Amendment No. 2 to IFB No. 72044020B00001 USAID Second Interim Measures for Dioxin Remediation at Bien Hoa Airbase
Questions Received Pertaining to IFB No. 72044020B00001 and Corresponding USAID Answers:
1. Materials, equipment, contractor personnel and vehicles will be brought in through which gate(s)?
USAID: Project gate is Gate 3. In special situations, other gates can be used with special requests. However, there will need to be a strong justification. USAID will arrange to open the currently abandoned gate near A42 and vehicles and equipment may enter there to haul soil from A42.
2. How do contractors move or travel inside the construction site?
USAID: Two types of areas -- 1) areas handed over to USAID by ADAFC, e.g., Pacer Ivy and the Southwest area excavation areas - contractor have full freedom to move within these areas, 2) areas which have not been handed over between ADAFC and USAID - contractor must request permission to move in these areas from ADAFC providing a schedule of movements and justification for movements, e.g., movement between Pacer Ivy and the Southwest areas. USAID will facilitate communication between the IM2 contractor and ADAFC for movement requests in non-hand over areas.
3. How do contractors move or travel inside the construction site?
USAID: Please see response to Question No. 2.
4. How are worker camps or accommodations to be arranged?
USAID: There are no overnight arrangements for access to the airbase. All contractors must leave the work site before 6 pm and cannot arrive before 6 am.
5. Field office space?
USAID: IM2 Contractor will propose their field office space. USAID will ensure sufficient space in the appropriate work areas.
6. Utilities for work scope and daily use?
USAID: The IFB describes power and water utility requirements. The contractor is responsible for making utility connections. Note that ADAFC operates utility services management on the airbase. USAID will support the IM2 contractor to ensure power and water utility access with ADAFC on the airbase. Bidders must be prepared to pay the cost of connecting to utility services and paying required service fees.
7. How are plants and trees in contaminated areas handled?
USAID: See Section 31 10 01 Site Preparation and Clearing.
Amendment No. 2 to IFB No. 72044020B00001 USAID Second Interim Measures for Dioxin Remediation at Bien Hoa Airbase
8. How to handle topsoil from contaminated areas? From uncontaminated areas like LTSA and topsoil from service/access roads?
USAID: The IFB specifies requirements for two types of topsoil: (1) Topsoil from contaminated areas, and (2) uncontaminated topsoil from the LTSA. Contractor must manage topsoil from contaminated areas in the same manner as other soil in the relevant decision units according to the contract requirements. Contractors must manage topsoils from the LTSA according to contract requirements. See the added General Note 5 to drawings 10C-07 and 10C-08 in Amendment No. 2 that clarifies requirements for removal and stockpiling of topsoil from the LTSA.
9. Bid Package preparation - Do contractors need to obtain a construction license beforehand? Why do we have a requirement for a design license when it is 100% construction?
USAID: Please see response to Question No. 32.
10. Signature on the amendment. Electronic signature is acceptable? Signed and scanned?
USAID: Each IFB amendment must be signed and submitted as part of the bid package in order for USAID to see that you have read and understand the IFB and its amendments. Electronic signature is acceptable.
11. Bid package submission – Can an offeror submit their offer with a link, or prefer attachments?
USAID: USAID prefers that Bidders send multiple emails. Total email size cannot exceed 20 MB. Multiple emails may be sent to accommodate the bid package size and content. All attachments must be in Adobe PDF, or MS Excel readable format. Bidders MUST NOT submit zipped files.
Please note that any bid form in PDF format must also be included in MS Excel format with formula shown. All electronic files must be “unlocked”.
If an Offeror sends an application by multiple emails, indicate in the subject line of the email whether the email relates to the technical or cost proposal, and the desired sequence of multiple emails (if more than one is sent) and of attachments (e.g. "no. 1 of 4", “no. 2 of 4”, etc.). USAID’s preference is that, to the extent practicable, the bid package be submitted as a single email attachment, e.g. that you consolidate the various parts of a bid package into a single document before sending it.
Prospective Bidders are reminded that the bid package must be in English.
