1.3 ADDITIONAL COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK

In addition to the requirements of FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK, comply with the following requirements:

a. The work schedule is Monday through Friday, except Federal holidays as coordinated and approved by the Contracting Officer, or as indicated.

Federal Holiday and weekend work must not commence unless approved.

b. Secure and keep unauthorized persons out of all work sites with signing, fencing, or by other approved means.

c. The building will be occupied by USACE employees. Accessibility is required for customer vehicles and deliveries during the construction period.

d. Work Area Requirements

(1) Radios and similar devices that can be heard outside the Contractor's work area are prohibited within that area(s).

(2) Remove dust and debris from the work areas daily.

(3) Complete work that generates noise above the exposure limits, as specified in EM 385-1-1 , outside the building or during non-business hours. Prior to completing this work, coordinate with the Contracting Officer.

e. In accordance with the "Bald and Golden Eagle Protection Act" and "Migratory Bird Treaty Act," limit construction activity near bald eagle roosting sites during the winter months unless otherwise approved. Conduct operations in a manner that minimizes the disturbance to bald eagles. The Bald Eagle Management Guidelines and Conservation Measures (available from https://www.fws.gov ) may be used to determine what constitutes a disturbance and to find information on minimizing impact to bald eagles. Contact the U.S. Fish and Wildlife Service (USFWS) or State Department of Natural Resources for assistance.

f. Copperbelly and Diamondback water snakes emerge from hibernation in early spring (April) when temperatures reach 64 to 72 degrees F . The U.S. Fish and Wildlife Service (USFWS) or the State of Illinois Department of Natural Resources personnel will survey areas under construction for snake activity during this period as a precaution to keep these snakes from being destroyed while they are still

SECTION 01 14 00 Page 3 lethargic. Restrict construction activities within these areas of suitable snake habitat if such activities are identified. Restrict heavy equipment from this habitat and lifts within 7 to 10 days when the snakes are active enough to escape the disturbance. Coordinate time extensions due to endangered species delay, per situation, with the Contracting Officer.

1.4 COORDINATION WITH OTHERS

Schedule and coordinate operations affecting other Contractors, Government personnel, utilities, and/or property occurring within the work limits.

Accomplish with lead time sufficient for coordination of all involved parties as necessary for timely completion of each Contract feature. At a minimum, establish coordination with each of the following point(s) of contact, as required:

1.5 ANTITERRORISM (AT) AND OPERATIONS SECURITY (OPSEC)

1.5.1 General Security Requirements and Guidance

The security requirements described below apply to Contractor personnel (including employees of the prime Contractor ("Contractor") and all subcontractor employees) supporting the performance requirements of this Contract. Address questions regarding security matters to the Contracting Officer. Contractor personnel are critical to the overall security and safety of USACE installations, facilities, and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; applicable Contractor personnel must complete initial training within 30 days after receiving Notice to Proceed. Notify the Contracting Officer within five business days of completing the training. Include documentation of the names of Contractor personnel trained and which training has been completed; maintain training records as part of Contract files; and be prepared to provide copies of training certificates to the Contracting Officer. Contractor personnel and vehicles are subject to search when entering Federal installations.

Comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (RAMs), and Health Protection Condition (HPCON) measures. Meet performance requirements during elevated FPCON and/or HPCON levels in accordance with USACE plans and procedures. This includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by FAR 52.243-4 CHANGES, if the FPCON or HPCON levels change at any individual facility or installation, the Government may implement security changes that affect Contractor personnel. Ensure that Contractor personnel are aware of their security responsibilities, including site-specific requirements identified in local policies or procedures.

1.5.2 Antiterrorism (AT) Level I Training

Contractor personnel requiring routine access to Army installations, facilities, and controlled access areas or requiring network access must

1.5.3 Physical Security and Access Control Requirements

a. Overview: Contractor personnel requiring physical access to a USACE facility must comply with the access control procedures of that location. Contractor personnel requiring unescorted access to meet Contract performance requirements will be vetted by the USACE Rock Island District Security and Law Enforcement Office (CEMVR-SL) using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB). Contractor personnel must comply with personal identity verification requirements as specified. Contractor personnel who do not meet requirements for unescorted access to Government installations must coordinate escorted access with the Contracting Officer. Contractor personnel who receive keys, access cards, or lock combinations that provide access to Government-owned property must comply with USACE key and lock control procedures.

