About this file

This document is a Limited Asbestos Materials and CAM-17 Metals Assessment report prepared by Health Science Associates (HSA) for Eastern Municipal Water District, covering four water tank sites located in Moreno Valley, Menifee, and Winchester, California. The assessment was conducted on August 5, 2025, with the primary objectives of determining if asbestos abatement was required and if paint on tank surfaces contained detectable levels of CAM-17 metals in accordance with California Title 22 hazardous waste standards. HSA collected 12 suspect bulk asbestos samples resulting in 14 analyses and 11 bulk paint chip samples across the four tank locations.

Laboratory analysis revealed no asbestos-containing materials (ACM) or asbestos-containing construction materials (ACCM) in the samples. However, several paint samples were found to contain metals at levels exceeding the total threshold limit concentration (TTLC), requiring specific hazardous waste disposal procedures. Paint samples from Quail Valley 2, Quail Valley 1, and Benton Road Recycle Tank contained various metals including barium, lead, zinc, chromium, copper, and nickel. The report recommends that contractors segregate waste materials and conduct additional Toxicity Characteristic Leaching Procedure (TCLP) testing to determine proper disposal methods in compliance with local, state, and federal regulations.

Executive Summary

Pursuant to the request of LaMikea Thewes, Eastern Municipal Water District, Health Science Associates (HSA) performed a limited asbestos materials and CAM-17 metals assessments of four Eastern Municipal Water District (EMWD) tank sites (S4144 Oliver Tank, located in Moreno Valley, CA; S4114 Quail Valley 1 Tank located in Menifee, CA; S4160 Quail Valley 2 tank located in Menifee, CA; and S9822 Benton Road Recycle Tank located in Winchester, CA). This assessment was performed on August 5, 2025.

The purpose of the survey was to determine if asbestos abatement was required and if the paint on the tank surfaces have detectable levels of CAM-17 metals in accordance with the California Title 22, §66261.24 hazardous waste standards for metals prior to the and renovation and/or demolition of the sites.

During the August 5, 2025 site visit, HSA collected a total of 12 suspect bulk asbestos samples resulting in 14 analyses by layer. Sampling locations and materials were determined by Eastern Municipal Water District. Laboratory analysis determined that none of the materials sampled were either asbestos containing material (ACM) or asbestos containing construction material (ACCM) per polarized light microscopy (PLM) with dispersion staining analytical method. No further action is required at this time with regards to the sampled materials.

For this project, HSA collected 11 representative paint samples from the exterior surfaces of the subject tanks. Laboratory analysis determined that the following paint contained levels above the total threshold limit concentration (TTLC) criteria and is considered to be and must be disposed of as a hazardous waste in the State of California. Additionally , the paint could also fail the Toxicity Characteristic Leaching Procedure (TCLP) test. Therefore, the contractor, or in-house personnel, as part of the required waste characterization process should segregate all waste generated, such as but not limited to, paint chips, polyethylene sheeting, and personal protective equipment (PPE), during any work on these tanks into separate waste streams and samples shall be submitted to a laboratory for TCLP analysis to determine proper disposal and to meet local, state, and federal requirements.

and S9822 Benton Road Recycle Tank located in Winchester, CA). This assessment was performed on August 5, 2025.

1.2 The purpose of the survey was to determine if asbestos abatement was required and if the paint on the interior wall had detectable levels of CAM-17 metals in accordance with the California Title 22, §66261.24 hazardous waste standards for metals prior to the sale of the Residence.

1.3 This project, project management, and report preparation were performed by Devin S. Berman, Industrial Hygienist (IH) California Certified Asbestos Consultant (CAC, 15-5418), California Department of Public Health (CDPH) Certified Lead Inspector/Assessor (I/A - LRC 00002357).

1.4 Senior project management and final report review were performed by Joel I.

Berman, Certified Industrial Hygienist (CIH), Certified Safety Professional (CSP), CAC (92-0838), Certified Indoor Air Quality Manager (CIAQM), CDPH Certified I/A (LRC 00003608) and Project Monitor (PM LRC 00003607), President.

