1.1.1 General Statement of Work
The work under this contract shall include furnishing all labor and materials necessary to completely remove and rebuild the Liberty to Van Buren portion of the Van Buren to Weleetka 161kV transmission line. The Contractor shall remove all structures, conductor, shield wire, grounding and all other items associated with this line except the existing optical ground wire (OPGW) and rebuild the line with all new materials.
The total length of the rebuild is approximately 12.1 miles.
The existing line is predominantly of wood pole, H-frame construction with 556.5 kcmil ACSR conductor. The new line shall consist of predominantly H-frame construction utilizing galvanized steel structures. The new phase conductor shall be
1192.5 kcmil, Grackle Conductor. New OPGW will be installed end to end in addition to the transfer of existing OPGW which will be located in the structure position opposite of the new OPGW cable.
Structures 59 and 60 are existing steel structures that span over a river with difficult accessibility. Field work will be required to modify the conductor attachment heights on the poles and to add additional guying to the existing steel poles. Contractor shall be responsible for all field modifications.
Work to rebuild this line shall be performed with the line deenergized. The Contractor shall perform work in a manner to minimize the amount of time that the line is out of service.
The work on this project further includes furnishing all labor and materials necessary to add fiber and related facilities in each of the substations from the new splice cans installed at the line terminations into the substation control houses. Discussion of the work at each location is described below.

The Contractor is expected to perform as much of the work as possible with the lines energized. Structure framing, anchor installation, and other make ready work and clean up shall be performed with the lines energized.
The order of work will be very important for the success of this project. A sequence of construction will be given as best determined by Southwestern at the time of writing. Events are likely to occur that will require Southwestern to alter the sequence. First and foremost in the decisions for construction sequence will be maintaining the integrity of Southwestern’s system and maintaining uninterrupted service to intermediate substations throughout the entire project. The Contractor must consider that changes in the order of construction are likely to occur and that work may not be contiguous from end to end on the project. Changes in the construction sequence will not be considered as grounds for time extensions or extra compensation.
The Contractor shall carefully review this sequence prior to bidding and bring to Southwestern’s attention in writing, any portion of the work that he believes to be unsafe or that he is unable or unwilling to perform.
Further the sequence of construction given is not intended to be fully inclusive of all work or steps required to perform the work. It is intended to identify the general order of work and critical milestones desired by Southwestern.
The general order of work will be as follows:
1. Order and receive all materials for the project.
2. Complete all underground work at the Van Buren Substation.
3. Request outage and clearance on the Van Buren-Weleetka Line. Priority should be given to work to be completed at Liberty Switching Station as outages at this site are more difficult to approve.

1.3 LOCAL CONDITIONS
1.3.1 Rights-of-Way
The selected contractor will be acting as Southwestern’s agent, which includes ingress and egress access to Federal lands and rights-of-ways for performance of the work over approved routes established by Southwestern.
The Contractor shall designate a single individual to be used throughout the duration of the project to make the landowner contacts and work with the landowners. The Contractor shall also take photographs of each tract or property documenting the condition of all aspects of the property and any associated access areas prior to entering the property the first time and again after completion of the project. This documentation shall be turned over to Southwestern at the end of the project.
The Contractor shall contact all landowners at least two weeks prior to entering any property in order to request preferred access to the right-of-way and advise the landowner of the project. Any cost associated with requests for access shall be borne by the Contractor. The Contractor shall also determine from each landowner any facilities such as sprinkler systems, septic systems etc. on the property requiring special attention or consideration. Any and all actions necessary to mitigate the risks to those areas of special attention or consideration are the responsibility of the Contractor. The Contractor shall prepare a written letter from each landowner, signed by both parties, authorizing the Contractor access to Southwestern’s right-of-way. These written letters shall be submitted to Southwestern prior to mobilization to the site. In addition to the submissions of the letters, Contractor shall provide a list of any landowner’s refusing access and/or any other impediment to access known by the Contractor at that time.
Southwestern will provide a list of landowners, including names and addresses, after the contract is awarded and a Notice to Proceed is issued. The list is provided solely as a courtesy to the Contractor and is not guaranteed current. The Contractor will be responsible for contacting and confirming the current owner of the property.
The Contractor shall contact all landowners prior to project completion and final demobilization to obtain a written release of claims signed by each landowner, agreeing that all restoration related to their property has been completed and releasing Southwestern from any further obligation associated with this construction project. The Contractor shall submit all written release of claims from each landowner to Southwestern prior to final project completion. A release of claims form is attached to this contract, see Appendix O.