b. Contractor personnel requiring unescorted access to the Rock Island Arsenal and not in possession of a DoD ID card, Federal PIV, or an installation access pass must undergo a NCIC-III background check and be issued an installation access pass for up to one year or the period of performance of the Contract, whichever is shorter. Submit a Rock Island Arsenal Access Request Form for Contractor personnel requiring access to the installation at least three days prior to arriving at the Rock Island Arsenal. The Rock Island Arsenal Access Request Form can be found at https://home.army.mil/ria/index.php/download_file/force/465/1 . When arriving at the Rock Island Arsenal for the first time, report to the Rock Island Arsenal Visitor Welcome Center located just outside the Moline Gate. Final processing of the visitor badge will take approximately 5 to 8 minutes per employee.

c. Definition: For the purposes of this Contract, USACE facilities are defined as any USACE owned or leased property for which entry is controlled and limited to authorized USACE employees, Contractors, and official visitors.

d. Procedures:

(1) Contractor personnel may have unescorted access within controlled areas upon completion of an adjudication of fitness by CEMVR-SL and entry onto an access control list (ACL) for the facility/project. Submit background checks conducted by a bonded third party within the last six months of Notice to Proceed and authorize reports to be provided to CEMVR-SL by the third party.

Background checks must consist of a check of NCIC-III and TSDB when available. Individuals may be denied access to Rock Island District controlled facilities and/or property if the results of the third party NCIC-III equivalent background check gives an indication that a person may present a threat to the good order, discipline, safety, or security of the facility. This information includes, but is not limited to a person who has:

(a) The background investigation contains criminal arrest information about the individual that causes the senior commander to determine that the person presents a threat to the good order, discipline, or health and safety on the installation.

(b) A claimed identity that cannot be verified based on the reasonable belief that the person submitted fraudulent identity information in the attempt to gain access.

(c) Current arrest warrant in NCIC, regardless of the offense or violation.

(d) Current bar from entry or access to another Federal installation or facility.

(e) Conviction of crimes encompassing sexual assault, armed robbery, rape, child molestation, production or possession of child pornography, trafficking in humans, or drug possession with intent to sell or distribute.

(f) Conviction for espionage, sabotage, sedition, treason, terrorism, or murder.

(g) Being registered as a sex offender.

(h) Felony conviction within the last 10 years regardless of the offense or violation.

(i) Felony conviction for a firearms or explosives violation regardless of when the conviction occurred.

(j) Engaged in acts or activities designed to overthrow the U.S.

Government by force.

(k) Been identified as known to be, or is suspected of being, a terrorist or belonging to an organization with known links to terrorism or support of terrorist activity.

(2) Short term Contractor personnel working at the USACE facility or project for less than 15 calendar days may be escorted at the USACE facility by a USACE employee or other Contractor personnel that is on the ACL for the facility or project. Names and dates of work for short term Contractor personnel must be submitted to CEMVR-SL via e-mail at cemvr-sl@usace.army.mil to be added to the ACL for the period they will be working at the facility.

e. In addition to the submitted background checks, supplemental agency checks may be performed at the discretion of CEMVR-SL personnel.

Cooperate and ensure that Contractor personnel provides documentation required to complete these checks. Any person lacking proper

SECTION 01 14 00 Page 6 identification credentials or deemed a security threat may be denied access to the project. Such action in no way relieves the Contractor from performance of the Contract. USACE Rock Island District retains the right to deny Contractor personnel from working on a USACE Rock Island District Contract based on final background investigation results.

f. Contractor personnel denied access based upon derogatory information from the NCIC-III or equivalent check may apply to the District Commander for a waiver. To obtain a waiver, Contractor personnel must:

(1) Obtain a certified copy of their complete criminal history including arrests and convictions.

(2) Obtain a letter of support from their USACE sponsor. The letter must indicate that the sponsor requests that the person be granted unescorted access to accomplish a specific purpose as well as the anticipated frequency and duration of such visits.

If Contractor personnel is terminated, the sponsor must inform the CEMVR-SL so that unescorted access is no longer authorized.

(3) Submit a letter requesting the access denial be waived, to the USACE sponsor who will submit it to the District Commander. The letter must include offenses, including an explanation of why the conduct should not result in denial of access. Other factors that the sponsor or requesting individual should address are the:

(a) Nature and seriousness of the conduct;

(b) Specific circumstances surrounding the conduct;

(c) Length of time elapsed since the conduct;

(d) Age of the person at the time of the incident or conduct;

(e) Proof of efforts toward rehabilitation; and

(f) Current mailing address or email address for Army communications.

(4) The USACE sponsor will review the person's information for completeness and determine whether to endorse the request for a waiver.

