About this file
This Addendum No. 1 is issued by the City of Newport, Oregon, and the Oregon Department of Transportation (ODOT) for the US 101 & SE 40th Street Traffic Signal Design-Build Project. The addendum provides critical clarifications and conditions for the design and construction of a traffic signal at the specified intersection. It incorporates an ODOT Interoffice Memo dated October 23, 2025, which approves the traffic signal installation with specific operational and design requirements. Key conditions include designing the signal according to current ODOT Traffic Signal Policy and Guidelines, establishing lane configuration and phasing per a Preliminary Signal Operations Design signed by the Region Traffic Signal Operations Engineer, closing or relocating the approach opposite SE 40th Street prior to signal activation, following ODOT's ADA design standards, obtaining Traffic Engineering Section approval of final design plans, and completing construction within five years of the memo's signature date to maintain approval validity.
The addendum establishes an estimated cost for design and construction services of $3,365,000, as documented in Exhibit A, the Intersection Control Evaluation dated November 26, 2024, prepared by Lancaster Mobley. All design and construction work must comply with the current edition of ODOT's Traffic Signal Design Manual, ODOT's Traffic Signal Policy and Guidelines, and the applicable Manual on Uniform Traffic Control Devices (MUTCD) edition in effect when the signal is installed or reconstructed. The approval is conditional and subject to rescission if construction does not proceed within the five-year timeframe, establishing a critical deadline for project advancement and contract execution.

FROM:
State Traffic Engineer
SUBJECT: Request for New Traffic Signal Oregon Coast Highway (US-101) at SE 40th St.
City of Newport
I have reviewed your request to install a traffic signal at the subject intersection. You submitted an intersection control evaluation demonstrating a signal as a preferable traffic control device, considering operations, safety, cost, freight and multi-modal users.
You also demonstrated satisfaction of warrants one and two in the opening year, dependent on trip generation from development projects currently under construction. Additionally, you demonstrated satisfactory progression analysis.
In accordance with Oregon Administrative Rule 734-020-0410, I approve your request with the following conditions in addition to the conditions listed in OAR 734-020-0490:
1. The traffic signal shall be designed and operated at the subject intersection according to the current edition of ODOT’s Traffic Signal Policy and Guidelines, ODOT’s Traffic Signal Design Manual, and the edition of the MUTCD in effect in OAR 734-020-0005 when the traffic signal is installed or reconstructed.
2. Lane configuration design and phasing shall be according to a Preliminary Signal Operations Design signed by the Region Traffic Signal Operations Engineer.
3. The approach currently opposite SE 40th St. shall be closed or relocated prior to signal turn-on.
4. Follow ODOT’s ADA-related design standards, design exceptions, and inspection process.
5. The Traffic Engineering Section must approve the final signal design plans.
6. This approval is rescinded if the traffic signal is not advanced to construction within five (5) years of this interoffice memo’s signature date.
If you have any concerns regarding this approval, please contact Chris Primm at chris.j.primm@odot.oregon.gov.
