STATE OF MICHIGAN Date Issued: January 17, 2018 Department of Technology, Management and Budget Index No(s): 44301 State Facilities Administration File No: 761/15266.SAR 3111 W. St. Joseph Street Department: Environmental Quality Lansing, Michigan 48917 Project Name: Chuck’s Corner Site Marion, MI Subject: Addendum to Bidding Documents

Bid Opening Date: January 24, 2018

ADDENDUM NO. 2

TO: All Bidders

SUBJECT: Addendum to Bidding Documents Chuck’s Corner Site Marion, MI

INTENT: This Addendum is issued to modify the previously issued Bidding Documents.

Item 1 – Answers to Questions: Several questions were posed by Bidders. Please refer to Attachment A for the questions and answers.

Item 2 – Of the Drawings, Sheet 3 – Surface Restoration Details has been revised. Sheet 3 now identifies the entire concrete surface over the gasoline UST will be replaced since it is expected to be removed during the selective demolition portion of the Work and in order to complete site restoration activities. Additionally, Sheet 3 now identifies pulverized/recycled asphalt will be replaced as surface cover over the area southeast of the concrete. These revised surface areas are identified in the Legend on Sheet 3.

Item 3 – The Bid Schedule has been revised and is attached. The bid quantity for Base Bid Item No. 5 “Transportation and Recycling/Disposal of Asphalt and Concrete” was increased to 255 tons in order to account for the removal changes made on Sheet 3. Additionally, the Base Bid Item No. 15 “Provisionary Allowance for Unforeseen Site Conditions” was increased to $40,000.00.

Accordingly, the following references in the specifications are modified as follows:

• Section 01020 Allowances, Article 1.2 Provisional/Contingency Allowances, Item (a) shall be modified as follows:

Bidders must include in their Base Proposal Sum a contingency allowance of $40,000.00. The base bid shall include bonds and insurance on the value of the allowance.

• Section 01025 Measurement and Payment, Article 3 Description of Pay Items, Item No.

15 - Provisionary Allowance for Unforeseen Site Conditions shall be modified as follows:

Bidder must include in their Base Proposal Sum a provisionary allowance of $40,000.00. The base bid shall include bonds and insurance on the value of the allowance. Monies will be used in the contingency allowance only if directed in writing by the Project Director and the Professional. Payments under a Provisionary Allowance will include not only the purchase/furnished cost of the materials and equipment involved, but also all related labor costs, subcontract costs, construction equipment costs, general conditions cost and fee, provided they are calculated in accordance with the requirements of the contract documents. Unused allowances will be deducted from the contract amount through contract change order.

Item 4 – Section 024113 Selective Demolition, Article 1.1, Item (b) shall be modified as follows: Saw cut and remove concrete and/or asphalt, as necessary, in order to remove underground storage tank (UST) piping between the 12,000 gallon gasoline UST and the two gasoline dispensers. It is anticipated that all concrete will be removed from the surface above the gasoline UST and between the UST and the vent lines. The UST Owner is responsible for ensuring the gasoline UST is 100% full prior to the removal of the concrete surface cover above the UST in order to prevent the UST from potentially rising due to the presence of groundwater.

Item 5 – Section 026100 Removal and Disposal of Impacted Soil, Article 1.1, Item (h) shall be modifed as follows: Removal and disposal/recycling of existing asphalt and concrete materials, as required. Quantity is estimated to be approximately 255 tons of asphalt and/or concrete materials.

Item 6 – Section 312323 Backfill, Article 1.3, Item (a) has been deleted.

Item 7 – Section 312500 Erosion and Sedimentation Control, Article 3.1, Item (a), Subitem (i) has been modified as follows: Drainage: The Contractor shall construct and maintain any necessary surface drainage systems on the Work site so as to prevent water from entering existing structures, flowing into the excavation or the UST cavity, or flowing onto public or private property adjacent to the site. The Contractor shall prevent erosion of soils and blockage of any existing drainage system, such as storm sewers. The related costs are incidental to the project.

Item 8 – Section 329119 Site Restoration has been modified and is attached.

Item 9 – Section 01025 Measurement and Payment, Article 3 Description of Pay Items, Item No. 12 – Site Restoration has been modified as follows: Payment shall be made on the basis of a lump sum which shall be full compensation to restore the site to pre-work conditions by providing final site grading, asphalt placement, concrete placement, gravel placement, pulverized/recycled asphalt placement, and topsoil and seeding. The site shall be graded to promote runoff and prevent ponding or flooding on the site.

ACKNOWLEDGEMENT: This Addendum must be acknowledged by the bidder in the space provided in the Bid Summary Form submitted with the bidder's bid for submission of a valid bid. The changes and information shall become part of the contract documents. (Authority: 1984 PA 431)

ANSWERS TO QUESTIONS

Q: At the pre-bid meeting, the property owner indicated a preference for using crushed asphalt instead of gravel. Is this going to be added as an alternate bid item and would it be applicable to all areas noted as "gravel" on Sheet 3?

A: Sheet 3 (Surface Restoration Details) has been revised to replace pulverized/recycled asphalt in the area southeast of the concrete. Section 329119 (Site Restoration) has also been revised to reflect this surface restoration change. The Bid Schedule was not affected by this surface restoration change since the Base Bid Item No. 12 is a Lump Sum item for “Site Restoration”.

Q: In section 312323 (1.3 (a)) of the PSM, it states the contractor shall use stockpiled materials deemed suitable as backfill and if not used the soil shall be removed from the site. With storing the canopy components on site, maintaining access for customers to the store and getting trucks in and out of the site, there is not a lot of extra space available on the site. Is this requirement still applicable or can it be reconsidered?

A: The Owner and Professional do not intend to stockpile any native soils for placement as backfill; all excavated soils will be removed from the site. Accordingly, Section 312323 (Backfill) has been revised to reflect this intent.

Q: With an indeterminate date for when the frost laws will be lifted, the window for completing the work on the project to meet the deadlines (5/11/18 for fuel dispensing and 5/18/18 for M-115 to be reopened) is likewise indeterminate. With that said, extra hours may be required (i.e. weekends, longer hours during the week, etc.) to complete the project. So this is not so much a question, but rather something that may have to be considered and addressed dependent upon when we can actually start the project.

Q: Additionally, another inquiry was received which reiterates project schedule concerns without asking a specific question.

A: The Owner is aware of the issues raised regarding timing and frost laws. For bidding purposes, please assume that the frost laws will not be an issue and that the current schedule will be met. If site conditions change and the Owner and Professional agree, the Provisionary Allowance may be accessed to address cost differentials. Final pavement dates will be as stated in the original Bidding and Contract Document.
