Amendment #1
3. Section H.8 Launch Delays is revised as follows:
FROM:
The delivery schedule and/or period of performance of this contract is based upon a spacecraft launch plus 60-day on-orbit checkout date of April 2023. In the event of a Government directed delay of the launch date, the Contracting Officer may inform the Contractor, in writing or by exercising the launch delay option(s) as priced out in Clause B.4 GSFC 52.217-90 Option to
Extend (SEP 2013), of the revised launch date. If the Government does not exercise a launch delay option as priced out in Clause B.4 GSFC 52.217-90 Option to Extend (SEP 2013), and utilizes the authority of this clause the Government will allow the Contractor to submit a proposal for the effect of this delay on the cost, delivery schedule, or other terms of the contract. This may result in an equitable adjustment to the Firm Fixed Price and delivery schedule or period of performance. Failure to agree to an adjustment shall be considered as a dispute under the Disputes clause. However, nothing in this clause shall excuse the Contractor from proceeding with the contract as extended. In the event of a launch delay the Government reserves the right to exercise a launch delay option as stated Clause B.4 GSFC 52.217-90 Option to Extend (SEP 2013), the authority of this clause, or a combination of both during contract performance.