1.5 The subject locations are stand alone water tanks enclosed behind gated areas.

The tanks are made of metal and were constructed on concrete slabs.

1.6 During the August 5, 2025 site visit, HSA collected a total of 12 suspect bulk asbestos samples resulting in 14 analyses by layer and 11 bulk paint chip sample.

Sampling locations and materials were determined by Eastern Municipal Water District.

2.0 METHODOLOGY

2.1 Asbestos

2.1.1 The collection of bulk samples from suspect asbestos containing materials (ACMs) was performed to determine if the sampled materials were either ACM, defined by the Environmental Protection Agency (EPA) as any material containing greater than one percent (>1%) asbestos, or asbestos containing construction material (ACCM), defined by the State of California as any construction material containing greater than 0.1

Page 1 - Project Number 250190LA

HSA | 10771 Noel Street | Los Alamitos | California | 90720 | Phone: 714-220-3922 | www.healthscience.com percent (>0.1%) asbestos. In general, bulk sampling guidelines outlined in the Asbestos Hazard Emergency Response Act (AHERA) were followed, but actual sample locations and total number of samples were determined by the technician that conducted the survey.

2.1.2 The suspect asbestos samples were analyzed via polarized light microscopy (PLM) with dispersion staining in accordance with EPA method 600/R-93-116. The lower limit of reliable quantification for this method is 1%. When any trace level of asbestos was detected (often even one fiber) by the PLM analyst, the sample result were reported as “<1%,” i.e. ACCM, along with an identification of the type of asbestos that was detected. Subsequently, where ACCM was reported, further analysis via PLM 1000 point counting can be performed to quantify the asbestos levels down to 0.1%, the quantification limit where the material is considered non-asbestos containing for most regulatory purposes.

Point counting was not required for this survey.

2.2 CAM-17 Metals

The bulk paint sampling and analytical methodologies employed followed NIOSH, OSHA, EPA, and/or other professionally accepted sampling methods. The specific method is reported on the laboratory reports and sampling data sheets, which include chains-of-custody (COC) signatures.

2.3 Laboratory

After sample collection, all samples were transported via chains-of-custody procedures to LA Testing’s Huntington Beach California laboratory for analysis.

LA Testing is part of a larger, nation-wide laboratory organization known as EMSL. These laboratories maintain accreditations by the American Industrial Hygiene Association (AIHA), the National Voluntary Laboratory Accreditation Program (NVLAP), the California Department of Public Health Environmental Laboratory Accreditation Program (ELAP), and AIHA's Environmental Lead Laboratory Accreditation Program (ELLAP).

2.4 Exclusions/Limitations

2.4.1 This site and sampling investigation did not access hidden and unknown portions of the site or sample in areas where access was not granted by the Owner.

2.4.2 HSA’s scope of work for this evaluation did not include collection of samples for any other suspect hazardous materials (i.e. soil, ground

Page 2 - Project Number 250190LA

HSA | 10771 Noel Street | Los Alamitos | California | 90720 | Phone: 714-220-3922 | www.healthscience.com water, etc.), which may or may not have been associated with the site or normal facility operations.

3.0 STANDARDS AND GUIDELINES

3.1 Asbestos

3.1.1 Asbestos Containing Material (ACM) - Any material containing more than one percent (>1%) asbestos, as defined by the EPA.

3.1.2 Asbestos Containing Construction Material (ACCM) - Any manufactured construction material which contains more than one-tenth of one percent (>0.1%) asbestos by weight, as defined by the State of California.

3.1.3 If the total amount of ACM or ACCM to be abated is equal to or greater than 100 s.f. the following regulations must be met.

3.1.3.1 South Coast Air Quality Management District (SCAQMD), Rule 1403, this rule requires District notification and removal of all ACM items (friable and non-friable) from a building prior to demolition. It requires the use of a state certified and a registered asbestos abatement contractor and a ten (10) day written notification. However, no notification is required if there is less than 100 square feet of ACM to be disturbed unless ACM is disturbed during renovation or demolition activities outside of a containment, then a Procedure 5 investigation and clean-up are required. SCAQMD does not regulate ACCM.

