SECTION F - DELIVERIES OR PERFORMANCE

F.1 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (FAR 52.211-10)

(APR 1984)

The Contractor shall be required to (a) commence work under this contract within 14 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 420 days after receipt of Notice To Proceed. The time stated for completion shall include final cleanup of the premises.

F.2 LIQUIDATED DAMAGES – CONSTRUCTION (FAR 52.211-12) (SEPT 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $898.00 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

F.3 TIME EXTENSIONS (FAR 52.211-13) (SEPT 2000)

Time extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction. The change order granting the time extension may provide that the contract completion date will be extended only for those specific elements related to the changed work and that the remaining contract completion dates for all other portions of the work will not be altered. The change order also may provide an equitable readjustment of liquidated damages under the new completion schedule.

F.4 PERFORMANCE OF WORK BY THE CONTRACTOR (52.236-1) (APR 1984) ||

The Contractor shall perform on the site, and with its own organization, work equivalent to at least fifteen (15%) percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.

AG-3K15-S-09-0019 12

F.5 SUSPENSION OF WORK (FAR 52.242-14) (APR 1984) ||

(a) The Contracting Officer may order the contractor, in writing, to suspend, delay, or interrupt all or any part of the work of this contract for the period of time that the Contracting Officer determines appropriate for the convenience of the Government.

(b) If the performance of all or any part of the work is, for an unreasonable period of time, suspended, delayed, or interrupted (1) by an act of the Contracting Officer in the administration of this contract, or (2) by the Contracting Officer’s failure to act within the time specified in this contract (or within a reasonable time if not specified), an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) necessarily caused by the unreasonable suspension delay or interruption, and the contract modified in writing accordingly.

However, no adjustment shall be made under this clause for any suspension, delay, or interruption to the extent that performance would have been so suspended, delayed, or interrupted by any other cause, including the fault or negligence of the contractor, or for which an equitable adjustment is provided for or excluded under any other term or condition of this contract.

(c) A claim under this clause shall not be allowed-

(1) For any costs incurred more than 20 days before the contractor shall have notified the Contracting Officer in writing of the act or failure to act involved (but this requirement shall not apply as to a claim resulting from a suspension order); and

(2) Unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the suspension, delay, or interruption, but not later than the date of final payment under the contract.

F.6 PERFORMANCE TIME ||

The period of performance is 420 calendar days, including options, after receipt of Notice To || Proceed (NTP). This includes time for the construction contractor to order and install leased trailers and to move staff out of the building.

F.7 EXERCISE OF OPTIONAL ITEMS ||

The time to exercise any of the optional items will be within 120 days from date of contract award.

AG-3K15-S-09-0019 17

G.6 POST AWARD EVALUATION OF CONTRACTOR PERFORMANCE (AGAR ADVISORY

NO. 88c) ||

(a) Contractor Performance Evaluations

Interim and final evaluations of contractor performance will be prepared on this contract in accordance with FAR 42.15 (or FAR 36.201 for construction, or FAR 36.604 for Architect Engineering). The final performance evaluations will be prepared at the time of completion of work.

Interim and final evaluations will be provided to the contractor as soon as practicable after completion of the evaluation. The Contractor can elect to review the evaluation and submit additional information or a rebuttal statement. The contractor will be permitted thirty days to respond. Contractor response is voluntary and is not mandatory. Any disagreement between the parties regarding an evaluation will be referred to an individual one level above the Contracting Officer, whose decision is final.

Copies of the evaluations, contractor responses, and review comments, if any, will be retained as part of the contract file, and may be used to support future award decisions.

(b) Electronic Access to Contractor Performance Evaluations

FAR 42.15 (or FAR 36.201 for construction, or FAR 36.604 for architect engineering) require agencies to prepare interim and final evaluations of contractor performance. The U.S. Department of Agriculture utilizes the National Institutes of Health (NIH) Contractor Performance System (CPS) to record and maintain past performance information. The CPS module for architect engineer contracts is not yet available, therefore the following information regarding electronic access does not apply to architect engineer contracts.