(5) If the USACE sponsor endorses the waiver letter, the sponsor will provide a letter of recommendation for the person. The letter must address the relevant conduct that caused the denial and indicate why the conduct should not prohibit the person from being granted unescorted access. The USACE sponsor will submit the letters to the District Commander.

(6) The District Commander will render a determination in line with good order, discipline, and health and safety of the facility.

The District Commander will provide a copy of the determination to the person.

(7) The results of the District Commander's decision will be provided to the CEMVR-SL to update the Access Control List for the project.

(8) Persons who had a waiver request denied may request reconsideration from the District Commander one year after the date of the Commander's decision. Persons may request reconsideration earlier if they can present significant information that was not available at the time of the original request or show that the basis for the original denial was overturned, rescinded, or expired.

g. If an unexpected change in personnel is required due to sudden absence of critical path Contractor personnel, immediately contact the Contracting Officer to coordinate obtaining written approval from CEMVR-SL for new or additional Contractor personnel to be brought on-site prior to background check acceptance. Submit ATTACHMENT A - Personnel Change Request Form to receive written authorization from CEMVR-SL prior to bringing new Contractor personnel on-site. Ensure that a background check is sent to CEMVR-SL no later than 10 days from written notice of approval. USACE Rock Island District reserves the right to terminate access of Contractor personnel upon review of the background check. The Contractor will be notified immediately of any such Government decision.

h. If an unforeseen change in work site conditions, which may require a Contract Modification, causes the immediate addition of Contractor personnel, submit ATTACHMENT A - Personnel Change Request Form to receive written authorization from CEMVR-SL prior to bringing new personnel on-site. Ensure that a background check is sent to CEMVR-SL no later than 10 days from written notice of approval. USACE Rock Island District reserves the right to terminate access of Contractor personnel upon review of the background check. The Contractor will be notified immediately of any such Government decision.

1.5.4 Contractor Personnel Requiring a Common Access Card (CAC)

Contractor personnel will be issued a common access card (CAC) only if duties involve one of the following:

a. both physical access to a DoD facility and access to DoD information systems or networks;

b. remote access to a DoD information system or network using DoD-approved remote access procedures; or

c. physical access to multiple DoD installations or multiple non-DoD federally controlled facilities on behalf of the DoD on a recurring basis for a period of 6 months or more.

Before CAC issuance, Contractor personnel must have at a minimum, a favorably adjudicated Tier 1 investigation or an equivalent or higher investigation in accordance with applicable Army regulations and Homeland Security Presidential Directive 12. At the discretion of the Government installation, an initial CAC may be issued based on a favorable review of a fingerprint check and a successfully scheduled Tier 1 investigation with the National Background Investigations Bureau. The Government installation will provide Contractor personnel with additional information and forms to initiate the CAC issuance process and/or to initiate background investigations, when required. Contractor personnel must complete the processes within established timelines to avoid delays.

1.5.5 Suspicious Activity Reporting Training

Contractor personnel must receive initial and annual refresher training from the Government installation representative on the local suspicious activity reporting program (e.g., iWATCH, CorpsWatch, or See Something, Say Something). This locally developed training provides Contractor personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the Contracting Officer.

1.5.6 Contractor Personnel Requiring Access to Government Information Systems

Contractor personnel requiring access to Government information systems (including USACE business systems and CAC-enabled websites) must be in accordance with applicable DoD and Army regulations and must use USACE UserID-Password Administration and Security System (U-PASS) at commencement of services to request network user accounts. Contractor personnel must complete DoD Information Assurance Awareness training prior to accessing information systems, and annually thereafter.

1.5.7 Contracts Requiring a Formal OPSEC Program

Develop and submit for approval an OPSEC SOP/Plan within 90 days of Notice to Proceed. Include a process to identify critical information, where it is located, who is responsible for it, how to protect it, and why it needs to be protected. In accordance with Army and DoD regulations, provide a certified Level II OPSEC Coordinator to ensure OPSEC compliance for the duration of the Contract.

1.5.8 Training Requirements for the Protection of Sensitive Information

Contractor personnel with access to, or that may generate, information identified by USACE, the Mississippi Valley Division, or the Rock Island District as critical information (see the current MVR Critical Information List) must ensure that this information is safeguarded.

a. Contractor personnel with access to critical information must be added to an Access Control List (ACL) for the project using the same process as identified in paragraph "Physical Security and Access Control Requirements. "

b. Critical information must only be transmitted via Government encrypted e-mail, or a Government secure data transfer portal such as DoD SAFE.

c. Contractor personnel with access to critical information as identified in the MVR Critical Information List must complete initial and annual refresher:

(1) OPSEC Level I Awareness training which is available at http://www.cdse.edu/catalog/operations-security.html

(2) Controlled Unclassified Information training which is available at https://securityawareness.usalearning.gov/cui/

d. Foreign National Contractor personnel must receive approval from the USACE Foreign Disclosure Officer before they can be exposed to, or potentially generate, critical information. To receive foreign disclosure approval, submit the following information to the USACE Rock Island District Security and Law Enforcement Office:

(1) A legible copy of the photo page of the foreign Contractor personnel's passport.

