About this file
This is Addendum #3 to Bid Invitation 2892-24 issued by the State of New Hampshire Division of Procurement and Support Services Bureau of Purchase and Property for B-20 with B-5 Option Biodiesel Fuel Supply and Delivery. The addendum addresses six bidder questions and clarifications regarding fuel specifications, testing procedures, delivery requirements, and pricing methodologies. Key clarifications include confirmation that the state will conduct independent third-party laboratory testing if concerned about product compliance with the -5 degrees F cloud point specification for winter months (12/2 to 3/31), and that no waivers have been granted for vendors unable to meet specifications. The addendum modifies the spills and overfills language on Page 11, Item #5 to clarify that vendor liability applies only to the extent caused by acts or omissions of the vendor's employees or agents. Additionally, the addendum provides photographic examples of delivery tickets, terminal bills of lading, and fuel order forms to guide vendor compliance. The bid closing date is April 24, 2024, at 10:00 AM.
The addendum resolves critical pricing methodology questions by clarifying that OPIS rack pricing for non-winter months will utilize LSN2P Ultra pricing, while winter blend months will use ULS2P WNT pricing. This response addresses bidder concerns regarding gaps in OPIS historical data availability from April to October, ensuring vendors understand which pricing index applies during months when ULS2P pricing is not published. All changes noted in this addendum supersede previously submitted bid documents, and vendors must acknowledge receipt and include this addendum with their bid submissions. The addendum maintains all other specifications from the original solicitation without modification.
