About this file
This is a Designation of Confidential and Proprietary Information form (DOA-3027) submitted by the State of Wisconsin, Department of Justice, in response to Request for Bids (RFB) No. DOJ-2018-02 for the printing, preparation, and delivery of U.S. Supreme Court Briefs and Appendices. The form allows bidders to designate specific pages of their bid or proposal response as confidential and proprietary information protected under Wisconsin Statutes Section 19.36(5) and the Wisconsin Open Records Law. Bidders must identify which sections and pages they wish to keep confidential, provided the information qualifies as a trade secret as defined under Wisconsin Statutes Section 134.90(1)(c), meaning the information derives independent economic value from not being generally known and is subject to reasonable efforts to maintain secrecy. Notably, bid prices always become public information upon opening and cannot be designated as confidential.
Bidders who submit this form must provide the company name, authorized representative name and signature, and date. The form requires bidders to understand that failure to include this completed form may result in all bid information being subject to public examination and copying. Additionally, bidders agree to hold the state harmless for any costs, damages, or legal assistance needed to defend confidentiality designations if challenged, and to hold the state harmless for any damages arising from the release of materials unless they are specifically identified on this form. The state considers other markings of confidentiality in bid documents to be insufficient; only information formally designated on this official form will receive confidential treatment.

We request that the following pages not be released
