The Technical Volume must contain completed Technical Quote Questionnaires demonstrating compliance with mandatory requirements, commercial literature/cut sheets describing specific equipment, and a proposed methodology and schedule. The Past Performance Volume requires up to three references from contracts performed within the last five years with similar scope of work and overseas workforce management experience, submitted via Past Performance Questionnaires completed by referenced customers or contracting activities. The Price Volume must include a completed SF 1449 form and Summary Price Sheet with all line items priced except the data line item (Not Separately Priced). Offerors must hold prices firm for 90 calendar days. The Government will evaluate offers based on three factors weighted approximately equally: Technical Capability (rated Outstanding, Good, Acceptable, Marginal, or Unacceptable), Past Performance (rated Substantial, Satisfactory, Neutral, Limited, or No Confidence), and Price (evaluated for completeness, reasonableness, and balanced pricing). Award may be made to a higher-priced offeror if technical capability and past performance represent better overall value. All line items will be awarded to a single offeror. RFO Clause 52.212-2 Evaluation—Commercial Products and Commercial Services.

As prescribed in 12.205(a)(2), insert a provision substantially as follows: Evaluation—Commercial Products and Commercial Services (Deviation Date)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

price, technical, and past performance. *Evaluation factors other than price when combined are approximately equal to price*

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to RFO Clause 52.212-2 Evaluation—Commercial Products and Commercial Services.

(d) This is a competitive acquisition for a Firm-Fixed-Price (FFP) contract for a Baggage Conveyor System conducted in accordance with (IAW) Revolutionary Federal Acquisition Regulation Overhaul (RFO) part 12. The Government will select the best offer which conforms to the solicitation requirements (to include all stated terms, conditions, representations, certifications, and all other information required by the submission instructions), and is judged, based on the evaluation factors to represent the best value to the Government IAW

RFO 12.203.

The Government seeks to award to the offeror who provides the best value in fulfilling the requirement. This may result in an award to a better value, higher priced offeror, where the decision is consistent with the evaluation factors, and the Government reasonably determines that technical capability and past performance of the higher priced offeror outweighs the price difference.

The Government will review all documents for compliance and will conduct comparative evaluations of offers to determine best value.

The Government reserves the right to award a contract to other than the lowest priced offer if a higher rated offeror represents overall best value to the Government. Evaluation factors other than price when combined are approximately equal to price.

The following factors (correlating to the respective volume) shall be used to evaluate each offer:

Volume I: Technical Capability – Under this factor, the Government will evaluate the Offeror's proposed technical capability based on the written documentation submitted in accordance with the Addendum to RFO Clause 52.212-1, Instructions to Offerors. During evaluation of each quote, the Government will assign a rating, as shown below, to identify an offeror's ability to accomplish this factor. The following subfactors will be evaluated to determine technical capability:

CONTROLLED UNCLASSIFIED INFORMATION (CUI)

Subfactor 1: TQQs

(a) Offerors will be evaluated on their completed TQQs in accordance with RFO Clause 52.212-1 and the requirements of the quotation checklist (Appendix D). The TQQs demonstrate the vendor's capabilities for providing the mandatory requirements set forth in the Appendix_SOW_Cover PD and all Appendices.

2. Subfactor 2: Commercial Literature/Cut Sheets

(a) Offerors will be evaluated on providing all literature/cut sheets in accordance with RFO Clause 52.212-1 and the requirements of the Quotation checklist (Appendix D). The literature/cut sheets must thoroughly describe/ depict the characteristics of the specific equipment required to meet the requirements of the Appendix _SOW_Cover PD and Appendices and the methodology proposed.

3. Subfactor 3: Proposed Schedule

(a) Offerors will be evaluated on their proposed schedule. The schedule must provide a logical progression of defined objectives, events, and submittals and includes steps which are relevant and required to complete the work in accordance with the delivery schedule contained in the solicitation.

Offerors will be scored by the following adjectival ratings for the overall Technical Capability factor:

Rating Description

Outstanding Demonstrates an exceptional approach and understanding of the baggage conveyor requirements, contains multiple strengths and/or at least one significant strength.

Good Demonstrates a thorough approach and understanding of the requirements and contains at least one strength or significant strength.

Acceptable Demonstrates an adequate approach and understanding of the requirements.

Marginal Does not demonstrate an adequate approach and understanding of the requirements and contains one (1) deficiency.

Unacceptable Does not meet the requirements of the solicitation and thus is ineligible for award and contains more than one (1) deficiency.

Volume II: Past Performance – Under this factor, the Government will evaluate the Offeror's Past Performance based on the following four (4) criteria: Recency (within the last five (5) years from the date of solicitation), Relevancy (same or similar scope of work), Quality (how well the offeror performed on past contracts), and Place of Performance (experience managing an overseas workforce and adhering to overseas requirements).

Each Past Performance Questionnaire (PPQ) received will be evaluated based on the above four (4) criteria.

Once all PPQs have been evaluated, an overall performance confidence assessment rating will be assigned.

CONTROLLED UNCLASSIFIED INFORMATION (CUI)

Table B - Performance Confidence Assessment Ratings

• Substantial Confidence: Based on the offeror's recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

• Satisfactory Confidence: Based on the offeror's recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

• Neutral Confidence: No recent/relevant performance record is available. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

• Limited Confidence: Based on the offeror's recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

• No Confidence: Based on the offeror's recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

* Note on Past Performance:

• A higher Performance Confidence Assessment Rating may be viewed more favorably than a lower rating.

• In the case of an offeror without a record of relevant past performance, or where information is so sparse that no meaningful rating can be assigned, the offeror shall be determined to have "Neutral" past performance and will not be evaluated favorably or unfavorably.

• The Government will utilize submitted PPQs but reserves the right to obtain information from other sources, including CPARS, FAPIIS/SAM, eSRS, or interviews with Program Managers and Contracting Officers.

• When a completed PPQ is inconsistent with a CPARS rating, the CPARS report will take precedence.

Volume III: Price – Under this factor, the Government will evaluate the Offeror's price based on the following:

Offers will be evaluated for (i) Total Evaluated Price (TEP), (ii) completeness, (iii) reasonableness, and (iv) Balanced Pricing. Offerors whose price is determined to be incomplete or unreasonable will not be considered for award.

Total Evaluated Price (TEP): The TEP will be calculated as the sum of all proposed line items for the Baggage Conveyor System, inclusive of all transportation and delivery charges to the destination.

(a) Completeness: Pricing will be reviewed to determine if all price information requested by the solicitation has been submitted. The Government may reject an offer if the pricing does not include all normal costs associated with fulfilling the requirement.

(b) Reasonableness: For a price to be reasonable, it must represent a price to the Government that a reasonably prudent person would expect to pay in the conduct of competitive business for the same or similar system. The Government will determine prices fair and reasonable through the use of price analysis techniques at RFO 12.204.

(c) Balanced Pricing: Quotations will be evaluated to determine if any CLIN is significantly over or understated.

An unbalanced quotation may be rejected if the CO determines that the lack of balance poses an unacceptable risk to the Government.
