About this file
This is a vendor compliance document issued by the City of San Angelo, Texas Purchasing Division regarding reciprocity requirements for non-resident vendors. The document establishes compliance procedures that non-resident vendors must follow to be eligible for contract awards. Non-resident vendors, defined as contractors whose principal place of business is located outside Texas, are required to complete Section A of the form by identifying their state of business and stating the percentage by which they must underbid Texas resident vendors according to their home state's reciprocity laws. Texas resident vendors must complete Section B by confirming their principal place of business is located within Texas. The document references Texas Government Code 2252.002 as the statutory authority for these reciprocity requirements.
The reciprocity requirement mandates that non-resident vendors bid at amounts lower than the lowest Texas resident vendor bid by the same percentage that Texas resident vendors would be required to underbid non-resident vendors in the non-resident's home state. Failure to complete the appropriate section disqualifies the non-resident vendor from contract consideration. The requirement does not apply to contracts involving Federal funds. An authorized agent must sign the form, providing the vendor name, address, city, state, zip code, and the agent's name, title, and signature with date. This compliance document applies to the City of San Angelo's request for bids on trucks, including approximately two dump trucks and one haul truck for purchase within the first twelve months of the award.

Vendor Compliance with Reciprocity on Non-Resident Vendors
Texas Government Code 2252.002 provides that, in order to be awarded a contract as low vendor, a non-resident vendor must bid projects for construction, improvements, supplies or services in Texas at an amount lower than the lowest Texas resident vendor by the same amount that a Texas resident vendor would be required to underbid a non-resident vendor in order to obtain a comparable contract in the state in which the non-resident’s principal place of business is located.
A non-resident vendor is a contractor whose corporate offices or principal place of business is outside of the state of Texas. This requirement does not apply to a contract involving Federal funds. The appropriate blanks in Section A must be filled out by all out-of-state or non-resident vendors for your submission to meet specifications. The failure of out-of-state or non-resident contractors to do so will automatically disqualify that vendor. Texas resident vendors must check the blank in Section B.
