Summary of Pilcher Timber Sale Sample Contract
This sample timber sale contract is between the State of Oregon Department of Fish and Wildlife (ODFW) and a successful bidder for the harvest of timber on 253 acres of the Elkhorn Wildlife Area located in Union County, Oregon. The contract establishes terms and conditions for harvesting timber designated as merchantable logs from mixed conifer forest consisting primarily of Ponderosa Pine, Western Larch, Douglas Fir, and Grand Fir at elevations ranging from 4,100 to 4,200 feet. The successful bidder must complete two primary components: Project Work consisting of approximately 4.0 miles of road improvement and maintenance, and fell, skid, and pile operations for sub-merchantable material; and Timber Harvesting Operations involving the removal of designated logs meeting minimum specifications of 6 inches diameter and 20 board feet net volume for sawlogs, with an estimated total of 2,668 MBF of sawlog volume and optional pulp log removal. The contract includes seasonal restrictions limiting operations to December 1 through March 1 with minimum 18-inch snow cover requirements, and establishes a contract expiration date of June 30, 2028, with no renewal options specified.
Pricing is established on a recovery basis with sawmill-grade conifer logs priced per ton, with specific rates for Douglas Fir/Western Larch/Grand Fir/White Wood species at the highest rate and Ponderosa Pine at a lower rate, while pulp logs are optional at a specified lower rate. The successful bidder must submit advance payments totaling 10 percent of the estimated bid value prior to commencing operations, with subsequent payments due in advance of timber removal. The bidder must furnish a performance bond equal to the greater of the project work value or 20 percent of total purchase price, and a payment bond guaranteeing one month plus 15 days of timber removal value. The contract requires comprehensive insurance including Commercial General Liability of $2,000,000 combined single limit, Automobile Liability of $2,000,000, and Loggers Broad Form coverage of $2,000,000, plus Workers' Compensation insurance as required by Oregon law. Project Work credits of $12,273.46 are provided to offset timber costs, comprising $4,273.60 for road improvement and $7,999.86 for sub-merchantable material removal and landing cleanup.
