About this file

This is a vendor compliance document issued by the City of San Angelo, Texas Purchasing Division regarding reciprocity requirements for non-resident vendors bidding on city contracts. The document outlines compliance procedures under Texas Government Code 2252.002, which governs how non-resident vendors must structure their bids relative to Texas resident vendors. Non-resident vendors, defined as contractors whose corporate offices or principal place of business is located outside Texas, are required to complete Section A of the form by identifying their state of principal business location and specifying the percentage by which they must underbid Texas resident vendors, as determined by their home state's reciprocity laws. Alternatively, if a non-resident vendor's home state does not require underbidding, they must indicate that no such requirement exists. Texas resident vendors must complete Section B by confirming their principal place of business or corporate offices are located within Texas. The document requires an authorized agent to print the vendor name, address, and sign the form with date.

The reciprocity requirement does not apply to contracts involving federal funds. Failure by out-of-state or non-resident contractors to complete the appropriate section will result in automatic disqualification. The form is submitted as part of vendor proposals for the City of San Angelo's Equipment Financing procurement, in which the Fleet Services Division is seeking proposals for approximately $4-5 million in construction and street repair equipment to be purchased through a separate Request for Bid and/or purchasing cooperatives.

Vendor Compliance with Reciprocity on Non-Resident Vendors

Texas Government Code 2252.002 provides that, in order to be awarded a contract as low vendor, a non-resident vendor must bid projects for construction, improvements, supplies or services in Texas at an amount lower than the lowest Texas resident vendor by the same amount that a Texas resident vendor would be required to underbid a non-resident vendor in order to obtain a comparable contract in the state in which the non-resident’s principal place of business is located.

A non-resident vendor is a contractor whose corporate offices or principal place of business is outside of the state of Texas. This requirement does not apply to a contract involving Federal funds. The appropriate blanks in Section A must be filled out by all out-of-state or non-resident vendors for your submission to meet specifications. The failure of out-of-state or non-resident contractors to do so will automatically disqualify that vendor. Texas resident vendors must check the blank in Section B.