12. In the HCTS after hauling, do we need to include a geotextile on the top of the dirt before covering with the required HDPE liner?
USAID: No, this is not required as shown in Drawing 20C-03.
THIS AREA IS INTENTIONALY LEFT BLANK
Amendment No. 2 to IFB No. 72044020B00001 USAID Second Interim Measures for Dioxin Remediation at Bien Hoa Airbase
13. IFB – Where to stockpile contaminated material during dewatering or testing? Inside the exclusion zone?
USAID: Contaminated soil must stay within the exclusion zone to dry (dewatering) before transporting to the relevant storage area. As noted in the "Table of Changes” added to the Technical Specifications (December 10, 2020), USAID has modified the Technical Specifications in the following manner for 01 57 13 - Environmental Mitigation: ADD the following to paragraph 1.04: “J. Stockpiles of contaminated soil and sediment must be located within established Exclusion Zones for the project.”
14. Quantity of workers at the site. Can more workers be added, more than the original registration.
USAID: USAID specifies no restrictions on the numbers of workers on site. However, Bidders should note that all workers must comply with health and safety requirements and contractors must request site access for each worker three weeks in advance of entry to work areas.
15. When I review the latest document, I still see the 20C 02 has issues. The drawing is not accurate since it still shows CMU blocks that have been removed. Can it be amended?
USAID: Please see the response to Question No. 40a and 40b.
16. Drawing -- The coordinates use the Vietnamese standard VN2000 and there is mention of a temporary survey benchmark - TBM2. Is this usable or do we need to establish a new benchmark?
USAID: Yes, benchmarks shown in the drawings, including TBM2, are available and usable.
17. Bid Opening time and information
USAID: The time for virtual bid opening will start from 9.00 am Hanoi local time. Details of the session will be sent to bidders’ representatives. Bidders are requested to provide names and e-mail addresses of their representatives no more than four persons per bid to USAID IFB POCs with the bid package.
18. Are we really going to get audited as part of the pre-award Financial Responsibility determination?
USAID: No. However, a financial and management survey will be conducted to assess the responsibility of the firm.
USAID will review the information provided as part of the bid package per L.2.14. Additional information and a pre-award survey may be conducted in accordance with L.2.16.
19. Could the USAID please provide the native CAD files for the drawings provided as Attachment J.3, specifically the ones related to construction of the LTSA and HCTS storage and the ones related to the Dig and haul, fencing and roadway, to allow for material take-offs.
USAID: The CAD files will not be provided prior to bid.
Amendment No. 2 to IFB No. 72044020B00001 USAID Second Interim Measures for Dioxin Remediation at Bien Hoa Airbase
20. Attachment J.2 BID FORM 0.17 Temporary Buildings and Facilities for Clients Consultants. The Bid Form requires a lump sum price for Item 0.17 - Temporary Buildings and Facilities for Clients Consultants. However, Section 01 52 13 of the Specifications only outlines requirements of the Contractors Field Office. Please provide specifications for the Consultant’s Office if that is meant to be part of the scope
USAID: There is no Item 0.17 listed in the Bid Form.
21. AttachmentJ.2 BID FORM 10.34 – Office at LTSA entrance. There is no design/specification provided for the Office at LTSA entrance. Please provide more details so that it can be priced appropriately
USAID: Section 13 34 23 Fabricated Structures is the specification for the LTSA field office.
22. C.7 Work by others. When the site of one contract is the necessary or convenient means of access for performance of work under another, the OWNER may grant privilege of access or other reasonable privilege to the contractor so desiring, to the extent, amount, and in manner and at time that the OWNER may determine. No OWNER determination of method or time or sequence or order of the work or access privilege must be the basis for a claim for delay or damage except under provisions of the Contract for temporary suspensions of the work. In order for us to efficiently sequence and schedule our approach to finish the work within the POP and accommodate work by others as stated, please provide us a schedule and description of planned operations by others in the vicinity of the Decision Units under this contract during.
USAID: After the contract award and submittal of the preliminary schedule, USAID will review with the Contractor to identify any potential conflicts with the work by others.
