Section III: Contract Clauses
INSTRUCTION TO OFFERORS
This requirement is for the contractor to provide all necessary facilities, materials, equipment, personnel, and other such things necessary to perform dry-dock repairs to the U.S. Coast Guard Cutter BLUEBELL (WLI 313), a 100' Inland Buoy Tender. A WLI's design limits its use to protected and inland waters. Open water transits are to be avoided whenever possible due to a significant reduction in righting arm due to rolling in sea states greater than 6 feet. WLI-100's are not crewed for continuous steaming and are normally limited to daylight transits. Due to crewing, a 2-day transit is the limit of crew endurance under normal operations. A WLI-100 is capable of transiting approximately 85 miles a day at an economical speed of 8 MPH, assuming a ten-hour transit period each day to mitigate crew fatigue. The U.S Coast Guard requires Inland Buoy Tenders to an area no greater than 100 nautical miles (nm) from the cutter's homeport and no open water transits. This vessel's home port is at 6767 N. Basin Ave Portland OR, 97217. All work is to be performed at the contractor's facility.
1. This requirement will be competed as 100% Small Business Set-aside. Award from this solicitation will be made to the responsible offeror whose proposal conforms to all the submission requirements outlined in the instructions to offerors and is determined to provide the best value to the Government, which will evaluate the price and non‐cost factors. Technical andpast performance factors when combined, are more importance than price. Under Best Value, the Government may acceptother than the lowest priced proposal if the perceived benefit warrants the additional price. Per FAR Part 2, Best value is defined as "the expected outcome of an acquisition that, in the Government's estimation, provides the greatest overall benefit in response to the requirement."a. All offerors shall provide a written statement that all repair work done in accordance with the terms, conditions, and attachments to this solicitation are under a minimum of a 60-day warranty. Failure to provide a warranty statement may result in the proposal not being considered for award.b. All offerors shall fully comply with terms and conditions of the RFP and address all solicitation requirements to be eligible for award. The solicitation document must be completed in its entirety in order to be compliant with the full solicitation. Offerors that take exception to any term or condition of this RFP, propose any additional term or condition, or omit any required information may not be considered for award.

(ii) Any reasonable payment to a person, other than an officer or employee of a person requesting or receiving a covered Federal action or an extension, continuation, renewal, amendment, or modification of a covered Federal action if the payment is for professional or technical services rendered directly in the preparation, submission, or negotiation of any bid, proposal, or application for that Federal action or for meeting requirements imposed by or pursuant to law as a condition for receiving that Federal action. 1352. An imposition of a civil penalty does not prevent the Government from seeking any other remedy that may be applicable.
(2) Contractors may rely without liability on the representation made by their subcontractors in the certification and disclosure form.
(f) Cost allowability. Nothing in this clause makes allowable or reasonable any costs which would otherwise be unallowable or unreasonable. Conversely, costs made specifically unallowable by the requirements in this clause will not be made allowable under any other provision.
(g) Subcontracts.
(1) The Contractor shall obtain a declaration, including the certification and disclosure in paragraphs (c) and (d) of the provision at FAR 52.203-11, Certification and Disclosure Regarding Payments to Influence Certain Federal Transactions, from each person requesting or receiving a subcontract under this contract that exceeds the threshold specified in FAR 3.808 on the date of subcontract award. Each subcontractor certification shall be retained in the subcontract file of the awarding Contractor.
(3) The Contractor shall include the substance of this clause, including this paragraph (g), in any subcontract that exceeds the threshold specified in FAR 3.808 on the date of subcontract award.

(2) Intended, by the gratuity, to obtain a contract or favorable treatment under a contract.
(b) The facts supporting this determination may be reviewed by any court having lawful jurisdiction.
