About this file
This is an Instructions to Bidders document issued by the West Virginia Department of Environmental Protection for construction and reclamation contracts, specifically for solicitation DEP22-063. The document provides comprehensive procedural requirements for vendors submitting electronic bids through the wvOASIS Vendor Self Service portal. Vendors must establish accounts on wvOASIS prior to submission, and all bids must be submitted electronically before the bid closing date and time specified in the associated solicitation. The document does not specify individual project details, quantities, response dates, or award dates, as it serves as a general instruction template applicable to multiple construction procurements. Bids submitted before the closing deadline will be publicly available within 24 hours of closure on the Department's website. Vendors are responsible for monitoring the Vendor Self Service Portal for any addenda issued by the Department, and failure to incorporate the latest addendum information may result in bid disqualification.
The document establishes mandatory compliance requirements including submission of a bid bond equal to five percent of the total bid amount, valid West Virginia contractor licensing, and a signed and notarized drug-free workplace affidavit for public improvement contracts exceeding $100,000. For contracts valued above $1 million, vendors must submit an interested party disclosure form to the WV Ethics Commission prior to award. For construction contracts exceeding $250,000, the apparent low bidder must submit a subcontractor list within one business day of bid opening, identifying all subcontractors performing more than $25,000 of work and including their license numbers. Contractors must also submit annual certified drug-free workplace reports during contract performance. All file submissions must be immediately accessible and viewable at bid opening, with encrypted or password-protected files considered blank or incomplete. Award notifications are provided via email to successful bidders, with inquiries directed to DEPProcurement@wv.gov.
