Amendment No. 0001

Question and Answer

Q1) The Technical Service Provider Certification requires the TSP to attest that the projects being inspected “1. Comply with all applicable Federal, State, Tribal, and Local laws and requirements.”

This is a tremendously broad certification of which I cannot imagine how anyone can with a reasonable effort and investigation, defensibly attest. As an example, the proposed project involves modification/installation of changes in the electrical fixtures and controls in quite a number of buildings. Requirements exist broadly that all electrical fixtures and installations in facilities such as those involved in this project comply with specific requirements of the National Electrical Code with respect to system design, components sizing and features, materials and methods of construction and installation, etc., but there generally is no electrical code or other system of regimented jurisdictional inspection for same in any rural county. Is the selected TSP expected/required to perform adequate electrical inspection to assure compliance with the National Electrical Code?

A1) Please see revised Exhibit 5, which removes this part of the certification. Please note that the three Counties in Missouri, Newton, Barry and McDonald, where this work is to take place have no code requirements or enforcement authority.
