About this file

This is a Construction Bid Submission Review Form created by the State of West Virginia Department of Environmental Protection (DEP) on August 11, 2017. The document serves as an informational guide for potential bidders on construction projects, outlining common issues that may result in bid disqualification. The form emphasizes that all bidders must thoroughly review the complete request for quotation (RFQ) documents, including all addenda, instructions, and supporting materials to identify specific bidding requirements for individual projects. The document does not establish itself as a comprehensive list of all bidding requirements but rather highlights frequent problems encountered during the construction bidding process. Failure to comply with stated requirements in the Bid Documents may result in immediate disqualification.

The form identifies two categories of disqualification errors: those resulting in immediate bid disqualification and those that may result in disqualification before contract award. Immediate disqualification errors include failure to attend mandatory pre-bid meetings, failure to sign required signature pages, failure to supply valid bid bonds, non-compliance with mandatory RFQ requirements, failure to acknowledge receipt of addenda (if required), late bid submission, federal or state debarment or suspension, outstanding environmental enforcement actions, and unresolved DEP vendor complaints. Potential disqualification errors before award include outstanding debt to the state or political subdivision, workers' compensation or unemployment compensation delinquency, failure to obtain required bonds and insurance, failure to provide a West Virginia contractor's license number within one day of request, failure to submit a signed drug-free workplace affidavit within one day of request, and failure to provide a subcontractor listing within one business day of bid opening or DEP request.