If the landowner refuses to sign the release of claims, a release of claims denial shall be obtained. A release of claims denial form is attached to this contract, see
Appendix O. The Contractor shall use the release of claims denial form to document the reasons the landowner refuses to sign the release of claims, obtain the landowner’s signature, and submit the form to Southwestern.
As the release of claims/release of claims denial form is a required deliverable prior to final completion of this contract, Southwestern will withhold 2.0% of the total contract amount until all release of claims/release of claims denial forms of each landowner have been received.
The Contractor shall conduct operations in a manner that minimizes damages
(including crop damage) on Federal lands or within the Federal rights-of-way and on adjoining lands during performance. The Contractor shall remove all fences as necessary to gain access to and along the right-of-way. Many different types of fences are expected to be encountered. Fences removed or damaged shall be reinstalled to a condition better than when they were found and to the satisfaction of Southwestern and the landowners. Fences shall be replaced with new, like kind fences as necessary to meet these requirements. No new gates shall be installed within the right-of-way. If an existing gate is damaged during project performance, the Contractor shall replace with new, like kind gate as necessary to meet these requirements.
Existing right-of-way has been previously cleared. Regrowth has possibly occurred.
The Contractor shall be responsible for clearing any brush on the right-of-way that impacts the installation of the line. Some of the right-of-way is in an inhabited urban environment. This may take many forms such as yards, cause ways, medians, gardens, parks etc. Any trees cut at ground level shall have the stump removed to a point four inches below ground level.
Transmission line rights-of-way are 100 feet wide. The Contractor shall be liable for and indemnify Southwestern against any and all loss, claims, or suits (including costs and attorneys' fees) for or on account of injury to or death of persons, damage to, or destruction of property belonging to either Southwestern or others occurring by reason of the act or negligence of the Contractor, Contractor's employees, or agents in connection with or arising from the work.
Any areas damaged shall be restored to a condition as good as or better than found and to the satisfaction of Southwestern and the landowners. This is discussed in more detail elsewhere in these specifications.
1.3.2 Use of Government Land for Construction Purposes
All Contractor-owned equipment and materials shall be removed from Government-owned land or rights-of-way within two (2) weeks after completion of the project. The Contractor shall not use the right-of-way or any other Federal lands to store material or equipment. The Contractor shall obtain his own secure site for a lay down yard, equipment & material storage, show-up or any other administrative type functions.
1.3.2.1 Contractor's Investigations
The condition and availability of public and private roads and clearances, restrictions, bridge-load limits, bond requirements, and other limitations that may affect transportation and ingress and egress at the job site shall be investigated prior to submittal of a bid. As any restrictions are presumed to be known to the Contractor at the time of submittal of its bid, unavailability of transportation facilities or limitations thereon shall not become a basis for requests for equitable adjustments or claims for additional compensation, damages, or extension of time.
1.3.3 Use of Private Land for Construction Purposes
If private land is used, all necessary arrangements shall be made with the Owner and all rentals or other costs shall be paid by the Contractor.
1.3.3.1 Damage to Existing Property, Facilities and Crops
The Contractor shall be liable for all damage to lawns, including sprinkler systems, crops and other areas as a result of work on this project, both on and off the right-of-way. The Contractor shall endeavor to minimize damage to any areas occupied or crossed by the Contractor.
The Contractor shall be liable for all damage to streets, roads, curbs, sidewalks, highways, shoulders, ditches, embankments, culverts, bridges, or other public or private property (including property owner fences and gates inside and outside the rights-of-way), which may be caused by transporting equipment, materials, or personnel to or from work site or any other aspect of the work related to this project.
The Contractor shall make satisfactory and acceptable arrangements with the agency or owners having jurisdiction over or ownership of the damaged property concerning its repair or replacement.
The Contractor shall notify the owner of any property or facilities damaged immediately upon discovery of such damage. Whether discovered by the Contractor or owner, all repairs and restoration shall be in complete accordance with the specifications provided or as directed by the owner of damaged facilities and to the complete satisfaction of those owners. Any damage shall be repaired or scheduled for repair suitable to the owner of the damaged property within 72 hours of receiving notice from the owner of the damaged property. Should this not occur, Southwestern reserves the right to have repairs performed by a third party. The cost of the third-party repairs plus an administration fee determined solely by Southwestern shall be deducted from final payment.
The Contractor shall have a continuous cleanup and restoration program throughout construction. Cleanup and restoration associated with each tract shall be completed immediately once construction activities are completed on that tract.
