About this file
This is a Bid Bond Form with preparation instructions issued by the State of West Virginia, Department of Administration, Purchasing Section. The document serves as a template for bidders submitting proposals in response to RFQs or RFPs. The bid bond is a required financial instrument that bidders must submit alongside their bids to demonstrate good faith commitment to entering into a contract if their proposal is accepted. The form requires bidders to identify the principal (bidder), surety (bonding company), obligee (State of West Virginia), and the scope of work being bid upon. No specific project details, quantities, response dates, site visits, or award dates are provided in this template document, as it is a standardized form for use across multiple state procurement opportunities.
The minimum acceptable bid bond amount is five percent of the total bid value, which bidders may express either as a percentage or a specific dollar amount. The surety executing the bond must be licensed in West Virginia to transact surety insurance, must affix its corporate seal, and must provide a dated Power of Attorney with seal affixed. The bond obligation becomes null and void if the bid is rejected or if the principal is accepted and enters into a contract in accordance with the bid terms while furnishing all required bonds, insurance, and performing the agreement as specified. The surety's liability is capped at the penal sum stated in the bond, and the surety waives notice of any extensions of time for bid acceptance.
