The U.S. COAST GUARD SHORE INFRASTRUCTURE LOGISTICS CENTER (SILC) invites you to submit a proposal, via the Acquisition of Commercial Items (FAR Part 12) to provide commercial Housing Maintenance Services FOR U.S. COAST GUARD TRACEN CAPE MAY, NJ.

This requirement is issued as a 100% Competitive 8(a) SET-ASIDE IN ACCORDANCE WITH FAR

SUBPART 19.8.

The North American Industry Classification System (NAICS) code that applies to this Request for Proposal (RFP) is 561210 (Facilities Support Services), with an applicable size standard of $35.5M.

IMPORTANT NOTICES

(1) The due date for proposal (s) (Volume I and Volume II in response to the RFP is scheduled for 29 August 2018, 2:00 PM, Eastern Time. All required proposal submissions must be submitted as directed in 52.212-1 Instruction to Offerors. Proposals submitted must be in compliance with all specifications and requirements as called out in the RFP. Failure to do so may result in the proposal being eliminated from further consideration for award.

(2) Prime Contractor/Subcontractor Arrangement and/or Contractor Team Arrangement (CTA)

Offerors shall identify any contractor teaming arrangement(s) or Prime Contractor/Subcontractor Arrangement(s) in their proposal. The offeror must clearly explain the portion of effort to be performed by each contractor. Prime Contractor/Subcontractor Arrangement and Contractor Team Arrangement (CTA) for this procurement shall be defined as described in the table below. If a contractor teaming arrangement is to be used, the offeror must provide a signed copy of the contractor teaming arrangement (CTA) with their proposal. The SBA 8(a) joint venture rules are found primarily at 13 C.F.R. § 124.513. Also see FAR Subpart 9.6 – Contractor Team Arrangements.

Contractor Team Arrangement (CTA) based on a Joint Venture

Prime Contractor/Subcontractor Arrangement

Each team member is combined into one entity considered to be the prime and at least one team member must be 8(a) certified.

Only the prime contractor must be 8(a) certified.

The combined team cannot exceed the size standard under the SBA’s affiliation rules. (see Exceptions below)

Only the prime must be within the size standard.

Each team member is responsible for duties addressed in the CTA document.

The prime contractor cannot delegate responsibility for performance to subcontractors.

Each team member has privity of contract with the government and can interact directly with the government.

Only the prime contractor has privity of contract with the government and can interact with the government.

The prime contractor is responsible for its subcontracting activities. (The use of subcontractors requires prior approval by the ordering activity.)

The ordering activity is invoiced at unit prices or hourly rates as agreed in the contract schedule.

The ordering activity is invoiced in accordance with the prime contractor's contract schedule, including any applicable price reductions.

Exceptions: Two limited exceptions to the general rule that members of a joint venture are presumed to be affiliated with each other for size determination purposes include: SBA Approved Mentor Protégé Joint ventures and 8(a) Joint Ventures. Under the Mentor Protégé Joint venture, the protégé must be a “socially and economically disadvantaged” small business concern that is 8(a) certified. Under the 8(a) Joint Venture, both contractor’s must be 8(a) certified.

(3) All contractor personnel working under this contract must be U.S. Citizens with no felony convictions.

(4) SITE VISIT: Site Visit at TRACEN Cape May, NJ will be conducted on 15 August 2018 at 0900 EST.

Attendance for the Site Visit is HIGHLY ENCOURAGED. All Questions shall be submitted in writing using the attached Question Worksheet NLT 3:00 PM Eastern Time 22 August 2018 to Cynthia Floyd at Cynthia.e.floyd@uscg.mil use in the subject line “ TRACEN Cape May, NJ Housing – Company Name”.

Questions will not be taken or answered during the site visit. All answers will be prepared by SILC and sent to all mailto:Cynthia.e.floyd@uscg.mil

Interested Vendors via email.

For security reasons and procedural expediency, each Vendor team may be represented by no more than three (3) members. In order to execute a background check, the offeror shall submit the name, date of birth, and the address of each individual attending the site visit to the Anti-Terrorism/Force Protection Officer, OSS4 Jeff Wilson, via e-mail at jeff.a.wilson@uscg.mil no later than 10:00 am Eastern Time 09 August 2018. The address submitted shall be that as it appears on the individual’s driver’s license. DO NOT PROVIDE SOCIAL SECURITY NUMBERS (SSN). In addition, if driving a vehicle on base, the driver must obtain a pass at the gate and be able to provide registration and proof of insurance.

During the TRACEN Cape May site visit, all smart phones or cell phones are permitted on base but must be turned off during the site visit. Cameras and photography will be allowed. Each visitor will be required to sign in and must stay with the site “tour” at all times. No other meetings for discussions with Government personnel shall be permitted. The Government reserves the right to inspect all material, briefcases, etc., entering or leaving Government facilities.

CONTRACTORS NOT COMPLYING WITH THESE RULES AND PROCEDURES MAY BE PRECLUDED FROM

FURTHER PARTICIPATION IN THIS SITE VISIT.

NOTICE TO OFFERORS

This procurement solicitation is being processed under a Partnership Agreement (PA) between the U. S.

Department of Homeland Security (DHS) and the U. S. Small Business Administration (SBA), under which the SBA has delegated to the DHS, authority to enter into 8(a) contracts directly with eligible 8(a) firms. The PA implements a streamline procurement process for awards under the 8(a) program.

Under this agreement, the Coast Guard Shore Infrastructure Logistics Center East (COB-2) will make the award directly to the 8(a) firm. SBA will not be a signatory to the award resulting from this solicitation.

SBA will, however, retain responsibility for 8(a) certification, administering other eligibility related issues under the 8(a) program, and be available to 8(a) firms for counseling and assistance.

NOTICE FOR FILING AGENCY PROTESTS

United States Coast Guard Ombudsman Program

It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time- consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government

Accountability Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute

Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or

Ombudsman.

Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for

Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman:

solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program.

Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the

Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted electronically to OPAP@uscg.mil and the Contracting Officer or by hand delivery to the Contracting Officer.

Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting Officer or the

Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed.

Notwithstanding the Contractor’s responsibility for total management during the performance of the contract, the administration of the contract will require maximum coordination between the Government and the contractor. The individuals listed below will be the Government points of contact during the performance period as follows:

The Base Services and Support Contracting Section (BSS), U.S. Coast Guard, Shore Infrastructure Logistics Center (SILC) will perform all administration under this contract.
