About this file
This Scope of Work document, issued by the State of Utah Division of Purchasing, establishes the requirements for a statewide cooperative contract to supply frozen and cooler food products to eligible users including state departments, institutions, agencies, political subdivisions, and authorized nonprofit organizations. The contract encompasses a comprehensive range of products spanning cooler/refrigerated foods such as deli meats, prepared proteins, pre-cut vegetables, and refrigerated beverages, as well as frozen foods including proteins, seafood, vegetables, bakery items, prepared meals, and desserts. All products must meet USDA Grade A standards where applicable, with locally sourced options prioritized whenever feasible. The contract term is five years, with the pricing guarantee period fixed at three months. Contractors are required to maintain FDA registration and USDA approval for applicable facilities, implement HACCP plans, obtain GFSI certification under standards such as SQF or BRCGS, comply with Buy American provisions for school lunch programs, and ensure proper labeling for allergens and ingredient declarations. Delivery must occur Monday through Friday between 6:00 a.m. and 3:00 p.m., with lead times not exceeding 7–10 business days after order receipt on an F.O.B. destination, freight prepaid basis.
Pricing is structured as a fixed fee or markup percentage from supplier cost and must be posted on the Purchasing website with no retroactive adjustments permitted. Contractors must provide online ordering capabilities with a maximum minimum order requirement of $600 and no case count limits, supported by a local authorized representative available Monday through Friday between 9:00 a.m. and 4:00 p.m. for customer service inquiries requiring response within 24 hours. Price increase requests require submission at least 10 days in advance with supporting documentation such as manufacturer notifications or cost index charts, while any cost decreases must be reflected in corresponding price adjustments to the State. An administrative fee of 0.75 percent is assessed on the contract. The RFP may result in multiple awards based on a tiered evaluation process requiring vendors to meet mandatory minimum requirements, score at least 455 of 700 technical evaluation points to advance to cost evaluation, and achieve a combined minimum of 650 of 1,000 total points to receive an award. Previous spending on the related MA3784 contract between 2022–2025 totaled approximately $48,524,545.42, though contract awards do not guarantee sales volume.