3.1.3.2 Labor Code 6501.5, requires the use of a state certified and registered asbestos abatement contractor for all asbestos removal projects that are equal to or more than 100 square feet of ACCM or ACM.

3.1.3.3 Federal Occupational Safety and Health Administration (OSHA) 29 CFR 1926.1101, California Code of Regulation (CCR) Title 8 § 1529 and § 5208 require employers to monitor the exposure of their employees who may be exposed to asbestos. If employees are exposed above certain criteria, the employer must take action to limit the employee's exposure to asbestos and to protect the employee's health. Per these regulations, the permissible exposure limit (PEL) for asbestos is 0.1 fibers per cubic centimeter of air (f/cc) expressed as an eight-hour time

Page 3 - Project Number 250190LA

HSA | 10771 Noel Street | Los Alamitos | California | 90720 | Phone: 714-220-3922 | www.healthscience.com weighted average (TWA) and the Excursion Limit is 1.0 f/cc expressed over a 30 minute time period.

3.1.3.4 Environmental Protection Agency (EPA) National Emission Standards for Hazardous Air Pollutants (NESHAP) 40 CFR Part 61, Subpart M requires the inspection for ACMs prior to any planned renovation or demolition of a building. If ACM has been identified it specifies work practice standards designed to minimize the release of asbestos fibers, such as the use of wet methods during building demolition or renovation, sealing waste in leak tight containers, transportation and disposal of waste material as expediently as practicable. The regulation also requires the owner or the operator of the renovation or demolition operation to notify the appropriate delegated entity (often a state agency) before any demolition or before any renovations of buildings when the amount of Regulated Asbestos Containing Material (RACM) is greater than 260 linear feet, 160 square feet or 35 cubic feet.

3.1.3.5 Environmental Protection Agency (EPA), Asbestos Hazard Emergency Response Act (AHERA) 40 CFR Part 763, Subpart E, this rule requires all K-12, public and private non-profit elementary and secondary schools nationwide, to inspect their schools for asbestos-containing building materials (ACBM) and develop and maintain an up-to-date Asbestos Management Plan (AMP). The management of ACBM can be maintained on an “in-place” based principle and the removal of ACBM is not necessary unless it is severely damaged or may become disturbed during a planned demolition or renovation project. In the event ACBM is to be removed or the school building demolished, public and private school districts must comply with NESHAP. The AHERA rule also stipulates that any personnel working on asbestos activities in schools must be trained and accredited in accordance with the Asbestos Model Accreditation Plan.

3.2 Lead and Other Metal Waste

3.2.1 Lead and other metal wastes are regulated under California Title 22, §66261.24. The standard defines lead hazardous waste as greater than (>) 1,000 milligrams per kilogram (mg/kg) of lead and/or lead compounds

Page 4 - Project Number 250190LA

HSA | 10771 Noel Street | Los Alamitos | California | 90720 | Phone: 714-220-3922 | www.healthscience.com determined as a Total Threshold Limit Concentration (TTLC) or 5.0 milligrams per liter (mg/l) determined as a Soluble Threshold Limit Concentration (STLC) or Waste Extraction Test (WET) method.

3.2.2 Under California Title 22, other metal wastes are also regulated.

3.2.3 Federal EPA under Resource Conservation and Recovery Act (RCRA) also mandates hazardous waste criteria for lead and other metals that is tested by the Toxicity Characteristic Leaching Procedure (TCLP). This method sets a limit for the quantity of lead that can be “soluble” or leach into the water. The EPA maximum toxicity characteristic for lead is equal to or greater than (>) 5.0 mg/l.

3.3 Other Regulations and Guidelines

California Title 8, CCR §5194, Hazard Communication Standard, requires employers to notify their employees of hazardous materials in their workplace.

4.0 RESULTS

4.1 The laboratory reports with chains-of-custody documentation are provided in Appendix A, the asbestos laboratory certification is provided in Appendix B, figures are provided in Appendix C, a photo exhibit is provided in Appendix D, and licenses provided are in Appendix E.

