About this file
This document is an Addendum (No. Eight) for an Invitation to Bid (RFB-235-25) issued by the Commonwealth of Kentucky's Department for Facilities and Support Services, Division of Engineering and Contract Administration, for the Upper Guide Wall Repairs Project at Kentucky River Locks 2 & 3 in Henry County, Kentucky. The project is associated with the Kentucky River Authority and is scheduled for bid on July 27, 2025, with a specific focus on repairs to the upper guide walls of the river locks.
The addendum primarily addresses a detailed question and response regarding project scheduling and liquidated damages, specifically addressing potential delays caused by weather and flooding. Key clarifications include that the contractor is not prohibited from working outside the designated "construction season" (July 1 - November 30), but project adjustments will not be accepted for high-water conditions during off-season periods. The owner will only consider schedule extensions for high water events during the construction season, and liquidated damages will accrue if substantial completion is not achieved by the established, adjusted completion date. The contractor remains responsible for protecting and securing the site at all times, regardless of the construction season.

ADDENDUM NO. Eight (8)
Date: July 25, 2025
RFB – 235-25
Item 1: Question and answer listed below:
Question 1: If weather and flooding delays cause the contractor’s schedules to push outside of
“construction season” (July 1 – November 30) prohibiting the contractor from starting work again until the following July 1st date, will liquidated damages be charged for the days in between or will the construction schedule be paused?
Response: No. Liquidated damages will be computed based only on the established, adjusted
Substantial Completion date. Liquidated damages are not tied to the “construction seasons” as specified.
For clarity:
• The Contractor is not prohibited from working outside the specified dates of the Construction Season. Work is allowed December 1 through June 30, although project adjustments will not be accepted for high-water conditions during this time.
• The Owner will not consider adjustments to the Contract Price based on river levels, regardless of dates (Refer to Article 4, Temporary Shutdowns/Elevated Water Levels of the Special Conditions).
• If the Work is delayed, only an extension in time will be granted. No adjustments to the Contract Price will be considered for the General Conditions.
• Requests for schedule extensions shall adhere to the requirements outlined in Article 16 of the General Conditions and the Special Conditions - Temporary Shutdowns/Elevated Water Levels.
• Schedule extensions due to high river levels will be considered by the Owner ONLY for high water events that occur during the Construction Seasons (July 1 – November 30 annually).
• Liquidated damages will accrue only if substantial completion is not achieved by the established, adjusted date for completion, regardless of the dates.
• To avoid assessments of Liquidated Damages outside of the Construction Season, the Owner intends to establish a Completion Date between July 1 and November 30.
• The Contractor is responsible for protecting and securing the site(s) at all times, including dates outside the Construction Season (Refer to Article 14.3, Construction Sequence of the Special Conditions).