23. G.4 d Failure by the Contractor to report to the Administrative Contracting Office, any action by the Government considered to be a change, within 3 days in accordance with FAR 52.243-7 (Notification of Changes), waives the Contractor's right to any claims for equitable adjustments. The various terms in this IFB implies that this is viewed as a Construction Contract. Given that, FAR 52.243-7 may have been inappropriately included in the solicitation.
FAR 52.243-7 is intended for contracts requiring the acquisition of major weapon systems and we request it be removed from this contract. In accordance with FAR 43.205 Contract clauses, the appropriate Changes clause for this Construction Contract is 52.243-4. Reducing the normal 30-day change notification period to a 3-day period is especially unreasonable. It’s inclusion, without cause or explanation, implies unusual or unnecessary contract risk that contractors must consider in the bid for this work.
USAID: Thank you. FAR clause 52.243-7 in the IFB and the resultant contract will be replaced with FAR clause 52.243-4, including any reference to the number of days mentioned in association with both clauses as noted in your question.
24. G6.6.6 Submit executed copies of each Application for Payment to the Engineer/Construction Manager; all copies must be complete, including waivers of lien and similar attachments, USAID is requested to elaborate on what kind of lien waivers may apply under this contract and the circumstances or conditions when they may be exercised.
USAID: This will be determined during contract implementation.
Amendment No. 2 to IFB No. 72044020B00001 USAID Second Interim Measures for Dioxin Remediation at Bien Hoa Airbase
25. Specification 01 57 13, Environmental Mitigation. Specifications state all environmental monitoring will be performed by the Engineer/ Construction Manager who is then responsible for notifying the Contractor should monitoring limits be exceeded and if the Contractor should or must implement steps to mitigate the cause or condition. Tables in Appendix A, specifically the main “Mitigation & Monitoring” tables (Tables 1A, 1B, and 1C), suggest the responsible party for all monitoring is the Bien Hoa Airbase A&E Contractor.
a. Are all air, water, and soil sampling and their subsequent analyses, as well as monitoring for noise and vibration, plus all data management and reporting to be performed by USAID’s Engineer/ Construction Manager?
USAID: Yes, as stated in Specification 01 57 13, 1.04, I.4, “Environmental Monitoring will be performed by the ENGINEER/CONSTRUCTION MANAGER.” Engineer/Construction Manager is the Bien Hoa Airbase A&E Contractor identified in Appendix A.
b. If not, please define data quality objectives, sampling methods, requisite test or analytical protocols, data management and reporting requirements, and any ancillary monitoring (including frequencies and durations) for which the Contractor is responsible.
USAID: Not applicable, please see the response above.
c. Are there any monitoring, testing, or reporting requirements not listed in this spec section for which the Contractor is responsible? If so, please delineate the requirement(s) and frequencies or conditions that would trigger such sampling or testing event(s).
USAID: No other environmental monitoring. The Contractor has responsibilities in other specification sections for other types of monitoring, testing, or reporting.
26. Has USAID established a Price range to determine if an offeror’s bid is responsive? If a bid is substantially below the range, will the offer be considered acceptable?
USAID: No. Other than the magnitude of construction indicated in the IFB which is ‘more than $10 million’, price range is not established for this IFB. Price evaluation will be in accordance with Section M of the IFB.
27. May an offeror be permitted to provide a basis of estimates or supporting cost narratives?
USAID: Yes, particularly cost breakdown for large lump sum amounts. However, the Bid Form is the basis of estimation and final award decision
28. Attachment J.2 Bid Form, Bid Item 60, Total Day Works: Please provide additional clarification for the Total Day Works.
USAID: The Total Day Works item is a means by which the Contractor can be paid for additional work that the Owner specifically instructs the Contractor to do. The bid form uses a default of $500,000. The actual amount will be finalized as part of the award.
Amendment No. 2 to IFB No. 72044020B00001 USAID Second Interim Measures for Dioxin Remediation at Bien Hoa Airbase
29. Reference to Section M.1.3 (page 79): Can USAID please clarify the evaluation process for performing a “basic compliance check on the apparent lowest priced bid” to ensure that the proposed bid is “substantially responsive to IFB requirements.” Will the basic compliance check be a qualitative process?