(2) A legible copy of the foreign Contractor personnel's entry visa, Permanent Resident Card, or Employment Authorization Document.

Ensure that foreign national Contractor personnel do not have access to critical information prior to receiving written approval from the USACE Foreign Disclosure Officer. Failure to do so may result in formal or informal investigation by USACE or other governmental agencies.

1.5.9 Information Assurance (IA)/Information Technology (IT) Requirements

Contractor personnel performing IA/IT services must comply with DoD training and certification requirements in accordance with DODM 8140.03 and maintain required background investigations as specified. Provide documentation of certification prior to performing on the Contract. In accordance with applicable DoD, Army, and USACE regulations, ensure that information systems (IS) and platform information technology (PIT) systems are developed and/or supported with cybersecurity and architectural requirements including, but not limited to, security technical implementation guides (STIG) (e.g., the current version of the Application Security and Development STIG, and the internet access point (IAP) demilitarized zone (DMZ) STIG), and the use of security controls developed under the risk management framework documentation for the system or platform. Address questions regarding these provisions to the Contracting Officer.

1.5.10 Contractor Personnel Requiring Handling or Access to Classified Information

Contractor personnel must have an appropriate Facility Clearance Level (FCL) prior to performance on the Contract; the Government installation will sponsor the Contractor in obtaining the FCL. Cleared Contractor personnel must comply with the FCL requirements, as well as applicable laws and regulations regarding access to security information. For classified Contracts, the Contracting Officer will generate the DD FORM 254, "Contract Security Classification Specification," which will be attached to the Contract.

1.5.11 Threat Awareness Reporting Program

Contractor personnel who maintain active security clearances must receive initial and annual refresher training on the Threat Awareness and Reporting Program (TARP), provided by a Counterintelligence Agent. As determined by the servicing Counterintelligence Agent, Contractor personnel may complete the web-based TARP training.

1.5.12 Escorting in Classified and/or Sensitive Areas

In accordance with applicable regulations, Contractor personnel who do not possess the appropriate security clearance or access privileges must be escorted in areas where they may be exposed to classified information or operations, sensitive information or activities, or restricted areas.

1.5.13 E-Verify Program

22.18 and submit Company Enrollment in E-Verify at:

https://www.e-verify.gov/ to meet the Contract employment eligibility requirements. Cooperate with Federal and State agencies responsible for enforcing labor requirements including eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i) FEDERAL AND STATE LABOR REQUIREMENTS - POLICY. Submit an initial list of verified/eligible candidates within three business days after Notice to Proceed. When Contracts are with individuals, the individuals must complete a Form I-9 , Employment Eligibility Verification, and submit it as part of the official Contract file.

1.6 ACTIVITY REGULATIONS FOR CONTRACTOR ACCESS AND USE OF PREMISES

Follow current Army Security Regulations concerning strict visitor control and preservation of Government assets. Immediately report security concerns to the Contracting Officer.

Work may be affected by the following Force Protection Conditions levels:

FPCON NORMAL

Applies when there is no discernible terrorist activity. Routine security posture.

FPCON ALPHA

When there is a general threat of possible threat activity against personnel and the installation, or both. There will be a limited impact on normal operations.

FPCON BRAVO

When there is an increased or more predictable threat. There will be an impact on normal operations, but it will not cause undue hardship to personnel, substantially affect operational capabilities, or cause aggravated relations with local authorities and civilians.

FPCON CHARLIE

When an incident occurs, or intelligence is received indicating imminent terrorist action. If this lasts for more than a short period it will probably create hardships for personnel and affect the peacetime activities of units and personnel.

FPCON DELTA

When a terrorist attack has occurred, or intelligence indicates likely terrorist action against a specific location. This is normally declared as a localized warning and requires implementation of mandatory security measures. This cannot be sustained for an extended period without causing significant hardships for personnel and affecting the peacetime activities of units and personal.

