About this file
This is an Appendix document outlining Veteran-Owned Small Business Enterprises (VSBE) participation requirements for a Substance Use Disorder Treatment Services solicitation (BPM055259) issued by the Maryland Department of Correction, effective September 1, 2026. The solicitation requires bidders and offerors to structure their contract performance to achieve a specific VSBE participation goal as the total contract dollar amount, with all certified VSBEs required to be registered on the State's eMaryland Marketplace Advantage (eMMA) platform. Bidders must identify specific work categories appropriate for subcontracting, conduct documented outreach to potential VSBE vendors through the Directory and VetBiz databases, solicit VSBEs before bid submission, make personal contact attempts with solicited VSBEs, assist with bonding requirements, and attempt to attend pre-bid meetings scheduled by the procurement agency. Each bidder or offeror must submit a completed VSBE Utilization Affidavit and Participation Schedule (Attachment E) at the time of bid or proposal submission, committing either to meet the full VSBE goal or requesting a full or partial waiver with documented good faith efforts justification.
Within 10 business days of notification as the apparent awardee, the successful bidder must submit the VSBE Project Participation Statement and any required waiver documentation or face a determination of non-responsibility. The contract requires monthly VSBE participation reporting by the 10th of each month following the reporting period, including paid and unpaid invoice reports from VSBE subcontractors with invoices over 45 days old. The contractor must maintain detailed records of all VSBE and non-VSBE subcontractors, work performed, and dollar values for three years after final contract completion, with records subject to State inspection and verification. When a verified VSBE firm serves as the prime contractor, the agency may count up to 100 percent of the distinct, clearly defined work performed by the VSBE with its own workforce toward meeting the VSBE goal, with any remaining goal percentage to be achieved through verified VSBE subcontractors.

Appendix 5. Veteran-Owned Small Business Enterprises (VSBE) Participation Goal

If, within three business days, the bidder or offeror fails to submit the amended form or forms correcting the deficiency identified, the procurement officer may determine, in the case of a bid, that the bid is not responsive or, in the case of a proposal, that the proposal is not reasonably susceptible of being selected for award.