USAID: No clarification is available at this time.
30. There is a discrepancy in some of the submittal due dates in the IFB and the Technical Specifications. Which submittal due dates prevail? Please clarify if the Plans are due 14 calendar days from the NTP or within 3 weeks after NTP? Please advise as this will impact the schedule of the start of work.
USAID: As noted in the "Table of Changes” added to Technical Specifications (December 10, 2020), USAID has modified the Technical Specifications so the submittal dates match those in the IFB.
31. In the Specs, Section 31 23 23-11 (Specs page 173), please clarify the requirement for testing to be conducted during construction:
a. Do we need to conduct all three tests or can we choose between the two methods (sand-cone vs nuclear gage)?
USAID: Contractor may choose either field density using nuclear density gage or field Density using sand-cone density apparatus.
b. In Note 3 above: Is that a correct understanding that they increase the frequency from 1 sample/500m2 (2 samples/1000m2) to 1 sample/450m2?
USAID: As noted in the "Table of Changes” added to Technical Specifications (December 10, 2020), USAID has modified the Technical Specifications in the following manner: so that there is one note for field density testing
Amendment No. 2 to IFB No. 72044020B00001 USAID Second Interim Measures for Dioxin Remediation at Bien Hoa Airbase
(regardless of method) as follows: “The test frequency must be increased to 1/lift/450 square meters for areas greater than one square meter compacted using hand-operated machines.”
32. C.5 REQUIRED REGISTRATION AND LICENSES "At the time of bid opening the Prime Contractor must (1) hold a valid Construction Operation Capability Certificate (in construction implementation and construction design at any grade, refer to Article 1, Sub-article 32 of Decree 100/2018/NDCP) or (2) submit with their bid the qualifying materials required to apply for a construction operations license for foreign contractors (refer to Article 70 of Decree 59/2015/NDCP and Article 1, Sub-article 38 of Decree 100/2018/NDCP)." "The scope of works of the present IFB is only construction activities as described in SECTION C. Additionally, Design works are already performed and Offerer shall comply with the approved plans, hence no design works are required except Shopdrawings and potential Design changes that do not require a design licence. Please confirm if a construction operation capability certificate in construction design is required? "
USAID: The construction design certificate requirement specified in Paragraph C.5 of the IFB is only required for shop drawings, and the Prime Contractor can subcontract for this as needed. A design certificate is not required at the time of bid opening. Paragraph C. 5 is replaced in its entirety with the following:
“C.5 REQUIRED REGISTRATION AND LICENSES

33. AMENDMENTS TO IFB ACKNOWLEDGEMENTS
"The Amendments acknowledgements (i.e: Q&A documents) will be summarized in ATTACHMENT J1.
Please confirm if the Prime bidder shall sign off and attach to the bid package the corresponding Amendments too?"
USAID: Yes, the prime bidder must acknowledge by signing and submitting with the bid package all amendments as per the IFB.
Amendment No. 2 to IFB No. 72044020B00001 USAID Second Interim Measures for Dioxin Remediation at Bien Hoa Airbase
34. SECTIONS AND ATTACHMENTS TO SIGN OFF (20201106+IM2+Pre-Bidding+Conference+72044020B00001) IFB and its amendments don’t stipulate that the sub-contractor shall sign off ATTACHMENTS or SECTIONS of the present IFB, However, the conference dated 06/11 says:

However, we intend to add a partner to improve the productivity of excavating and transporting, in the form of a joint-venture partnership with us. Please advise us :” Does the conversion from an independent contractor to a joint-venture contractor at present change the validity of bidder or not?”
2. In case this conversion is valid, do we need to complete any additional procedures for registration?
USAID: USAID will award (enter into) the contract to a legal entity that submits the bid package. If the conversion you are processing is completed and this Joint-Venture (JV) is legally registered, and meets the eligibility requirement, including DUNS and SAM registration as required by the IFB, then, the bid package submitted under this JV is considered responsive.
