About this file

This is Addendum No. 3 to the contract documents and specifications for the Regional Bicycle Enhancements Eugene 2024 federal-aid project issued by the City of Eugene, Oregon, in collaboration with the Oregon Department of Transportation (ODOT), dated December 10, 2025. The addendum amends key bidding requirements in response to updated Federal Highway Administration (FHWA) requirements and the U.S. Department of Transportation Interim Final Rule regarding the Disadvantaged Business Enterprise (DBE) program, effective October 3, 2025. The revised bid closing date is Thursday, December 18, 2025, at 2:00 p.m., and the project completion deadline has been extended from April 6, 2026, to June 5, 2026, per Special Provision 00180.50(h). Bidders are required to acknowledge receipt and acceptance of this addendum by signing and submitting it with their bid; failure to do so may result in bids being deemed non-responsive.

The addendum removes all DBE-related requirements and forms previously mandated for this project, including the DBE Commitment Certification and Utilization Form, DBE Commitment Requirements, and DBE Information Page, as the project now carries a 0% DBE goal. Several special provisions have been modified or deleted, including revisions to record requirements for subcontractors and material suppliers, elimination of DBE-specific provisions in trucking services agreements, and updates to the Paid Summary Report requirements (Form 734-2882), which now require submission to all subcontractors and suppliers with estimated total payments exceeding $10,000. The suspension of DBE requirements applies to all federally funded projects until ODOT implements the updated DBE Interim Final Rule. Contractors must continue to comply with federal Davis-Bacon prevailing wage standards, equal employment opportunity provisions, and other existing federal and state requirements for this federal-aid construction project.
