The purpose of this amendment is to:
a) Incorporate the following information provided via IFB Update#1 posted on November 4, 2020 as an integral part of the IFB;
1. There is a new requirement imposed by the Vietnam’s Ministry of National Defense (MND) that the site access will only be granted for the persons who are currently in Vietnam or have arrived in Vietnam at least 30 days prior with an evidence of proper quarantine. The individuals to be registered for a site walk must meet this condition.
2. To accommodate the above requirement, the deadline for registration of the site walk and pre-bidding conference at Bien Hoa on November 30, 2020 is extended to be no later than November 6, 2020 at 12.00 PM (noon) Vietnam local time.
3. The virtual pre-bidding conference will be on November 6, 2020 at 7.30 am to 9.30 am (previously to 10.30 am) Hanoi local time.
b) Include Slide Presentation of the Virtual Pre-bidding Conference held on November 6, 2020;
c) Clarify that the both the site walk and the pre-bidding conference on November 30, 2020 will be in-person only and there will be no virtual conference. All questions and answers during these events, if any, will be shared via beta.sam.gov as an amendment to the IFB; and,
d) Incorporate questions received and answers thereof as an integral part of the IFB.

Amendment No. 1 to IFB No. 72044020B00001 USAID Second Interim Measures for Dioxin Remediation at Bien Hoa Airbase
Questions Received Pertaining to IFB No. 72044020B00001 and Corresponding USAID Answers:
1. Is the bonding obligee and US entity with a US address? This is being asked because the bondable work is being conducted in a foreign county (Vietnam).
USAID: The bonding obligee is the United States of America (the Government). The Principal (the Contractor)’ s address is normally where the Principal's legal registration and business address is.
2. Is the jurisdiction for any dispute that may involve bonding within the US?
USAID: The jurisdiction/applicable law will be the US for both US-issued and local/international-issued bonds and bid guarantee.
3. Please clarify if that jurisdiction of this solicitation is through the United States government or through the Vietnamese government.
USAID: The jurisdiction of this solicitation is the U.S. and the contract is governed by U.S. law. Please also refer to response to Question No. 2.
4. Will bonds run through USAID or another agency? If the latter, please state which agency and if they are an
American or Vietnamese agency.
USAID: The bonding obligee is the U.S. Government.
5. Please clarify if the payment and performance bonds are 30% of the contract value, as described on page 22 of the IFB, or 100% of the contract value, as described on page 53.
USAID: Performance and Payment Bonds are at 30% of the Contract value as indicated in sub paragraph F.5.1 Bonds or Guarantees for Contract Performance of the IFB.
6. If the Prime Contractor is an American firm with a contractor’s license issued within one or multiple States of the
United States, which is currently active, can this be used in place of the “Construction Operation Capabilities Certificate” identified in the IFB?
USAID: No. A U.S. contractor's license does not substitute for a Vietnamese Ministry of Construction Operation Capabilities Certificate. Please refer to the Vietnamese regulations noted in paragraph C.5 REQUIRED REGISTRATION AND LICENSES in the IFB.
7. Please state the venue where dispute resolutions will be handled.
USAID: As above, legal jurisdiction and applicable law for any disputes concerning the bond will be in the U.S.

8. The IFB page 18: subsection C.11; Stage 2 Priority Work Year 1; item e; No. 8- identifies DU SW-03A for excavation. What is the estimated m3 quantity of soil for removal and stockpiling based on an average excavation depth of 30 cm?
USAID: The drawing 30C-03 provides the area of SW-03A. The soil volume can be estimated based on the excavation depth and the area provided.
9. The IFB page 18 subsection C.11; Stage 3 Priority Work Year 2; item b; No. 5- identifies MND-A42, SW-03B and SW-01-02 for excavation. What is the estimated m3 quantity of soil for removal and stockpiling based on an average excavation depth of [160 cm (MND-A42)], [90 cm (SW-03B)] and [120cm (SW-01-02)]? Note: The cm depths identified in questions 1 and 2 are based on drawings 30C-06, 30C-07 and 30C-08.
USAID: The drawings 30C-02, 30C-03, 30C-04 provide the areas of SW-01-02, SW-03B and MND-A42. The soil volumes can be estimated based on the excavation depth and the area provided.

13. Bid and bonds are the domestic banks/financial institutes acceptable?
USAID: USAID does not recommend or endorse any particular Vietnamese or U.S. financial institution, rather, the financial institution issuing any financial guarantees must be a recognized, credible and reliable financial institution.
