PURPOSE OF SOLICITATION AMENDMENT:
The purpose of this amendment is to address questions regarding 75N93024R00002.
Question 1: The sample task order proposes firm fixed price, but the business plan Excel sheet provided with the RFP requires cost reimbursement. Which method should one follow for pricing?
Answer 1: Firm fixed price or cost reimbursement may be used. If the sample task order proposes firm fixed price, a firm fixed price may be used and the cost reimbursement excel spreadsheet does not need to be used.
Question 2: To calculate the 7-year estimated cost in the business plan excel sheet, please provide the estimated number of task orders to be issued during one year.

AMENDMENT #5
Answer 2: It is estimated about 7-10 task orders per year.
Question 3: Invention: If the contractor receives a task order, any new invention or discovery (which is or may be patentable) made by the contractor during process and manufacturing, that invention belongs to the contractor, correct? The contractor does not share any intellectual property to, for example, the API in the task order, correct?
Answer 3: The requestor, and not the contractor, retains the intellectual property of the product being worked on. If a new invention arises from the contracted work, it is assigned to the requestor and not to the contractor.
Question 4: Contract/Task Order: Can the contractor excuse from performing a contract or task order because of unavailability in resources or time? Alternatively, before any contract or task order assigned, the contract would have to submit a Task Order Request for Proposal (TORFP), correct?
Answer 4: Regarding the TORFP, the Government will post a TORFP to the offeror task area pool for offerors to respond to the TORFP. Offerors in the task area pool are welcome to propose a bid or decline a bid to the TORFP. If an offeror decides to bid on a TORFP and is awarded the task order, it is expected the offeror to complete the necessary work for the task order.
