About this file

This is Addendum Two to RFP 758 1900000181, containing the Commonwealth of Kentucky Department of Corrections' (KYDOC) written responses to vendor questions regarding an Inmate Communications system procurement. The RFP encompasses inmate telephone services (ITS), video visitation services (VVS), video remote interpretation (VRI), video relay services (VRS), tablets, and associated infrastructure across 15 KYDOC facilities. The procurement does not include a pre-bid meeting or site visits, though vendors may reference prior facility specifications in Attachment G. No follow-up rounds of questioning are permitted. The KYDOC does not have a specific procurement timeline, though implementation requirements are detailed in Attachment A Section 50.36. The sole point of contact during procurement is Kathy Robinson at kathy.robinson@ky.gov, with technical project management details to be provided upon contract award.

The vendor shall be responsible for all costs associated with VRS and VRI services, including establishing business arrangements with VRI providers to ensure no ongoing costs to KYDOC. Minimum Annual Guarantee (MAG) amounts are subject to renegotiation based on changes in call volume or required calling rates, with adjustments to be negotiated accordingly. Gross Revenue is defined in Section 50.10.g with specific exclusions outlined, and sales tax is included but not commissionable. The incumbent systems include ITS, VVS, and tablets from undisclosed vendors; bidders are instructed to propose their best solutions regardless of current providers. Approximately 2-3% of the inmate population is indigent. VRI usage data from August 2018 through January 2019 ranges from 201 to 610 minutes monthly, and the Commonwealth currently uses LexisNexis for law library services. On-site call recording storage shall be provided by the vendor upon request at vendor expense, separate from the three-location requirement for CDRs and recordings.

a. We respectfully request the Commonwealth provide specific conditions and performance levels under which they may request an adjustment in the MAG amount.

b. If a situation outside a vendor's control occurs and it is unable to meet the MAG, does this automatically constitute a breach? As specified in this section, adjustments to the MAG will be negotiated based on any increases or decrease in call volume or required calling rates.

12 Section 50.10.c ITS Revenue Share, Payment and Reporting - and others regarding definition of Gross Revenue. Attachment A - RFP Page # 25 The definition of Gross Revenue for all services includes "any other compensation received..." which could be interpreted as encompassing transaction cost recovery fees. 18Section 60.7.h.ix Proposed Solution Content, ITS Monitoring and Recording RequirementsAttachment A - RFPPage # 70Asks vendors to describe their process for providing on-site storage of all call recordings. Since this is non-standard we ask the following for clarity:

a. Does the DOC intend on-site storage to mean recordings from each facility are stored at each facility, or all KYDOC recordings in a single DOC location?

19Section 50.12.jAttachment AN/AThe vendor respectfully asks the State to supply us with the contact information for the KOMS provider Marquis. This information will be provided to the successful Vendor.
20Section 50.14.dd.iAttachment A36Would the KYDOC consider removing the VRI portion of the requirement? VRI is a replacement for a standard face-to-face onsite interpreter and not the same as VRS nor a method of inmate communications per the requirement of this RFP. Additionally, since the State is asking vendors to assume the costs for VRI service with unknown usage, vendors would not be able to estimate the cost implications of offering this service. As an alternative, we suggest the State continue their contract with Purple for VRI and allow the vendors to provide the hardware for the VRI.No, the requirement will remain unchanged. Refer to the answer provided in question #14 for usage.
21Section 50.14.dd.iAttachment A36The vendor respectfully asks would the KYDOC allow the vendor to offer a tablet/tablet kiosk device for use in responding to the KYDOC requirement for VRS and VRI in place of a laptop? No, the laptop is KYDOC's preferred mobile method for VRS/VRI. This requirment will remain unchanged.
22Section 50.14.dd.iiAttachment A36The vendor respectfully asks would the KYDOC allow the vendor to offer a tablet/tablet kiosk device for use in responding to the KYDOC requirement for VRS and VRI in place of a laptop? 23Section 50.24.eAttachment A45With the SSN of a person being protected as Personally Identifiable Information and the potential issues with visitor/public disclosing this information would the State consider removing item iv, social security number, from this requirement? No. This requirement shall remain unchanged.
24Section 50.29.eAttachment A50Would the KYDOC please specify how many headsets designed for hearing impaired inmates are required? The number of headsets cannot be known until after the VRS/VRI units are installed. However, if a number must be provided, we estimate 15.
25Section 50.30.cAttachment A51Would the State allow vendors to offer an alternative inmate to tablet ratio? No. This requirement shall remain unchanged.
26Section 50.38.d.iAttachment A57Would the State please clarify that the infrastructure and network at these facilities is now in place and that this requirement is incorrect? The infrastructure and network at the listed facilities is not currently in place. In addition, Would the KYDOC consider removing the VRI portion of the requirement? VRI is a replacement for a standard face-to-face onsite interpreter and not the same as VRS nor a method of inmate communications per the requirement of this RFP.Refer to the answers provided in questions #20, #21 and #22.
28Attachment JAttachment JOn attachment J it states that Attachment O must be submitted with the Technical Proposal. We did not receive an attachment O. Could this be clarified?Attachment J has been updated to state "Attachment J must be submitted with the Technical Proposal"

Can parameters be set to govern the potential MAG adjustments?Refer to the answer provided in question #11.
31Section 50.14.ddRFP35RFP states the vendor is responsible for any cost associated with VRS and VRI…does this include only the initial upfront costs?

Does the KY DOC require the vendor to pay the per minute session costs to the VRI provider or will KY DOC pay for the actual sessions? How many annual VRI sessions does the KY DOC expect? Refer to Section 50.14. dd. Vendor is responsible for all costs associated with this requirement.

Vendor will be responsible for establishing a business arrangement with the VRI provider to ensure there is not an ongoing cost to KYDOC.

Refer to the answer provided in question #14.

32 Section 50.20 RFP 41 Will sales tax be charged in addition to the session price?

Also, is that sales tax commissionable / subject to revenue share? The applicability of sales tax will differ depending upon how the vendor charges for a video visitation session (each vendor is different). For example, if the visit is paid via a pre-paid account, sales tax would not apply. However, if a video visitation session is paid by visit, then, sales tax may apply. The vendor should specify it’s process.

If applicable, sales tax shall be included in the Gross Revenue; however, it is not commissionable.

KYDOC and Vendor may mutually negotiate any changes to the financial terms; however, Vendor shall not modify any financial terms without written approval from KYDOC. Refer to Section 40.8.

35Section 60.8RFP80Section 60.8 states “Vendor should complete the following certified statement and submit it with the Cost Proposal.” We do not see a subsequent statement. Could this be clarified?Section 60.8 has been revised to remove the reference to a certified statement.
36Section 50.23, paragraph eAttachment A44As it relates to VVS Specifications, it is stated that vendor shall supply (1) monitoring workstation for each facility. Is this workstation in addition to the required workstations identified in Attachment G – Facility Specifications? No, the workstation required in Section 50.23.e. is included in the total workstations listed in Attachment G-Facility Specifications.
37Section 50.39, paragraph a, vAttachment A58Do the Inmate PIN’s currently utilize alphanumeric characters? If not, where are the alphanumeric characters mentioned coming from that would need to be stripped? No, currently the inmate PINs do not contain alphanumberic characters.
