About this file

This document is an Addendum (No. Seven) for the Upper Guide Wall Repairs Project issued by the Commonwealth of Kentucky's Department for Facilities and Support Services, Division of Engineering and Contract Administration for Kentucky River Locks 2 & 3 located in Henry County. The project involves repairs to the upper guide walls at two lock locations, with the bid opportunity (RFB-235-25) dated July 18, 2025. The addendum provides detailed responses to 13 contractor questions covering various project aspects, including construction sequencing, permitting requirements, utility management, and site-specific technical details. The cutoff date for formal questions is set for Noon (EDT) on Wednesday, July 23, 2025.

Key additional project details include confirmation that this is not a prevailing wage or tax-exempt project, and the contractor is not required to maintain river traffic through the locks during construction, though the owner requests supporting lockages when possible. The project involves complex infrastructure work including sheet piling, concrete placement, and guide wall repairs, with specific technical instructions for material placement, utility protection, and permit management. The contractor will be responsible for securing necessary permits, including a KPDES Notice of Intent and Termination, and coordinating with various agencies like USGS for utility management. Material cost fluctuations will not have additional provisions or escalation clauses, and the contractor may purchase and invoice for stored materials to mitigate some financial risks.

RFB – 235-25

Item 1: Questions and answers listed below:

Question 1: Addendum 4 mentions different completion dates for locks 2 and 3. Construction Sequence Note 1 on sheet A04 of the plans mentions work can proceed concurrently at Locks 2 and 3. Is this still the case? A01 – A10

Response: Work may be performed concurrently at Locks 2 and 3 in accordance with the Plans for Construction and the Technical Specifications.

Question 2: Is this project tax exempt?

Response: The project is NOT tax exempt.

Question 3. In light of the ongoing volatility in material costs due to tariffs and trade regulations, can you clarify how tariffs will be handled for this project? Specifically, will there be any provisions, such as allowances or escalation clauses, to ensure a fair and level playing field for all bidders in the event of tariff-related price fluctuations after bid submission?

Response: No provisions, allowances, or escalation clauses will be added to the Contract. To help mitigate some of the risk associated with material escalation, the Contractor may purchase all required materials required for Locks 2 and 3 and invoice for stored materials.

Question 4: What permits will be required to be purchased by the contractor for this project?

Response: In accordance with Section 313211 Erosion Control, Paragraph 1.4.3 and 1.4.4 and Drawing A03, Note 2 under Permitting, prior to construction, the Contractor shall prepare and submit a KPDES Notice of Intent (NOI) form and any additional supporting documentation to the Kentucky Division of Water (KDOW) in accordance with their instructions and schedule requirements. The Contractor shall coordinate with the KDOW to determine if one NOI can be submitted for each site or if one NOI can be submitted for both sites. The NOI form and instructions can be obtained at www.water.ky.gov. The Engineer shall be provided with a courtesy copy of the completed NOI form within 48 hours of submission to KDOW.

KPDES Notice of Termination (NOT) - At the appropriate time, the Contractor shall prepare and submit a KPDES NOT form, along with any supporting documentation, to the Kentucky Division of Water (KDOW) in accordance with their instructions and schedule requirements. The Contractor shall coordinate with the KDOW to determine if one NOT can be submitted for each site or if one NOT can be submitted for both sites. The NOT form and instructions can be obtained at www.water.ky.gov. The Engineer shall be provided with a courtesy copy of the completed NOT form within 48 hours of submission to KDOW.

In accordance with all applicable laws and ordinances, the contractor shall identify, secure, and permit (if necessary) suitable off-site disposal site(s) for dredged, excavated, or demolished materials. Refer to Permitting Note No. 3 on Drawing A03 for additional information.

Question 5: Section 024100 Part 3.1.4 mentions “The CONTRACTOR shall dispose of demolished material and debris in an ENGINEER-accepted off-site location.” Are the timber pilings considered contaminated? Can an acceptable location be provided?

Response: It is not suspected that the timber pilings are contaminated. The Contractor is responsible for securing and disposal of demolished material and debris including the timber piling via appropriate means and methods.

Question 6: The Dam Construction Permit (Renewal)s on page 284 and 288 of the RFB expires August 2, 2025. Who is responsible for renewing these?

Response: The Owner is responsible for renewing the Dam Construction Permit. Permit is attached.

Question 7: Is this a prevailing wage project?

Response: No, this is not a prevailing wage project.

Question 8: What is the cutoff date for questions?

Response: Formal questions shall be submitted by Noon (EDT) on Wednesday, July 23, 2025.

Question 9: Can section 401, section 404, and the flood plain construction permit be provided?

Response: The following permits are attached, Section 401, Section 404, and the Dam Construction Permit.

Question 10: For the sheet piling at lock 2, detail 1 on sheet B04 indicates #57 backfill up to the waterline, then concrete up to elev 448.8’. Is this just for the piles against the Lock Land Wall or will this apply to all PZC26 sheet piles?

Response: This detail only applies to the sheet pile belly against the Lock Land Wall. No. 57 stone backfill shall be placed up to the waterline then concrete placed to elevation 448.8 feet within the sheet pile belly against the Lock Land Wall. Following concrete placement to elevation 448.8 feet within the sheet pile belly, the sheet shall be cut flush the top of concrete and capped with the concrete sidewalk.

See detail below for clarification. All areas outside of this sheet pile belly, shall be placed as shown on Drawings B06 – B08.

Question 11: The Historical Drawings for Lock #2 show details for the guide walls starting at Buttress No.

1, but do not show any details for the guide wall between Buttress No. 1 and the upper end of the lock wall (140.7’ ). Can details regarding the existing guide wall between buttress No. 1 and the Upper end of lock wall be provided? Are there existing buttresses behind this 140.7’ of guide wall?

Response: The cross sections available to understand the composition of the Upper Guide Wall between the buttresses and lock wall is shown as "Section of Old Crib" on Drawing D07.

Drawing D07 indicates that the buttresses were only installed on the upper 150-ft of the guide wall with buttresses 6 through 9 being demolished in 1980 as shown on Drawing D12.

Question 12: Both sites show existing underground electric apparently feeding assumed river monitor gauges. Please clarify how this will be addressed- contractor responsibility to remove/provide new? If this is contractor responsibility, can these be taken offline until completion of work and then new/reinstallation take place?

Response: The underground lines for the headwater gauges are owned and maintained by USGS.

These lines have been relocated ahead of construction by USGS to better accommodate construction activities. Some equipment associated with the headwater gauges has been left in-place at its’ previous location for the time being. The Contractor shall coordinate with USGS prior to starting excavation at each site. The approximate location of the relocated lines are shown below. In accordance with Section 024100, Paragraph 1.10.4, the USGS Concrete Pad and Platform at Lock 2 shall remain undisturbed during construction. Furthermore, in accordance with Section 024100, Section 1.10.6, the Contractor shall maintain existing utilities to stay in service and protect utilities against damage during excavation and demolition operations.

Lock 2

Lock 3

Question 13: Please confirm/clarify river traffic during construction. Will the contractor be required to allow river traffic to pass through the locks at all times? Can data be provided for estimated watercrafts?

Response: The Contractor is not required to maintain traffic through the lock during construction. The Owner has requested the Contractor support lockages if possible provided the lockages do not adversely impact the Contractor’s schedule and can safely be performed. This also applies to the Rockin’ Thunder Adventure dates listed in the Special Conditions (Article 4).
