About this file
This document is an agenda item from the New Smyrna Beach Utilities Commission (NSBU) Board meeting held October 27, 2025, presenting the bid tabulation and award recommendation for RFP No. 15-25 for Annual Underground Utility Contractor Services. The RFP, issued on July 7, 2025, sought qualified contractors to provide specialized underground utility construction and repair work within NSBU's water, wastewater, and reclaimed water distribution systems across their service territory in Volusia County and Orlando City, Florida. Services include new construction, repair and rehabilitation of existing infrastructure, and pipe, pump, and mechanical work at water and wastewater facilities such as raw water wells, sewer lift stations, treatment plants, and pump stations. The procurement received 17 proposals by the August 19, 2025 deadline, which were evaluated by committee across five criteria: location (20 points), project lists (25 points), references (30 points), price (20 points), and completed forms (5 points). The initial contract term is one year with options to extend for three additional one-year periods. NSBU recommends awarding three annual service agreements to support faster emergency response times and ensure planned projects proceed without delay.
The Board approved awarding the three service agreements to the highest-ranked contractors: Hazen Construction (92.08 points), Driveways, Inc. (90.42 points), and McMahan Construction, Inc. (87.92 points). Work will be assigned through individual work orders created on an individual basis, with any projects totaling $100,000 or more requiring NSBU Commission ratification. The evaluation committee scores for all 15 competing contractors are documented in the bid tab, ranging from 59.17 to 92.08 points across the four evaluators. Compensation will be provided on an hourly basis for emergency work and per unit costs for planned work, with price escalation or de-escalation permitted at the end of each contract year upon mutual written agreement. Contractors must maintain comprehensive insurance coverage including general liability, automobile liability, workers' compensation, professional liability, and contractors' pollution liability, and must have a minimum of five years' business experience in this specialized work.

1) RFP No. 15-25 Bid Tab
Approval - RFP No. 15-25 Award - Underground Utility Contractor Services For Water Resources (Continuing Professional Services Agmts.)
On July 7, 2025, NSBU issued an RFP #15-25, Request for Proposal for Annual Underground (URD) Utility Contractors for Water Resources. Subsequently, on August 19, 2025, (17) proposals were received. An evaluation committee evaluated, scored and ranked each proposal. Prior awards for URD contractor agreements approved on September 28, 2021 (AI 3-j). Annual Underground Utility Contractors support and assist Engineering and Water Resources to provide specialized construction work within NSBU's water, wastewater and reclaimed water distribution systems' service territory; as well as, providing pipe, pump and other mechanical work at our Water and Wastewater facilities. This work includes new construction and repair/rehabilitation of existing infrastructure, for both planned and emergency needs.
Water Resources recommends awarding three annual service agreements, with extension option up to three additional one-year terms, to the top three ranked Contractors (with evaluation scores): Hazen Construction {92.08}; Driveways, Inc. {90.42}; and McMahan Construction, Inc. {87.92}
Issuance of three service agreements means NSBU can mobilize a contractor quickly with faster response times to emergency work and ensures planned projects are not delayed. Work orders will be created on an individual basis for all work assigned. Any projects totaling $100,000.00 or more will be submitted to NSBU Commission for ratification.
A motion to approve and award under RFP No. 15-25 the issuance of three annual URD Utility Contractor Service Agreements for Water Resources work to Hazen Construction, Driveways, Inc., and McMahan Construction, Inc., and authorize the General Manager/CEO or his designee to execute all documents associated with this award.
