About this file

This is a Questions & Clarifications document (No. 5) for RFP AA-2027-01 issued by Lawrence Berkeley National Laboratory (LBNL) concerning the ALS-U project. The document addresses four key clarifications regarding contract terms and deliverables.

Regarding schedule, LBNL confirmed that January 31, 2027 remains the preferred target completion date, with allowance for proposers to submit alternative schedules and phased deliveries that will be evaluated accordingly. Any cost associated with expediting the schedule should be included in proposals. On the Acceptance Criteria List (Attachment C), LBNL clarified that a released and numbered version will be issued at award and is currently routing through LBNL's approval process with no anticipated changes. The two authorizing QA documents cited in the Acceptance Criteria List—LBNL QA Plan PUB 3111 and ALS-U Quality Assurance Plan AL-1024-3173—are incorporated into this Questions & Clarifications No. 5. Finally, LBNL clarified the boundary between correction obligations under the revised Sample Subcontract and SOW Section 6.4 support activities: work directed by LBNL during vendor fabrication that does not arise from subcontractor error, such as responses to vendor questions and clarifications, falls under Section 6.4 and is subject to the 200-hour maximum; the correction obligation applies only to errors, omissions, and non-conformances attributable to the subcontractor's own performance and does not apply to LBNL-directed changes or revisions.

RFP AA-2027-01

Questions & Clarifications No. 5

1. Confirming your October 1 answer still governs. On October 1 you wrote that "January 31 remains the ALS-U desired schedule. If this date is not attainable, alternative schedules should be presented and will be considered." Revision B Section 8 now says the same thing, calling January 31, 2027 LBNL's "preferred target date" and inviting alternative completion dates and phased deliveries. The closing paragraph of that same Section 8 still refers to "the required January 31, 2027, completion date." We are proceeding on your October 1 answer and on the opening of Section 8. Please confirm that is correct. This is correct. Please propose a realistic schedule and include any cost to expedite schedule, if it allows. The schedule will be evaluated as such.

2. Attachment C, the Acceptance Criteria List. The posted file carries no document number, revision, status, release date or author, and its Level of Care is not marked. The revised Sample Subcontract ties acceptance of the Services to this document. Which Level of Care applies, and will a released and numbered revision be issued before award? A released and numbered version will be issued with award. It is not anticipated to change and is currently routing through LBNL approval process.

3. The two authorizing documents named in Attachment C. Section 4 of the Acceptance Criteria List cites LBNL QA Plan PUB 3111 and ALS-U Quality Assurance Plan AL-1024-3173. Neither is in the RFP package. Can both be provided? These (2) documents are incorporated into Questions & Clarifications No. 5.

4. The boundary between the new correction obligation and SOW 6.4. The revised Sample Subcontract adds correction of design errors and deficiencies at no additional cost, extending to defects identified during vendor fabrication and assembly. SOW Section 6.4 provides as-needed support through completion of the associated procurements, up to a maximum of 200 hours. Both run over the same period. Please confirm our reading: that work LBNL directs during fabrication which is not a Subcontractor error, including responses to vendor questions, clarifications and LBNL-initiated changes, is support under Section 6.4, and that the correction obligation applies to errors, omissions and non-conformances attributable to the Subcontractors own performance.

This understanding is correct. SOW Section 6.4 includes evaluating and responding to vendor questions and proposed changes during fabrication, including documentation updates to address manufacturing feasibility or general concerns, where these activities do not arise from an error, omission, or non-conformance attributable to the Subcontractor’s performance. Such support is subject to the 200-hour maximum. The language in the revised Sample Subcontract applies to omissions and errors only and does not apply to LBNL directed changes or revisions.
