About this file
This is an insurance requirements document issued by the Colorado Department of Corrections for state and local contract opportunities. The document outlines mandatory insurance coverage that contractors must maintain throughout the contract term to protect the State of Colorado from claims arising from the contractor's or permitted subcontractor's performance. All required insurance must be primary and non-contributing to any comparable liability carried by the State and must be provided by companies with an A.M. Best rating of "A" or better with a financial size category of VII or better. Contractors must determine their applicable insurance needs based on the nature of work performed, with coverage types including Workers Compensation Insurance, Commercial General Liability Insurance ($1,000,000 each occurrence and general aggregate), Automobile Liability Insurance ($1,000,000 combined single limit if vehicles are used on state property), Protected Information Insurance ($1,000,000 each occurrence; $2,000,000 general aggregate if accessing confidential personal or protected health information), Professional Liability Insurance ($1,000,000 each occurrence; $2,000,000 general aggregate for professional or technical services), and Crime Insurance ($1,000,000 each occurrence and general aggregate if employees have access to state money or property).
The State must be named as additional insured on all commercial general liability policies, and all insurance policies must include provisions preventing cancellation or non-renewal without at least 30 days prior notice and must include subrogation waivers protecting the State and its entities. Contractors are responsible for all insurance deductibles and must provide certificates of insurance evidencing coverage within seven business days following the effective date, with evidence of insurance required before contract or purchase order issuance. Public entities meeting the definition under the Colorado Governmental Immunity Act may maintain liability insurance through commercial policy or self-insurance in lieu of stated requirements. Contractors should obtain insurance quotes prior to submitting a bid and submit certificates to doc_purchasing@state.co.us.
