About this file

This is a compliance procedure document issued by the Harris County Department of Economic Equity and Opportunity (DEEO) that establishes guidelines for M/WBE (Minority/Women Business Enterprise) trucking companies to demonstrate commercially useful function (CUF) and receive M/WBE credit on Harris County contracts, including the Dinner Creek Stormwater Detention Basin - Phase 1 project for the Harris County Flood Control District valued at approximately $35.6 million. The document outlines the fundamental requirements that M/WBE trucking firms must satisfy, including ownership and operation of at least one truck with one employee driver, performance of at least 30 percent of subcontract work with their own forces, and exclusive management and supervision of trucking operations without contrived arrangements. M/WBE firms must be certified by Harris County and may receive 100 percent credit toward participation goals for transportation services provided using owned and operated trucks with employee drivers.

The compliance framework addresses multiple trucking arrangements and their corresponding credit calculations: M/WBE firms leasing additional trucks from non-M/WBE firms while employing their own drivers receive 100 percent credit, while leased trucks exceeding the ratio of one leased truck per owned truck generate credit only for fees and commissions. Vendors utilizing M/WBE trucking companies must submit W-9 forms, current insurance documentation, and proof of truck ownership or registration with their M/WBE Utilization Plans. DEEO offers courtesy utilization plan reviews for submissions made up to five business days before solicitation closure, requiring vendors to provide completed and signed utilization plans, letters of intent, M/WBE certifications, and good faith efforts documentation. Contact information for additional guidance is provided through the DEEO office at 1001 Preston, Suite 670, Houston, TX 77002, (713) 274-1400, or DEEO@eeo.hctx.net.
