About this file

This document is a Federal Consistency Certification letter from the Massachusetts Office of Coastal Zone Management (CZM) dated December 12, 2024, addressed to Lily Collins at the MassDOT Highway Division. The letter pertains to a bridge preservation project located at Oak Street over Route 6 in Barnstable. The proposed activities include removing and disposing of granite curb, excavating the existing bridge barrier and safety walk, forming and pouring a new barrier and safety fence, installing highway guardrail transition, removing the temporary barrier, performing pavement milling, and installing new pavement markings.

The CZM indicates that while the project is located within the Massachusetts Coastal Zone, the activities fall below the thresholds requiring a formal review under federal consistency provisions. Consequently, a formal decision regarding consistency with enforceable program policies is not necessary. However, any federal licenses or permits for the work may be subject to CZM's federal consistency review, and the project proponent is responsible for notifying CZM and submitting detailed information about the nature of the work. The letter suggests that CZM will use the submitted information to determine if further federal consistency review is required.

RE: Federal Consistency Certification: Bridge Preservation Oak Street Over Route 6;

Barnstable

Dear Ms. Collins:

The Massachusetts Office of Coastal Zone Management (CZM) has completed its review of the proposed project which consists of bridge preservation activities at Oak Street over Route 6 in Barnstable. These activities include the following:

- The project consists of removing and disposing of the granite curb, excavating the existing bridge barrier and safety walk, formation and pouring of the new barrier and safety fence, installation of Highway Guardrail Transition, removal of the temporary barrier, pavement milling, and installation of new pavement markings.

Although the activities associated with this project are located within the defined

Massachusetts Coastal Zone, they fall below the thresholds that CZM generally uses to require review under our federal consistency provisions. Consequently, a formal decision from this office regarding consistency with our enforceable program policies is not necessary. Any federal licenses or permits for the work performed may be subject to CZM’s federal consistency review. It is incumbent upon the proponent to notify CZM, submit an explanation of the nature of the work, and submit necessary data and information. CZM will use this information to determine if further federal consistency review is required.

Thank you for submitting the information to CZM. If you have any questions regarding our review process, feel free to contact me at sean.duffey@mass.gov.

Sincerely, Sean Duffey CZM Project Review and Dredging Coordinator
