About this file

This is a Certification of Executive Order 18-03 Workers' Rights appendix submitted as part of Request for Qualifications and Quotations (RFQQ) No. 25-00017 issued by the Washington Department of Fish and Wildlife (WDFW). The solicitation seeks qualified organizations to purchase surplus salmon carcasses and eggs from WDFW hatcheries located throughout Washington state and arrange for their removal. This certification document serves as a mandatory attachment to bids submitted in response to the RFQQ and requires bidders to declare their employment practices regarding arbitration clauses and class action waivers. The solicitation dollar value reflects the estimated volume of sales the contractor is expected to generate, though specific quantities, response deadlines, and award timelines are not detailed in this appendix.

Bidders who certify that their firm does NOT require employees to sign mandatory individual arbitration clauses or class or collective action waivers as a condition of employment will receive a 3% bid preference under the best value evaluation criteria outlined in RCW 39.26.160(3). This workers' rights preference is authorized under Washington Executive Order 18-03 (dated June 12, 2018) and is designed to support companies with workplace practices that protect employee rights. Bidders must complete the certification form by identifying their firm's legal entity name, having an authorized company representative sign and date the document under penalty of perjury, and selecting one of two options regarding their mandatory arbitration and class action waiver policies. The certification must be executed in accordance with Washington state law.
