About this file

This is a Memorandum for Record (MFR) for Brand Name Justification for a FAR Part 12 commercial procurement under simplified acquisition threshold (SAT) procedures.

The Engineer Research and Development Center – Coastal and Hydraulics Laboratory (ERDC–CHL) is procuring model supplies for the Keystone General Physical Model on a brand name or equal basis. This is a new requirement with firm-fixed pricing and delivery required within 30 calendar days post-award. Funding is from Civil Works Construction accounts. The procurement is authorized under DFARS 211.204 (Class Deviation 2026-O0013) for items peculiar to one manufacturer, implemented to comply with section 888 of the FY 2017 National Defense Authorization Act regarding brand name or equal purchase descriptions under FAR 12.201-1 simplified procedures for commercial products. The NAICS code is 326140 (Polystyrene Foam Product Manufacturing).

The justification lists eighteen line items designated as either "Brand Name Only" (marked with asterisks) or "Brand Name or Equal" (marked with double asterisks). Brand Name Only items include Drew Foam foam blocks, Advantech plywood, MRP Supports pedestals, Creative Polymers polyurea and coatings, American WeatherStar urethane, Stratasys resin, Curbell foam and acrylic sheets, and SONALOK flow meter—all required to meet the proprietary patented modeling process or ensure compatibility with existing systems. Brand Name or Equal items include Kiltz primer, Sika adhesive and sealant, and Dowsil silicone. Market research confirmed that unique characteristics and specifications are necessary for mission success. The Procuring Contracting Officer Christine Shuck approved the justification using price analysis techniques to determine fair and reasonable pricing, subject to availability of funds.
