3. OBJECTIVES:

A. Project Execution Strategy for Construction, Design and CQM Contracts:

1. The project is planned to be contracted for delivery using a Tradeoff source selection procedure. The Project Construction Documents (CDs) are being developed (currently at 100%) and construction will be completed utilizing Building Information Modeling (BIM). The design and construction shall be in compliance with the NIH Design Requirements Manual (except where variance is granted). The Period of Performance (POP) Delivery at time of award will be determined with input from the CQM Contractor and the Construction Contractor, but currently planned as noted on the breakout request within this document. This POP is expected to require adjustment based on unforeseen conditions/changes to the project scope, however, this contract can make the assumptions noted as a baseline for their proposals.

This Construction Contract will be commenced in the spring of 2021 as the funding has been previously received via the CARES Act. The Government’s intent is to buildout and commission the new structure as soon as possible.

C104385 8 January 2021 Page 4 of 15

2. The Architectural/ Engineering Firm (A/E) providing the Construction Documents also created a draft Quality Plan for the project and may be engaged as the Commissioning Agent. While the design and planning for Commissioning will be included in the A/E contract, the actual in field Commissioning is to be completed through the Quality Control Management Contract. All Commissioning will be completed by a certified Commissioning Agency; The responsibility of the field Commissioning is the CQM Contractor, with approval from the COR.

3. The NIH intends to engage a CQM Contractor under this agreement to support the Project Quality Assurance ensuring that the project is executed in accordance with contract documents to the level of quality specified and in accordance with the project schedule and any adjustments thereto. The CQM Contractor must use Good Document Practices throughout the project period of performance.

B. Order Statement of Objectives (SOO)

1. The Objective of this Order is to ensure Project Quality Assurance (QA).

2. QA involves the means by which the Government protects its interests and it inherently includes CQM. With assistance from the CQM, the Government ensures that the Construction Contractor Quality Control (QC) and Quality Control Plan (QCP) are working effectively and construction complies with the quality established by the construction contract and associated CDs.

3. CQM is the performance of tasks, which ensure that construction is performed according to CDs, on time, within a defined budget, and a safe work environment.

4. For a construction project, quality begins with requirements carefully developed, reviewed for adherence to existing guidance, and ultimately reflected in criteria and design documents (Construction Documents, CDs) which accurately address these needs. Therefore, the designer establishes the quality standards and the Construction Contractor, in building to the quality standards in the plans and specifications, controls the quality of the work. With that stated, it is the requirement of this CQM contract to influence and guide the proper insertion of Quality Assurance measures into the final Construction Bid Documents prior to issuance in February 2021.

5. The purpose of CQM is the Government’s efforts, separate from, but in coordination and cooperation with the Construction Contractor, to ensure that the quality set by the plans and specifications is achieved. CQM is the combined effort of the Construction Contractor and the Government.

6. The Construction Contractor has primary responsibility for producing acceptable quality construction through compliance with construction plans, technical specifications, NIH policies and requirements, the Contractor’s QCP and accepted standards of the industry.

7. CQM, as the objective of this Task, enables the Construction and Design Contractors and Government personnel to be proactive and, thereby, prevent mishaps and deficiencies from occurring.

C104385 8 January 2021 Page 5 of 15

8. If it is found that the Contractor is working in a reactive mode and relying on inspection and/or QA to achieve required quality of product, this means that CQM is either not understood or that the philosophy has not been adopted.

The Contractor shall take corrective actions including not exercising an option year if necessary or as acceptable to the Government should this occur.
