About this file
This is an Affidavit of Eligibility form from the City of Midland, Texas, pursuant to Texas Local Government Code 271.9051, which governs local preference consideration for bidders whose principal place of business is located within the City of Midland. The affidavit applies to bids ranging from $50,000 up to $100,000 for services and up to $500,000 for commodities, covering purchases of real property, personal property not affixed to real property, or services. Under this local preference policy, if the City receives bids from a local Midland business that are within five percent of the lowest bid from a non-resident bidder, the City may award the contract to either the lowest bidder or the local bidder if the City Council determines in writing that the local bidder offers the best combination of contract price and additional economic development opportunities for the City of Midland.
To qualify for local preference consideration, bidders must complete this affidavit and submit it to Erika Martinez, Purchasing Manager at the City of Midland. The form requires detailed information about the business including verification that the listed address is the principal place of business within city limits, the number of Midland residents employed at the location, the year the business was established in Midland, sales tax reseller information if applicable, details about multiple Texas office locations, and confirmation of business and real property tax payments to the City of Midland. The affidavit includes a penalty of perjury clause and warns that intentionally submitting false information will result in a one-year prohibition from bidding on City of Midland products and services.
