About this file

This document is a Department of the Army Nationwide Permit (NWP) verification letter from the U.S. Army Corps of Engineers, Sacramento District, issued to the City of Visalia for the Cameron Creek Recharge project. The project involves constructing three new reinforced-concrete check-structure facilities within Cameron Creek to utilize the creek as a linear groundwater recharge facility. The approximately 8-acre project site spans three separate locations along 1.75 miles of the creek, located at Latitude 36.306719°, Longitude -119.250411° in Tulare County, California. The specific authorized activities include placing 140.8 cubic yards of concrete fill and 99.8 cubic yards of rip rap into 168 linear feet of Cameron Creek, resulting in permanent impacts to 0.103 acre and temporary impacts to 0.0028 acre. The permit is valid until March 14, 2026, with specific conditions requiring weekly Best Management Practices (BMPs) inspections and work to be conducted only when the project area is naturally dewatered.

The permit is authorized under Nationwide Permit Number 59 for Water Reclamation and Reuse Facilities, subject to Section 404 of the Clean Water Act. The City of Visalia must comply with all terms and conditions of the Central Valley Regional Water Quality Control Board's Clean Water Act Section 401 Water Quality Certification. Within 30 days after completing the authorized work, the permittee must sign and return a Compliance Certification to the U.S. Army Corps of Engineers. The project is associated with a November 2024 Nationwide Permit Supplemental Information prepared by Provost & Pritchard Consulting Group, and the permit is contingent on adhering to specific environmental protection and construction management requirements.

Dear Ms. Keenan:

We are responding to your January 12, 2025, pre-construction notification for a Department of the Army (DA) permit for the Cameron Creek Recharge project. The approximately 8-acre project site includes three separate locations within Cameron Creek along approximately 1.75 miles of the creek, centrally located at Latitude 36.306719°, Longitude -119.250411°, in the City of Visalia, Tulare County, California.

Based on the information you provided to this office, the Cameron Creek Recharge project involves the discharge of fill material into 0.103 acre of waters of the U.S. for the construction of three new, reinforced-concrete check-structure facilities within Cameron Creek to utilize the Creek as a linear recharge facility for groundwater, subject to Section 404 of the Clean Water Act. The construction activities will require the excavation of 0.0028 acre of the streambed to facilitate construction of the three check facilities. The specific activities that require DA authorization are the placement of 140.8 cubic yards (CY) of concrete fill and

99.8 CY of rip rap into 168 linear feet of Cameron Creek. These activities will result in permanent impacts to 0.103 acre and temporary impacts to 0.0028 acre of Cameron Creek.

The proposed activities would be conducted in accordance with the Cameron Creek Liner Recharge Project plans dated September 6, 2024 (Enclosure 1).

We have determined that activities in waters of the U.S. associated with the project are authorized by Nationwide Permit Number (NWP) 59, Water Reclamation and Reuse Facilities. You must comply with all terms and conditions of the NWP and applicable regional conditions. Enclosed is information about the NWP terms and conditions (Enclosure 2). In addition, your work must comply with the following special conditions:

1. You shall comply with all terms and conditions of the enclosed Central Valley Regional

Water Quality Control Board Clean Water Act March 28, 2025, Section 401 Water Quality Certification WDID# 5C54CR00154 (Enclosure 3).

2. You shall conduct all work when the project area is naturally dewatered. No work shall be conducted in flowing water.

3. Prior to initiation of any construction activities in waters of the U.S. authorized by this verification, you shall install construction best management practices (BMPs) as identified in the November 2024, City of Visalia Nationwide Permit Supplemental Information, prepared by Provost & Pritchard Consulting Group, which is hereby incorporated by reference as a condition of this verification. You shall ensure the BMPs are inspected weekly, and maintained in good condition while ground disturbing activities are occurring, until construction activities in waters of the U.S. authorized by this verification are complete. All BMPs shall remain until construction activities within 25 feet of waters of the U.S. are completed and all disturbed soils are stabilized.

Within 30 days after completion of the authorized work, you must sign the enclosed Compliance Certification and return it to this office.

This verification is valid until March 14, 2026, when the existing NWPs are scheduled to be modified, reissued, or revoked. Furthermore, if you commence or are under contract to commence this activity before the date the NWP is modified, reissued, or revoked, you will have 12 months from the date of the modification, reissuance or revocation to complete the activity under the present terms and conditions. Failure to comply with the general and regional conditions of this NWP, or the project-specific special conditions of this authorization, may result in the suspension or revocation of your authorization.
