The positions listed in the table below are the expected labor categories needed to complete the first Task Order (TO) under this contract.
ACC-APG does not make the determination as to whether these positions will be classified as professional or non-professional, therefore, please clearly indicate each proposed labor category as professional (P) or non-professional (N). As the contractor, you are subject to all of Department of Labor's rules and are subject to the Department of Labor's audit procedures. By classifying the positions, you take full responsibility for any of Department of Labor's findings during an audit.
If you want to propose a position that is not listed within the wage determination, you must determine whether this position is a professional or non-professional position.
Within each wage determination the Department of Labor states that the positions under a Federal Contract must be specifically listed in the wage determination. If the position is professional, it is not subject to the Service Contract Act. If the position is not professional and is not listed under the wage determination, the following must be completed as a part of your proposal package.
If you consider the positions within your proposal to be professional, follow the instructions found in Paragraph (b) below. If you consider the positions within your proposal to be non-professional, see the instructions in Paragraph (a) below. An example of a non-professional position which is not listed in the wage determination would be an Administrative Assistant.
a. Please review the Service Contract Act Directory of Occupations which can be found at http://www.dol.gov/esa/regs/compliance/whd/wage/main.htm and see if the positions you want to offer will fit into any of the currently published occupation titles under the wage determination. For the positions that you list as non-professional, please indicate (N) in a separate column. If you have a non-professional labor category and can make a reasonable relationship to a category listed on the SCA Directory of Occupations, provide a cross reference sheet showing which DOL position relates to the position in your offer. If the position will not fit into any of the currently published occupation titles, please review the instructions in the wage determination entitled “The process for preparing a conformance request”. In accordance with the Department of Labor instructions which can be found in each wage determination, entitled Conformance Process, “any class of service employee which is not listed herein and which is to be employed under the contract (i.e., the work to be performed is not performed by any classification listed in the wage determination), be classified by the contractor so as to provide a reasonable relationship (i.e., appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed classes of employees shall be paid the monetary wages and furnished the fringe benefits as are determined. Such conforming process shall be initiated by the contractor prior to the performance of contract work by such unlisted class(s) of employees. The conformed classification, wage rate, and/or fringe benefits shall be retroactive to the commencement date of the contract. (See Section 4.6(c)(vi) ).”
If you decide that the positions require conformance, please include a statement of your intent to prepare the required written reports and forms within the time frames specified by the Department of Labor, and provide documentation as to where the hourly base rates were developed from and provide supporting documentation such as invoices, price list's, Salary.com, current contracts, etc. If using Salary.com for base pricing, provide a print-out from Salary.com in support of pricing. You must provide invoices to show commercial sales in support of the rates proposed. Since these positions will not appear on future wage determinations, you must propose a method to be used for future price adjustments.
b. For the positions that you list as professional, please indicate (P) in a separate column. Provide documentation as to where the hourly base rate was developed from and provide supporting documentation such as invoices, price list's, Salary.com, current contracts, etc. If using Salary.com for base pricing, provide a print-out from Salary.com in support of pricing for each position. You must provide invoices to show commercial sales in support of the rates proposed. Also, for these positions, please propose a method to be used for future price adjustments.
