WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7).
Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
4.) All decisions by the Administrative Review Board are final.

In the listing above, the "SU" designation means that rates listed under the identifier do not reflect collectively bargained wage and fringe benefit rates. Other designations indicate unions whose rates have been determined to be prevailing.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination

Questions Received from Industry
Please note that only answers provided via an amendment are the official answers to any questions.
No. QUESTION ANSWER 01 “Can proposals be hand delivered?” Yes, proposals can be hand delivered, but must be delivered by the deadline to Contract Specialist Darleen Masten at the address listed in Block 7 of the SF-1442, in Beltsville, Maryland. Proposals will not be accepted at the Arboretum. If hand delivering a proposal, please go to the rear loading dock of the George Washington Carver Center. Please be sure to give the delivery person the name of Darleen Masten at (301) 504-1183 so he/she can have the guard call Ms. Masten.
02 “Where can I purchase/pick-up copies of the drawings or specifications?”
The drawings and specifications are posted on FedBizOpps. Please print them out or save to a USB flash drive and have a local printing firm print them for you.
03 “My bonding company just sent me an email and wants to know which is the correct Solicitation number to put on the bond. Is it AG-3K15-S-09-0019A or AG-3K15-S-09- 0019? The solicitation package has the number without the letter at the end and on FBO.gov is has the letter at the end. They just want to be sure which number they are supposed to reference on our bid bond. I appreciate your help.”
The solicitation number is AG-3K15-S-09-0019.
04 Where will a contractor and his employees be allowed to park for the job?
There is parking at the loading dock of the Administration Building in the rear. If needed, there is additional parking by the New York Avenue entrance and contractors can car pool employees to the building. This area can also be used if needed for staging/storage. We do not want contractor employees parking in the visitors lot.
05 “Please advise if you have solar screens on this project.”
There are no existing, or proposed, solar panels at the Administration building. There are existing exterior vertical aluminum sun shades (on the south facing windows.) Amendment 02 added plans and specifications for interior window shades.
06 “What is the prospect for the use of geothermal systems in the renovation project? “
Geothermal systems are not part of the mechanical design.

“Reference section M.2 Criteria for Evaluating Proposals: the note at the bottom of the page reads "Newly established firms with no past experience shall receive a neutral score which reflects 50% of the possible points for Past Performance.”
“With no past experience, do newly established firms receive a neutral score for the Sub Factor "Experience" or no points?”
“Will the Government allow a bidder to submit project (with past performance evaluations ) under the $5M thresh hold?’
“If the answer to Question 2 is affirmative, will a score above "neutral" be possible for Sub Factors "Experience and Past Performance"?”
07A. The statement referenced doesn’t apply to Experience. It only applies to Past Performance.
Experience will be evaluated based on the criteria of Experience. See Section L.12, on page 65.
07B. Yes, but the proposal will be scored accordingly.
07C. The factors will be scored according to the submitted technical proposal and scored on the write up details. For Past Performance as stated "Newly established firms with no past experience shall receive a neutral score which reflects 50% of the possible points for Past Performance.”
08 “Regarding the above referenced solicitation, in an effort to demonstrate our relevant project experience for the technical proposal, may we also submit the experience of a teaming partner if we choose to pursue the project in that manner? Please advise.”
We do allow Joint Ventures (JV) & teaming agreements as long as the proper legal paperwork that establishes the JV/teaming agreement is in place. If it’s a teaming arrangement, you will need to provide paperwork as to who will be taking the lead, etc.
Please remember this is a 100% Total Small Business Set-Aside.
09 “Permit and Inspections have plans been submitted to DCRA for building permit? If not, will contractor make submission? This could be a very lengthy review process.

“After reviewing the scope of work and the solicitation package, I do have a question about the asbestos abatement needs. In the scope of work it clearly states the need for asbestos abatement.
1.) Did your office perform an asbestos inspection of the building and do you have a copy of the asbestos report? If so will you please post the inspection report to include the summary of findings, estimated qualities of materials and all other supporting documentation.
2.) Do you have an asbestos abatement specific specification to identify contractor requirements, responsibilities, and overall asbestos abatement procedures and testing requirements that your division would like for us to follow. If so may we please obtain a copy.”
10A. Yes, we had an Asbestos Survey performed. A copy of the Asbestos Report is attached. On page 3 of the report it states that specifications are attached. We did not attach them because they are already included in Section 13281N of the specifications. The summary of the findings, estimated qualities, etc., are also listed in Section 13281N of the specifications.
10B. See Section 13281N of the specifications.
