Summary of Addenda No. 2 to the RFP for US 101 & SE 40th Street Traffic Signal Design-Build Project
This document is Addenda No. 2 issued by the City of Newport, Oregon, regarding the US 101 & SE 40th Street Traffic Signal Design-Build Project. The addendum provides clarifications and responses to bidder questions regarding project requirements and contract terms. Key clarifications include confirmation that ODOT requirements apply and the Design-Builder will be responsible for design coordination with ODOT; this is a traditional design-build project, not progressive design-build. The City provided exhibit references for lighting as-built drawings and ADA requirements, clarified that utility coordination records from the SE 35th Street signal project are unavailable as the work was ODOT-managed, and indicated that directional drilling may be required in recently paved areas. A bid bond is not required for this project delivery method. Email submissions are acceptable for proposal delivery. The addendum also clarifies that ADA ramps are required on the east side of US 101, with acceptable pedestrian AC landing examples provided for the west side.
The addendum makes substantial modifications to the EJCDC Form 520 Agreement and EJCDC Form D-800 Supplementary Conditions to incorporate comprehensive statutory requirements under Oregon Revised Statutes. Notable additions include mandatory contract dispute resolution provisions, extensive certification requirements regarding Design-Builder authority and qualifications, discrimination prohibitions, tax compliance obligations, and federal funds certifications including Excluded Parties List verification. The addendum mandates employee drug testing programs, establishes detailed payment obligations to subcontractors with 10-day payment requirements, specifies interest penalty provisions, overtime compensation requirements, prevailing wage compliance, public works bond filing requirements with the Construction Contractors Board, and workers' compensation obligations. These statutory additions address labor protections, prevailing wage considerations, prompt payment requirements, and public contracting compliance under Oregon law.
