About this file
This is a Staffing Service Level Agreement (SLA) appendix for the Substance Use Disorder Treatment Services – DOC Facilities Statewide contract (Solicitation #BPM055259) administered by the Maryland Department of Correction. The document establishes minimum staffing performance standards to ensure uninterrupted delivery of substance use disorder treatment services, including SUD screening and assessments, medication for opioid use disorder counseling, ASAM Level 2.1 intensive outpatient treatment programs, and related clinical and re-entry services across all DOC facilities statewide. The contractor must maintain sufficient qualified personnel as specified in the Department-provided Quarterly Staffing Matrix, with staffing performance measured monthly based on staffing levels as of the last calendar day of each month.
Staffing compliance is calculated as the percentage of filled positions divided by required positions, with performance levels triggering specific service credit deductions from the monthly administrative fee: 95% or greater results in no service credit, 90% to 94.99% results in a 0.5% deduction, 85% to 89.99% results in a 1% deduction, and below 85% results in a 2% deduction plus submission of a corrective action plan. Provisionally filled positions may be counted toward compliance for up to 60 calendar days from background investigation submission. If staffing remains at critical deficiency levels for two consecutive months or three months within any rolling 12-month period, the contractor may face additional contractual remedies including payment withholding or termination for default. The contractor must submit corrective action plans within five business days of Department notification when staffing falls below 85%, detailing reasons for deficiency, vacant positions, ongoing recruitment activities, interim staffing measures, and anticipated restoration dates.

Appendix 11. Staffing Service Level Agreement (SLA)
I. Purpose
The purpose of this Staffing Service Level Agreement (SLA) is to establish the minimum staffing performance standards required to ensure uninterrupted delivery of services under the Contract.
The Contractor shall maintain sufficient qualified personnel to perform all services in accordance with the requirements of this Contract.
Staffing performance shall be monitored monthly by the Department using the Department-provided Quarterly Staffing Matrix.
II. Performance Standard
The Contractor shall maintain staffing levels sufficient to perform all Contract requirements and shall maintain staffing in accordance with the Department-provided Quarterly Staffing Matrix.
Staffing performance shall be measured monthly based on the staffing level as of the last calendar day of each month.
III. Staffing Calculation
Staffing compliance shall be calculated as follows:
Staffing Percentage = (Number of Filled Positions / Number of Required Positions) * 100
The Quarterly Staffing Matrix shall serve as the official staffing document for purposes of determining staffing compliance.
Positions approved by the Contract Manager to be temporarily suspended or removed from the Staffing Matrix shall not be included in the calculation.
IV. Provisional Staffing Credit
A position shall be considered provisionally filled for purposes of this SLA provided all of the following conditions have been met:
• The Contractor has extended an offer of employment and the candidate has accepted the position;
• The candidate has been submitted to the Department for all required background investigations and security clearances;
• The candidate is actively awaiting Department approval to begin work.
A provisionally filled position may be counted towards staffing compliance for a period not to exceed sixty (60) calendar days from the date the complete background investigation package is submitted to the Department.
If the candidate withdraws, is determined ineligible, fails to obtain the required clearance, or has not received Department approval within sixty (60) calendar days, the position shall be considered vacant unless otherwise approved in writing by the Contract Manager.

V. Staffing Performance Levels
Monthly Staffing Level Performance Status Service Credit
95.00% or greater Meets Service Level None
90.00% - 94.99% Minor Staffing Deficiency 0.5% of the monthly Administrative Fee
85% - 89.99% Significant Staffing Deficiency 1% of the monthly Administrative Fee
Below 85.00% Critical Staffing Deficiency 2% of the monthly Administrative Fee and submission of a Corrective Action Plan.
VI. Assessment of Service Credits
Service Credits shall be calculated using the Contractor’s monthly Administrative Fee for the applicable billing period.
The Department may deduct any assessed Service Credit from payment of the Contractor’s monthly invoice.
Assessment of a Service Credit does not relieve the Contractor of its obligation to perform all Contract requirements.
VII. Corrective Action Plan
If staffing falls below 85%, the Contractor shall submit a written Corrective Action Plan to the Contract Manager within five (5) Business Days after notification by the Department.
The Corrective Action Plan shall include, at a minimum:
1. The reason(s) for the staffing deficiency.
2. The positions currently vacant.
3. Recruitment and hiring activities underway.
4. Interim staffing measures implemented to maintain required services.
5. The anticipated date on which full staffing compliance will be restored.
The Department may require revisions to the Corrective Action Plan as necessary, or may reject the Corrective Action Plan, and direct the Contractor to take specific corrective action.
VIII. Chronic Nonperformance
Maintaining Critical Staffing Deficiency levels for two (2) consecutive months; or three (3) months during any rolling twelve (12) month period, may constitute unsatisfactory contract performance and may result in additional contractual remedies, including requiring additional corrective actions, withholding payment, or termination for default in accordance with the Contract.
IX. Reservation of Rights
The assessment of Service Credits under this Appendix is intended to encourage timely correction of staffing deficiencies and shall not limit or waive any other rights or remedies available to the Department under the Contract or applicable law.
