About this file
This is a Payment/Performance Bond document issued by the Great Lakes Water Authority (GLWA) in Michigan for Requisition No. 0008187, covering the Primary Area Gas Detection System Upgrade and Switchgear Replacement at Electrical Building EB-20 at the Water Recovery Facility (WRRF). The document serves as a template for contractors to provide both payment and performance bonds as required by Michigan Public Act 213 of 1963, as amended. The payment bond protects claimants supplying labor and materials to the contractor or its subcontractors, while the performance bond ensures the contractor faithfully performs all undertakings, covenants, terms, conditions, warranties, and guarantees within the contract time and during any correction period. Both bonds are subject to the same underlying contract documents and remain in full force regardless of changes to contract price, contract time, or substitutions to the contract documents.
The surety providing the bonds must be licensed by the Michigan State Insurance Bureau, acceptable to GLWA, and maintain specified Best's ratings and financial size categories as currently rated by A.M. Best Company, unless otherwise authorized by GLWA. The surety must also designate an agent who is either a resident of Michigan or maintains a principal office in the state. The bond amounts, effective dates, and specific Best's rating requirements are to be filled in by GLWA at the time of contract award. The prevailing party in any suit on either bond is entitled to recover reasonable attorneys' fees as part of the judgment. Both bonds are executed pursuant to Michigan statutes and remain enforceable to the full extent provided by law, with all other provisions remaining in full force and effect even if any individual provision is deemed illegal or unenforceable.
