About this file
This is an addendum to FAR 52.212-2 establishing the basis for award for Solicitation W911RX26QA047, a forestry mulcher procurement issued by the Department of the Army Materiel Command Mission and Installation Contracting Command Fort Hood for use at Fort Riley. Prospective offerors must comply with the terms established in this addendum alongside the salient characteristics document and main solicitation to be eligible for award consideration. Interested vendors should direct all inquiries to Contract Specialist Noah Younger at noah.w.younger.civ@army.mil and submit completed proposals and required attachments to the same point of contact.

Addendum to The clause at FAR 52.212-2, Evaluation – Commercial Items, applies to this acquisition and is amended as follows.
1. Basis for Contract Award: The basis of which this contract will be awarded will be price and technical capability, in accordance with Federal Acquisition Regulation (FAR) Parts 12, 13, procedure. By submission of this offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications.
a. The Government will award a contract resulting from this solicitation to the responsible offeror, whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
b. The Government will determine Best-Value using the Lowest Price Technically Acceptable method. Best-Value will be assigned to that offer which presents the lowest price amongst the offers which meet all Technical Acceptability criteria.
c. The following factors will be used to evaluate offers. The factors are Price and Technical Capability.
i) The contract resulting from this solicitation will be awarded to that responsible offeror (in accordance with FAR 9.104) whose offer conforms to the RFQ and is determined to provide the best value to the Government.
ii) Technical capability will be evaluated on an Acceptable/Unacceptable basis; only an offeror rated as “Acceptable” in all elements of their technical proposal as outline in FAR addendum 52.212-1 Instructions to offeror, section L, will be considered for award.
iii) Technical acceptability is as important as price as per RFO 13.203.
2. The government will evaluate based on these criteria:
Price Evaluation:
i) Price will not be scored.
ii) Evaluation of price will be performed using one or more of the proposal analysis techniques in RFO 13.203. Unbalanced pricing will be evaluated IAW RFO 13.203, as applicable, to assess potential performance risk. Through these techniques, the Government will determine whether prices are reasonable, complete, and balanced. The price evaluation will document the fairness and reasonableness of each element outlined in the pricing matrix using the FAR Part 13 techniques above.
iii) The government reserves the right to perform price realism analysis.
Technical Capability. The Government will evaluate technical proposals on a Pass/fail basis and assign an Acceptable or Unacceptable rating as described in Table A1.
Table A-1. Technical Acceptable/Unacceptable Ratings
Adjectival Rating
Description
Acceptable
Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable
Proposal does not clearly meet the minimum requirements of the solicitation.
i) Technical Acceptability includes subfactor 1) Conformance with desired Salient Characteristics. In order to be considered eligible for award, offerors must fill out, sign, and submit the attachment ‘Salient Characteristics Sheet’. Offers which do not meet or exceed the characteristics detailed therein will not be considered eligible for award.
ii) Technical Acceptability includes subfactor 2) no gray-market products. The government will not accept any quote which offers a used or ‘gray market’ product. All offers, in order to be considered eligible for award, must be of new, never before used product.
iii) Technical Acceptability includes subfactor 3) Timeliness of delivery schedule. The government requires that the product be delivered within the time period detailed on document ‘ Solicitation – W911RX26QA047’. Offers which fail to meet this timeframe will not be considered eligible for award.