FPCON NORMAL through FPCON BRAVO will not affect the work. FPCON CHARLIE

SECTION 01 14 00 Page 11 and FPCON DELTA will affect the work. FPCON CHARLIE will subject the Contractor to a higher degree of inspection and may not be able to work on-site for short periods of time as decreed by the USACE Rock Island District Security Officer. FPCON DELTA, as determined by the USACE Rock Island District Security and Law Enforcement Office, will close the site down and the Contractor will not be able to work on the site.

1.7 SPECIAL SAFETY REQUIREMENTS

Remove Contractor personnel from the job site who disregards safety regulations or displays unsafe attitudes and actions, as directed, and in accordance with EM 385-1-1 .

1.8 LOCATION OF PARKING, STAGING, AND STORAGE AREAS

The Contractor's parking, staging, and storage areas are as indicated or as coordinated and approved.

1.9 ELECTRICAL POWER LINES

Prior to mobilization, if the work will be adjacent to power lines, provide appropriate danger signs where equipment scheduled for use is capable of contacting such lines. To confirm the location of underground lines, contact the appropriate council listed in Section 01 30 00 ADMINISTRATIVE REQUIREMENTS paragraph ONE CALL SYSTEM FOR EXCAVATORS.

Coordinate with the Contracting Officer. Either have aerial power lines temporarily shut off and prevent the lines from being energized, or maintain clearances required by EM 385-1-1 . Do not proceed working into dangerous areas without assigning additional Contractor personnel to watch the movements of other personnel and equipment. Ensure that designated clearances are maintained.

1.10 AVAILABILITY AND USE OF UTILITY SERVICES

a. Refer to FAR 52.236-14 AVAILABILITY AND USE OF UTILITY SERVICES.

b. The use of basement facilities, drinking and restroom facilities, power, and potable water, are subject to proper use. Carefully conserve utilities furnished.

1.11 HISTORICAL BUILDINGS

Complete a building assessment in accordance with the State Historic Preservation Office standards for reporting. Due to the historic nature of the property, work must be in accordance with professional standards and guidelines including, but not limited to, FR 44715 , 36 CFR 68 , and Preservation Briefs and Technical Publications issued by the Technical Preservation Service of the U.S. National Park Service.

The Contactor must have recognized and demonstrable expertise in the appropriate type of historic preservation and architectural investigations. Maintain standards of conduct, integrity, and competency for staff. Submit Contractor Portfolios demonstrating and documenting expertise and experience providing the required services for projects with similar scope(s) of work.

1.12 DELAYS DUE TO THE GOVERNMENT

Upon acknowledgment of Notice to Proceed and continuing throughout the

Contract, record on the daily CQC report, any days in which the Government's work extends beyond those detailed in paragraph ADDITIONAL COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK. The Contract Duration period will be extended by the number of calendar days that the Government delays the Contractor's work. The Government will not reimburse the Contractor for standby costs associated with delays caused by the Government. Delays caused by the Government will not be the basis for an adjustment in Contract price.

The job price and payment made for each item listed constitutes full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.

1.2.1 Mobilization and Demobilization

Failure to justify such price to the satisfaction of the Contracting Officer may result in payment of actual mobilization costs, as determined by the Contracting Officer at the completion of mobilization;

1.3 SUPERVISION

1.3.1 Superintendent Qualifications

Provide project superintendent with a minimum of 10 years experience in construction with at least 5 of those years as a superintendent on projects similar in size and complexity. The individual must be familiar with the requirements of EM 385-1-1 and have experience in the areas of hazard identification and safety compliance. The individual must be capable of interpreting a critical path schedule and construction

Submit certifications or passing exam results for the ICC National Standard General Building Contractor (ICC Exam F11-N or G11-N). For projects where the superintendent is permitted to also serve as the Quality Control (QC) Manager as established in Section 01 45 04 CONTRACTOR QUALITY CONTROL, the superintendent must have qualifications in accordance with that section.

1.3.2 Minimum Communication Requirements

Have at least one qualified superintendent, or competent alternate, capable of reading, writing, and conversing fluently in the English language, on the job-site at all times during the performance of Contract work. In addition, if a Quality Control (QC) representative is required on the Contract, then that individual must also have fluent English communication skills.

1.3.3 Duties

The project superintendent is primarily responsible for managing subcontractors and coordinating day-to-day production and schedule adherence on the project. The superintendent is required to attend partnering meetings, and quality control meetings. The superintendent or qualified alternative must be on-site at all times during the performance of this contract until the work is completed and accepted.

1.3.4 Non-Compliance Actions

The Project Superintendent is subject to removal by the Contracting Officer for non-compliance with requirements specified in the contract and for failure to manage the project to ensure timely completion.

Furthermore, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken.
