and gears should be used commercially only through sole-source or other specific contracts with the Commonwealth.

50.9 KDFWR staff will collect data to assess harvest efficiencies over various weather and water conditions, bycatch tendencies, and all data considered pertinent to determine whether the tested gears warrant consideration as a viable commercial harvest gear.

50.10 Entities will provide all equipment, sampling gear, and necessary staff to test gears and methods.

50.11 KDFWR will schedule sampling locations, dates and times with the entities.

50.12 The entities will not attempt sampling or testing gears and methods without KDFWR staff present.

50.13 Entities will be responsible for proper disposal of all Asian carp harvested during testing and if desired, will be allowed to sell any or all harvested Asian carp to a buyer or buyers of their choice.

50.14 Employees or agents of each party will remain employees or agents of that party and at no point does an employee or agent of one party become an agent for or employee of the other party.

50.15 Entities will retain ownership of all intellectual property used to complete gears and methods testing.

50.16 Except as expressly set forth in this Agreement, nothing in this Agreement shall be construed as granting to or conferring upon the entities any right, title, or interest in any intellectual property that is now owned or subsequently owned by the KDFWR. Except as expressly set forth in this Agreement, nothing in this Agreement shall be construed as granting to or conferring upon the KDFWR any right, title, or interest in any of the entities’ intellectual property that is now owned or subsequently owned by the entity.

50.17 Neither party grants the other the right to use its trademarks, trade names, service marks, or other designations in any promotion or publication without prior written consent.

50.18 By entering into this Agreement, neither party is directly or indirectly endorsing any product or service that is or will be provided, whether directly or indirectly related to this Agreement. Nothing in this Agreement shall constitute an endorsement of one party by the other.

50.19 Liability:

The successful bidder agrees to indemnify and hold harmless the Commonwealth from any and all claims, demands, damages, actions, costs, including attorney’s fees, and charges for which the Commonwealth may be subject, or for which the Commonwealth, or the successful bidder, may be required to pay by reason of injury to any person or property or loss of life or property resulting from or in any way connected to the character, condition or use of the leased premises or any means of ingress thereto, or egress there from unless such injury or loss arises directly from the negligence of the Commonwealth, or any of its officers, agents or employees, while acting within the scope of their employment. The successful bidder shall, at their own expense, assume defense of such claims and actions for damages or judgments arising directly from the negligence of the Commonwealth, any of its Departments or Agencies, or any of its officers, agents, or employees while acting within the scope of their employment. KDFWR reserves the right to require program contractors to produce proof of insurance upon request.