Contractors that have Internet capability may access evaluations through a secure Web site for review and comment by completing the registration form that can be obtained at the following URL:

http://oamp.od.nih.gov/OD/CPS/cps_contractor.htm

The registration process requires the contractor to identify an individual that will serve as a primary contact and who will be authorized access to the evaluation for review and comment. In addition, the contractor will be required to identify a secondary contact who will be responsible for notifying the cognizant contracting official in the event the primary contact is unavailable to process the evaluation within the required 30 day time period. Once the contractor is registered and a performance evaluation has been prepared and is ready for comment, the CPS will send an email to the contractor representative notifying that individual that a performance evaluation is electronically available for review and comment.

“Reference section M.2 Criteria for Evaluating Proposals: the note at the bottom of the page reads "Newly established firms with no past experience shall receive a neutral score which reflects 50% of the possible points for Past Performance.”

“With no past experience, do newly established firms receive a neutral score for the Sub Factor "Experience" or no points?”

“Will the Government allow a bidder to submit project (with past performance evaluations ) under the $5M threshhold?’

“If the answer to Question 2 is affirmative, will a score above "neutral" be possible for Sub Factors "Experience and Past Performance"?”

07A. The statement referenced doesn’t apply to Experience. It only applies to Past Performance.

Experience will be evaluated based on the criteria of Experience. See Section L.12, on page 65.

07B. Yes, but the proposal will be scored accordingly.

“After reviewing the scope of work and the solicitation package, I do have a question about the asbestos abatement needs. In the scope of work it clearly states the need for asbestos abatement.

1.) Did your office perform an asbestos inspection of the building and do you have a copy of the asbestos report? If so will you please post the inspection report to include the summary of findings, estimated qualities of materials and all other supporting documentation.

2.) Do you have an asbestos abatement specific specification to identify contractor requirements, responsibilities, and overall asbestos abatement procedures and testing requirements that your division would like for us to follow. If so may we please obtain a copy.”

1.) Yes, we had an Asbestos Survey performed. A copy of the Asbestos Report is attached. On page 3 of the report it states that specifications are attached.

We did not attach them because they are already included in Section 13281N of the specifications.

The summary of the findings, estimated qualities, etc., are also listed in Section 13281N of the specifications.

2.) See Section 13281N of the specifications.

“I have a few questions regarding Option #2- Clean the exterior of the building and caulk as required.

1. What is the quantity of sealant (caulk) we should bid on removing and replacing. ("As required" is to general of a term to identify a quantity). If quantity is unknown, is there a base lineal footage that can be used so all bidders are

80B

80E quoting the same quantities. With this, we could also include a unit (l/f) price.

2. There are no specs for the "cleaning" of the building. Please provide full specs. Are the soffits included in the scope for cleaning?

3. Will the water be drained, plants and fish relocated from the mote areas? (This will aid in setting rolling scaffold towers/ladders etc..to perform the cleaning and sealant work)It will be very difficult to keep the cleaning product and water from entering the mote areas. If this is to be a hot water wash down only, will the hot water be allowed to enter the mote areas? If the mote areas are not drained and scaffold/ladders etc.. are not permitted in the drained mote areas, options for accessing these walls is very limited. A boom lift required to reach the walls would be large and its dimensions and weight may not permit its use. (Load rating of existing sidewalks if not on grade or the close proximity to the mote edge.

4. There are plants that are attached to the exterior wall either by themselves or by existing mechanical fasteners. Will the Arborist from the Arboretum be removing the plants and securing away from the wall so cleaning and sealant work can be performed. We would cover the plantings (poly sheeting) prior to any work being started.

5. Will the cleaning/wash-down water be allowed to drain into the soil at the area(s) of existing plantings?”