4.2 HSA collected 11 representative paint samples from the tank surfaces for laboratory analysis. The results, descriptions and analytical results are presented in Table IA through ID - Bulk Sampling Results for Metals. The sampling results are evaluated and compared with reference to levels regulated by California Title 22, §66261.24 hazardous waste standards for metals and Resource Conservation and Recovery Act (40 CFR Part 261).

4.3 Laboratory analysis determined that the following paint contained levels above the total threshold limit concentration (TTLC) criteria and is considered to be and must be disposed of as a hazardous waste in the State of California.

Additionally , the paint could also fail the Toxicity Characteristic Leaching Procedure (TCLP) test. Therefore the contractor should segregate all waste generated, such as but not limited to, paint chips, polyethylene sheeting, and personal protective equipment (PPE), from these tanks into separate waste streams and be submitted to the laboratory for TCLP analysis to determine proper disposal and to meet local, state and federal requirements.

4.5 The results, descriptions, estimated quantities, and analytical results for asbestos bulk samples are presented in Table II. HSA collected 12 suspect bulk asbestos resulting in 14 analyses by layer. Laboratory analysis determined that none of the materials sampled were ACM/ACCM per PLM method. No further action is required for the materials sampled unless other, previously hidden suspect ACMs are determined to be present during any future renovation /maintenance or demolition activities.

4.6 *Note: all suspect bulk asbestos samples collected are representative of the materials found in each location. Therefore, materials similar in color, texture and appearance as those identified as ACM located within the sampled areas are to be considered asbestos until tested.

5.0 RECOMMENDATIONS

5.1 The lab results form this survey determined that ACM/ACCM were not identified in the materials sampled at the subject locations.

5.2 During the impact of paint, generated waste should be segregated into different waste streams (i.e. paint chips, cleaning items, poly sheeting, PPE, etc.) and a waste profile should be conducted on separately on each waste stream to comply with all local, State, and Federal laws. Once the removal has begun, a

Page 6 - Project Number 250190LA

5.3 As stated in 4.3 and 4.4, follow-up sampling and analysis will need to be performed prior to disposal by the contractor or in-house personnel as part of the required waste characterization process.

5.4 Care should be taken when performing any activities (e.g. manually dry sanding or scraping surfaces) to prepare any of the component(s) either determined to be coated with or which are suspected of containing lead for repainting.

5.5 It is HSA’s understanding that the tanks are scheduled for maintenance/renovation at some future date. Therefore, due to the nature, age, hidden, or unknown suspect ACM/ACCM, lead, or other hazardous materials may be uncovered during any future renovation/maintenance activities.

Therefore, all contractors working on the project should be informed of policies with regard to notifying management/owner if previously unidentified suspect hazardous materials are discovered during the project.

5.6 This report was prepared for use by Eastern Municipal Water District in evaluating the subject site. The information contained within this report is as factual as possible and the opinions related herein are based on HSA’s experience in similar investigations. LA Testing maintains liability limited to cost of analysis. Interpretation and use of test results are the responsibility of the client. This report relates only to the samples reported above, and may not be reproduced, except in full, without written approval by LA Testing. LA Testing bears no responsibility for sample collection activities or analytical method limitations. The report reflects the samples as received. Results are generated from the field sampling data (sampling volumes and areas, locations, etc.) provided by the client on the Chain of Custody. Samples are within quality control criteria and met method specifications unless otherwise noted. The above analyses were performed in general compliance with Appendix E to Subpart E of 40 CFR (previously EPA 600/M4-82-020 “Interim

Method”) but augmented with procedures outlined in the 1993 (”final”) version of the method. This report must not be used by the client to claim product certification, approval, or endorsement by

NVLAP, NIST or any agency of the federal government. Non-friable organically bound materials present a problem matrix and therefore LA Testing recommends gravimetric reduction prior to analysis.

Unless requested by the client, building materials manufactured with multiple layers (i.e. linoleum, wallboard, etc.) are reported as a single sample. Estimation of uncertainty is available on request.
